Is Online Gambling Illegal in California? Laws, Penalties, and Legal Options

Online gambling is largely illegal in California. There is no state-licensed online sportsbook, no legal online casino, and no authorized online poker site. The only clear exceptions are online horse race wagering through licensed Advance Deposit Wagering accounts and daily fantasy sports, which operates in a legal gray area rather than under an explicit authorization.

Everything else you might find online — sportsbook apps advertised in other states, offshore casino sites, poker rooms accepting California players — is operating outside California law. The state’s default rule is prohibition: if a gambling activity isn’t specifically authorized by statute or the constitution, it’s presumed illegal.1California Legislative Information. Online Sports Betting

You cannot legally bet on sports online in California. The state has no licensing system, no regulator overseeing online sportsbooks, and no legal pathway for apps like the ones operating in New Jersey, Colorado, or Arizona. Those platforms are geofenced out of California entirely.

Voters had the chance to change this in November 2022 and declined. Proposition 26 would have allowed in-person sports betting at tribal casinos and licensed racetracks. Proposition 27 would have authorized online sports betting through commercial operators partnered with tribes. Both failed, with Prop 26 drawing only about 33% of the vote and Prop 27 doing worse. No major legislation has advanced since to fill the gap.

Online Casino Games and Poker

Online slots, blackjack, roulette, and other casino games are illegal in California. Slot machines are permitted only at tribal casinos operating under compacts with the state, and roulette and craps aren’t legally offered anywhere in California, even in person.2California Legislative Information. Online poker is a particular sore spot. California has roughly 80 licensed card rooms where you can play poker in person, because the house doesn’t bet against players in those games. That authorization has never been extended to the internet. Multiple bills between 2012 and 2016 tried to legalize intrastate online poker, and none reached a full floor vote. As of 2026, no new online poker bill has been introduced.

What You Can Legally Do Online

Horse Race Wagering

Advance Deposit Wagering is the clearest legal avenue for real-money online betting in California. Under Business and Professions Code Section 19604, the California Horse Racing Board can authorize licensed providers to accept parimutuel wagers through online accounts on sanctioned in-state and out-of-state races.3California Legislative Information. Daily Fantasy Sports

DraftKings, FanDuel, and similar daily fantasy platforms operate in California, but not because the state explicitly legalized them. No California statute authorizes or regulates the industry. These platforms continue running because their contests are widely treated as games of skill rather than wagers on chance, which keeps them outside the standard legal definition of gambling. The California Attorney General’s office has issued a legal opinion describing how existing law applies to daily fantasy sports and noted that only the Legislature or voters can change that law.5State of California Department of Justice – Office of the Attorney General. Sweepstakes and Social Casinos

Social casino apps and sweepstakes-style sites offer casino-like games built on a sweepstakes model rather than direct wagering. California law treats sweepstakes as legal provided they don’t become an illegal lottery, which requires a prize, chance, and consideration (payment to enter). Platforms sidestep the consideration element by offering a genuine free entry alternative alongside any paid option.6Senate Committee on Public Safety. Charitable Raffles

Nonprofits can run raffles under Penal Code Section 320.5, but with a direct limitation on online activity: raffle tickets cannot be sold over the internet. A nonprofit may advertise a raffle online, but the ticket sale and the drawing itself have to happen offline.7State of California Department of Justice – Office of the Attorney General. Penalties If You Gamble Online Anyway

Playing a prohibited gambling game is a misdemeanor under Penal Code Section 330, punishable by a fine of $100 to $1,000 and up to six months in county jail.1California Legislative Information. California Penal Code 330 In practice, California law enforcement rarely pursues individual online bettors. Prosecutorial attention goes toward the operators, not the person placing a small bet from their couch. Rare prosecution is not the same as legal, though, and a misdemeanor conviction still appears on a background check.

The penalties jump considerably for anyone running an unauthorized operation. Under Penal Code Section 337a, bookmaking and operating a gambling business are “wobbler” offenses, meaning prosecutors can file them as misdemeanors or felonies depending on scale. A felony conviction can carry state prison time and substantial fines.

Federal law adds another layer. The Unlawful Internet Gambling Enforcement Act of 2006 prohibits anyone in the business of betting from knowingly accepting credit card charges, electronic transfers, or other financial instruments connected to unlawful internet gambling.8Office of the Law Revision Counsel. 31 USC Chapter 53 Subchapter IV – Prohibition on Funding of Unlawful Internet Gambling Regulation GG requires banks and payment processors to block these transactions,9eCFR. 12 CFR Part 233 – Prohibition on Funding of Unlawful Internet Gambling (Regulation GG) which is why a credit card deposit to an offshore site often gets declined before it reaches the operator.

Practical Risks of Offshore Sites

The day-to-day risks of using offshore gambling sites tend to hurt California users more than any criminal penalty. These platforms sit outside U.S. regulation, so the consumer protections you’d expect from a licensed operator aren’t there.

If an offshore site refuses to pay your winnings, you have no regulator to complain to. California agencies have no jurisdiction over a company based in Curacao or Malta, and suing in a foreign jurisdiction over a gambling dispute isn’t realistic for most people. Your deposits sit in accounts you can’t audit, and if the site shuts down overnight, which happens regularly, your money disappears with it.

Data security is a real concern too. Regulated U.S. operators must meet standards for protecting personal and financial information. Offshore platforms face no equivalent requirements. You’re handing over your Social Security number, banking details, and identity documents to a company with no legal obligation to protect them.

Payment blocking under UIGEA pushes users toward cryptocurrency, prepaid cards, and other workarounds. Each workaround adds fees, complexity, and another point of failure if a transaction goes wrong.

You Still Owe Taxes on the Winnings

Whether winnings come from a legal horse racing account or an unauthorized offshore site, the IRS expects its share. All gambling winnings are taxable income under federal law regardless of the source. For 2026, the reporting threshold for Form W-2G has been adjusted for inflation to $2,000 for certain types of gambling winnings. Federal withholding of 24% applies when winnings exceed $5,000, and for parimutuel and sports wagers when the payout is at least 300 times the amount bet.10Internal Revenue Service. Offshore sites won’t send you a W-2G because they’re not inside the U.S. tax system. That doesn’t relieve you of the obligation to report the income. California also taxes gambling winnings as ordinary income, with no separate state deduction for losses beyond what you can claim federally.

Why This Isn’t Changing Soon

California’s gambling landscape is dominated by tribal gaming. More than 60 tribes operate casinos under compacts with the state and have strong reasons to resist any legalization framework that lets commercial operators in without tribal control. The state’s roughly 80 card rooms want online access, but on terms that don’t hand control to tribal operators or out-of-state sportsbooks. Horse racing interests add a third constituency. Each group has enough political weight to block proposals favoring the others, and none can push through a framework alone. The 2022 ballot failures reflected that stalemate, and nothing about the underlying dynamics has shifted since.

For now, if you want to gamble online from California legally, the real options are an ADW account for horse racing and a daily fantasy sports contest. Everything else carries legal exposure, financial risk, or both.
