Recreational weed is legal in New York for adults 21 and older. The Marihuana Regulation and Taxation Act (MRTA), signed on March 31, 2021, lets adults buy, carry, consume, and grow cannabis for personal use, within limits the state sets and enforces.1Office of Cannabis Management. How Much You Can Have
Outside your home, you can carry up to three ounces of cannabis flower and up to 24 grams of concentrated cannabis (edibles, oils, vape cartridges).2New York State Office of Cannabis Management. Know Your Rights with Cannabis Those are the caps for what’s on you in public.
At home, cannabis you grow yourself can be stored on your property. It must be kept somewhere minors can’t get to it.3New York State Senate. New York Penal Law 222.15 – Personal Cultivation and Home Possession of Cannabis There is no separate statutory ceiling on home storage beyond what your own plants produce.
Going over the public limit is not decriminalized in a blanket way. Between three and 16 ounces of flower is a violation with a fine of up to $125; more than 16 ounces climbs into misdemeanor territory, and larger quantities into felony territory.4New York State Unified Court System. Where You Can Consume
You can use cannabis in a private home. Outdoors, you can generally use it wherever tobacco smoking is allowed. The list of places you can’t is longer than most people expect.

- Anywhere tobacco smoking is banned under the state Clean Indoor Air Act, including indoor workplaces, restaurants, bars, schools, and most enclosed public spaces.

- In New York City parks, beaches, boardwalks, and pedestrian plazas, under local smoke-free air laws.
A workable rule of thumb: if you can’t light a cigarette in that spot, you can’t consume cannabis there either.
Buying From a Licensed Dispensary
Recreational cannabis can only be bought legally at dispensaries licensed by the Office of Cannabis Management. Licensed shops post a verification decal near the main entrance, and OCM keeps a location lookup so you can check before walking in.7Office of Cannabis Management. Your per-visit cap matches the possession cap: three ounces of flower and 24 grams of concentrate. You can mix formats (flower, pre-rolls, vapes, edibles) as long as you stay under those numbers. Every dispensary checks ID before ringing you up.
Buying from an unlicensed shop or delivery service is still illegal, and the product hasn’t been lab-tested, so there’s no reliable way to know what’s in it. The state pursues unlicensed sellers with civil penalties reaching $10,000 per day, and up to $20,000 per day for operators who ignore cease-and-desist orders.8New York State Senate. What You’ll Pay in Tax
Legal weed carries a real tax load. A 9% tax applies at the distributor-to-retailer stage, plus a 13% tax at retail.9New York State Department of Taxation and Finance. Adult-Use Cannabis Products Tax Both get baked into shelf price, and ordinary state and local sales tax stacks on top. Expect prices at a licensed store to run noticeably above the illicit market.
Growing at Home
Adults 21 and older can grow at home. Each person can have up to three mature and three immature plants at once.3New York State Senate. Growing has to happen at your private residence, whether that’s a house, an apartment, or a mobile home. Plants and any cannabis they produce must stay on the property, out of public view, and secured so no one under 21 can reach them.3New York State Senate. Driving After Using
Cannabis DUI is treated as seriously as drunk driving. A charge under VTL § 1192(4) for Driving While Ability Impaired by Drugs is a misdemeanor, with a first offense carrying a fine of $500 to $1,000, up to one year in jail, and a six-month license revocation. A second offense within ten years triggers a one-year revocation.11Governor’s Traffic Safety Committee. There is no cannabis equivalent of a 0.08 BAC number. Police rely on Drug Recognition Expert evaluations and observable impairment, which makes outcomes harder to predict. The safest move is to not drive after using.
Your Job and Your Home
New York protects off-hours cannabis use at work more strongly than most states. Under Labor Law § 201-d, an employer can’t refuse to hire you, fire you, or discriminate against you for legal cannabis use outside of work hours, off company premises, and without company equipment.12New York State Senate. There are exceptions. An employer can act if federal law, a federal contract, or a federal drug-free workplace rule requires drug testing and ignoring it would cost them federal money. They can also act if you show “articulable symptoms” of impairment on the job that hurt performance or create a safety hazard, though a positive THC test by itself isn’t enough.12New York State Senate. New York Labor Law 201-D Certain regulated jobs, like commercial drivers, federal contractors, and law enforcement, remain subject to testing rules that override the state protection.
If you rent, a landlord cannot refuse to rent to you because you consume cannabis. They can, however, ban smoking, vaping, and growing on the property, so a no-smoking lease clause covers cannabis the same way it covers tobacco. Patients in New York’s Medical Cannabis Program have the right to consume medical cannabis at home, including by smoking or vaping, and a landlord can only restrict that if allowing it would put a federal benefit like federal housing funding at risk.13Office of Cannabis Management. Where Federal Law Still Bites
Cannabis is still a Schedule I controlled substance federally. That creates a few hard edges no state law can smooth over.
Guns
Federal law bars anyone who is an “unlawful user of or addicted to any controlled substance” from possessing, buying, or receiving firearms or ammunition.14Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Because cannabis remains federally illegal, regular use can disqualify you from buying a gun regardless of New York law. Taking It Out of State

Federal Property

Old Cannabis Convictions
The MRTA reached backward as well as forward. New York automatically expunges qualifying cannabis offenses, including prior convictions for possessing up to 16 ounces or selling up to 25 grams under the old Penal Law Article 221.15New York State Unified Court System. You don’t have to file anything or pay any fee. Eligible convictions have already been suppressed and no longer show up in background checks run through the courts or the Division of Criminal Justice Services.15New York State Unified Court System.
