Sports betting in Idaho is illegal in every form. There is no licensed sportsbook, no legal mobile app, no daily fantasy platform, and no social or office-pool carve-out. The Idaho Constitution prohibits gambling as a matter of public policy, and state law specifically names sporting events as covered wagering. The only legal way to bet on a live competitive event in Idaho is pari-mutuel wagering on horse racing.
What Idaho Law Says
The ban starts in the state constitution. Article III, Section 20 declares that gambling “is contrary to public policy and is strictly prohibited,” and allows only three exceptions: a state lottery, pari-mutuel betting on horse races, and bingo or raffle games run by qualified charities.1Justia. Idaho Constitution Article III – Section 20 – Gambling Prohibited Sports betting is not on that list.
Idaho Code § 18-3801 then defines gambling to include risking anything of value for gain based on chance or on the outcome of an event, “including a sporting event.”2Idaho State Legislature. Idaho Code 18-3801 – Gambling That language covers an NFL wager, a March Madness bracket, a high school football bet, and everything in between. It applies whether the bet is placed in person, through an offshore website, or on a mobile app operated from another country.
The statute lists narrow activities that don’t count as gambling: legitimate contests of skill where prizes go only to the contestants or their sponsors, ordinary business transactions, arcade-style games that award only additional play, and promotional drawings with no cost to enter.2Idaho State Legislature. Idaho Code 18-3801 – Gambling None of them cover betting on someone else’s athletic performance.
Penalties for Placing or Taking a Sports Bet
Under Idaho Code § 18-3802, participating in gambling or knowingly allowing gambling on property you control is a crime.3Idaho State Legislature. Idaho Code 18-3802 – Gambling Prohibited It’s a misdemeanor, which under Idaho’s general penalty statute means up to six months in county jail, a fine of up to $1,000, or both.4Idaho State Legislature. Idaho Code 18-113 – Punishment for Misdemeanor
There is no lighter tier for small bettors. The person putting twenty dollars on a game faces the same misdemeanor as the person running the book, and a landlord or property owner who knowingly allows illegal betting on their premises faces the same charge.
Larger operations can pick up federal exposure on top of the state charge. Under 18 U.S.C. § 1955, an illegal gambling business becomes a federal offense when it violates state law, involves five or more people who run or finance it, and either operates for more than 30 consecutive days or takes in more than $2,000 in gross revenue in a single day.5Office of the Law Revision Counsel. 18 U.S. Code 1955 – Prohibition of Illegal Gambling Businesses The federal penalty is up to five years in prison.
Office Pools, Fantasy Apps, and Other Common Situations
Office Pools and Casual Bets Between Friends
Idaho has no social gambling exception. Some states let friends wager small stakes privately without legal consequences; Idaho isn’t one of them. A $10 buy-in for a Super Bowl squares board and a $10,000 bet with a bookmaker are both misdemeanors under Idaho Code § 18-3802.3Idaho State Legislature. Idaho Code 18-3802 – Gambling Prohibited Enforcement against a workplace bracket is rare in practice, but the legal exposure is real, and the person who hosts the pool shares criminal liability with the people who buy in.
DraftKings, FanDuel, and Daily Fantasy Sports
Daily fantasy sports platforms do not operate in Idaho. In 2016, Attorney General Lawrence Wasden concluded that paid fantasy contests amount to illegal gambling under state law because participants risk money for a chance to win a prize based on the outcome of real athletic events.6Boise State Public Radio. DraftKings and FanDuel Agree to Stop Doing Business in Idaho DraftKings and FanDuel reached a settlement and stopped taking Idaho customers by May 15 of that year.
The industry’s national argument that daily fantasy is a game of skill did not fit Idaho’s statute. The gambling definition covers gain based on the outcome of an event, and the skill-contest exception only applies when awards go to the contestants themselves or their owners.2Idaho State Legislature. Idaho Code 18-3801 – Gambling Fantasy players aren’t on the field; they’re wagering on how real athletes perform.
Tribal Casinos
Idaho’s tribal casinos cannot offer sports betting either. Under the federal Indian Gaming Regulatory Act, Class III gaming, which includes sports wagering, is only lawful on tribal land if the state permits that gaming “for any purpose by any person, organization, or entity.”7Office of the Law Revision Counsel. 25 USC 2710 – Tribal Gaming Ordinances Idaho doesn’t, so tribes can’t. Tribal-state compacts reinforce the same limit: the Shoshone-Bannock compact, for instance, states that tribal Class III gaming is prohibited except in the categories the state constitution allows.
Betting While Traveling
Every neighboring state except Utah has legalized some form of sports wagering. Placing a bet while you’re physically in one of those states is legal there, but geolocation technology enforces the geography: a licensed sportsbook app will only accept a wager when the device is inside the state where the operator is licensed. Sitting in Boise and logging into a Wyoming or Oregon app does not work, and using an offshore site from within Idaho carries the same criminal exposure as any other illegal gambling under Idaho law, no matter where the operator is based.
The One Legal Wager: Pari-Mutuel Horse Racing
Pari-mutuel wagering on horse races is the only legal way to bet on a live competitive event in Idaho. The Idaho Horse Racing Act, in Title 54, Chapter 25, authorizes it under the Idaho State Racing Commission.8Justia. Idaho Code Title 54, Chapter 25 – Horse Racing Bets are pooled rather than placed against a bookmaker, and payouts depend on the pool after the track takes its cut.
Wagering is available at licensed tracks during live racing and at approved simulcast facilities. Idaho also allows advance deposit wagering, which lets bettors fund an account and place pari-mutuel bets remotely through licensed platforms. Operators must obtain a specific license from the Racing Commission and file a detailed plan of their wagering system before accepting bets.9Legal Information Institute. Idaho Admin Code r. 11.04.01.951 – Advanced Deposit Wagering License This is the only form of legal online wagering available to Idaho residents, and it’s limited to horse racing.
Will Idaho Legalize Sports Betting?
Not soon. No sports betting or daily fantasy bill has been introduced in the Idaho legislature in recent sessions, and the barrier is structural, not just political. Because Article III, Section 20 caps legal gambling at its three listed exceptions, legalizing sports betting would require a constitutional amendment: a two-thirds vote in both chambers plus approval by a majority of voters in a general election.1Justia. Idaho Constitution Article III – Section 20 – Gambling Prohibited Until that happens, anyone who wants to bet on sports legally will need to travel to a state that permits it, and stay there while the wager is placed.
