Is Online Betting Legal in Colorado? Rules, Taxes, and Help

Yes, online sports betting is legal in Colorado. The state has allowed licensed sportsbooks to accept mobile and web wagers since May 1, 2020, as long as you are at least 21 and physically inside Colorado when you place the bet. Online casino games — slots, blackjack, roulette, and poker played over the internet — are not legal in the state.

What You Can Legally Bet On

Licensed Colorado sportsbooks take wagers on professional sports, college athletics, Olympic events, and certain esports competitions where the governing body meets integrity standards. Daily fantasy sports operate under a separate framework that treats those contests as skill-based. Horse racing is available through approved advance deposit wagering platforms.

Two limits on college betting matter. You can wager on the outcome of a college game or the point spread, but you cannot place proposition bets on individual college athletes, such as how many yards a specific quarterback throws or how many points a player scores. Any event involving participants under 18, including high school sports, is off limits entirely.

Online Casino Games Are Not Legal

Colorado’s gaming laws authorize sports betting in the digital space and nothing else. Internet versions of slots, blackjack, roulette, and poker remain illegal. Offshore websites that offer those games operate without state oversight, provide no consumer protections, and leave you with no recourse if an operator refuses to pay out.

Who Can Place a Bet

You must be at least 21 to create an account, deposit funds, or place a wager with any Colorado sportsbook.1Colorado Department of Revenue. Sports Betting Regulations 1 CCR 207-2 Signing up requires your Social Security number, date of birth, and a government-issued ID. Operators verify this through multi-source authentication that can include third-party and government databases. Accounts that fail verification are frozen or permanently closed.

You also have to be physically inside Colorado at the moment you place each bet. Every app uses geofencing software that checks your location in real time, and a signal from across the state line in Kansas or Wyoming will block the wager.1Colorado Department of Revenue. Sports Betting Regulations 1 CCR 207-2 This is federal law as well as state. The Wire Act prohibits transmitting bets across state lines unless both states have legalized betting on that event.2Office of the Law Revision Counsel. 18 U.S. Code 1084 – Transmission of Wagering Information; Penalties

People Who Cannot Bet

Age and location aside, state regulations bar several groups from placing sports bets:

  • Athletes, coaches, and referees cannot bet on events overseen by their sport’s governing body.
  • Managers, handlers, athletic trainers, and others with authority over participants are barred.
  • Anyone with access to non-public information about an event in their sport cannot wager on that sport.
  • You cannot place a bet on behalf of another person.

These rules sit on top of league-level policies. The NFL, for example, bans its personnel from entering a sportsbook during the season and from betting on any professional or college sport, while the NHL only prohibits bets on its own games.

Taxes on Your Winnings

Sports betting winnings are taxable at both the federal and state level. Most bettors don’t think about this until tax season, and that’s when problems appear.

Federal Reporting and Withholding

For 2026, a sportsbook must issue you a Form W-2G when your winnings reach at least $2,000 and are at least 300 times your wager. The $2,000 threshold was adjusted upward for inflation starting in 2026 and will continue to adjust annually. Federal income tax is automatically withheld when a payout exceeds $5,000 after subtracting the wager, provided the winnings are also at least 300 times the bet.3IRS.gov. Instructions for Forms W-2G and 5754 (Rev. January 2026)

You still have to report all gambling income on your return even when no W-2G is issued. The IRS does not need a form generated to know you owe tax on a $500 parlay.

Deducting Gambling Losses

Starting in 2026, you can only deduct 90% of your gambling losses, and only up to the amount of your gambling winnings for the year. The deduction is available only if you itemize; the standard deduction will not work. Win $10,000 and lose $10,000 in the same year, and you can deduct $9,000 of those losses, leaving $1,000 of taxable gambling income even though you broke even in reality. Keep detailed records of every bet, win, and loss.

Colorado State Income Tax

Colorado taxes gambling winnings as ordinary income at the state’s flat rate, which was 4.4% for the 2025 tax year.4Colorado Department of Revenue. Individual Income Tax Guide Your sportsbook winnings get added to your other income on your Colorado return. The state does not carve out special treatment for sports betting.

How Federal Law Shapes the Experience

Two federal statutes explain why Colorado’s online market works the way it does. The Wire Act, discussed above, is the reason your app shuts off at the state line. Violations carry up to two years in federal prison, though enforcement targets operators rather than individual bettors.2Office of the Law Revision Counsel. 18 U.S. Code 1084 – Transmission of Wagering Information; Penalties

The Unlawful Internet Gambling Enforcement Act of 2006 requires banks and payment processors to block transactions tied to illegal online gambling.5eCFR. Part 233 Prohibition on Funding of Unlawful Internet Gambling (Regulation GG) If you use a licensed Colorado sportsbook, this law is invisible, because your deposits go through. It’s the reason offshore sites often reject U.S. credit cards or push users toward cryptocurrency.

Taking a Break: Self-Exclusion and Help

Colorado runs a voluntary self-exclusion program that bans you from all gaming in the state, including casinos, retail sportsbooks, and online sportsbooks, for one year, three years, or five years.6Bet Smart – Colorado. Self-Exclusion You apply through the Division of Gaming’s online form or by visiting their office. A detail worth knowing: removal is not automatic when your term ends. You must request removal and get approval from the Division of Gaming Director before you can bet again. While on the list, you cannot redeem any accumulated points, bonuses, comps, or free play.

If gambling has become a problem for you or someone close to you, Colorado’s 24/7 confidential helpline is available by calling or texting 1-800-GAMBLER. Gamblers Anonymous meetings run across the state, and the Problem Gambling Coalition of Colorado operates a treatment center in Lakewood.7Bet Smart – Colorado. Responsible Gaming Resources
