Tannerite is legal to buy in Illinois in its unmixed form, but the moment you combine the two components it becomes a regulated explosive, and possessing it without an Illinois explosives license is a Class 3 felony punishable by two to five years in prison. The box on the shelf is not the problem. What you do with it in your backyard is.
Why the Unmixed Box Is Legal
Tannerite is a binary target. One container holds ammonium nitrate; the other holds a metal fuel, typically aluminum powder. Neither is explosive on its own. You mix them, shoot the combined powder with a high-velocity rifle round, and the impact sets off the detonation.
Federal law treats that split seriously. Unmixed binary components are not classified as explosive materials and are not federally regulated.1Bureau of Alcohol, Tobacco, Firearms and Explosives. ATF Explosives Industry Newsletter You can buy and ship the separate containers without a federal license. Once combined, the mixture is an explosive material under 27 CFR Part 555.2eCFR. 27 CFR Part 555 – Commerce in Explosives
What Illinois Adds Once You Mix
Federal law allows individuals to mix and detonate binary explosives on their own property for personal, non-business use without a federal license. Illinois does not follow that rule. The Illinois Explosives Act (225 ILCS 210) governs the acquisition, storage, use, possession, transfer, and disposal of all explosive materials in the state,3Justia. Illinois Code 225 ILCS 210 – Illinois Explosives Act and it defines “explosive materials” by incorporating the federal list at 27 CFR 555.23, which includes mixed binary explosives.4Illinois General Assembly. Illinois Code 225 ILCS 210/1003 – Definitions
The practical result is simple. Once you combine the two Tannerite containers in Illinois, you need a state explosives license from the Department of Natural Resources to possess what you just made. There is no backyard exception.
The Illinois Explosives License
The licensing framework is built for demolition crews, blasters, and mining operations. Any individual who meets the qualifications can apply, but the requirements are not casual.
- You must be at least 21 years old.
- You must pass a fingerprint-based criminal background check. Any conviction for a crime punishable by more than one year in prison disqualifies you.
- You cannot be a fugitive, under indictment, or an unlawful user of controlled substances.
- You must be a U.S. citizen or lawful permanent resident.
- You must pass a written exam on Illinois explosives laws, storage requirements, and safe handling with a score of at least 80%.
The application fee is $100, and you register for the class and exam through the IDNR’s Individual Explosives License Coordinator before applying.5Illinois Department of Natural Resources. Illinois Individual Explosives License – Eligibility and Requirements
A license alone does not let you store what you mix. Anyone who intends to keep mixed explosives on hand needs a separate storage certificate from the IDNR.6Legal Information Institute. Illinois Administrative Code Title 62, Section 200.200 – Application for Original Storage Certificate License and certificate holders must also keep records of every purchase, use, disposal, and transfer for at least five years.7Legal Information Institute. Penalties for Mixing Without a License
Possessing, storing, or transferring explosive materials without the required license or certificate is a Class 3 felony under Section 5010 of the Illinois Explosives Act.8Illinois General Assembly. Illinois Code 225 ILCS 210 – Illinois Explosives Act – Section 5010 A Class 3 felony carries a standard prison sentence of two to five years, with an extended term of five to ten years possible in aggravated circumstances.9Illinois General Assembly. Illinois Code 730 ILCS 5/5-4.5-40 – Class 3 Felony Storing mixed material without a storage certificate is independently a Class 3 felony. Failing to keep required records is a Class B misdemeanor.
No criminal intent is required. The act of possessing the mixed powder without authorization is the offense. Someone who buys a two-pound target at a sporting goods store, mixes it in the driveway, and sets it off in a back pasture has committed a felony even if nothing else goes wrong.
Where You Still Cannot Use It
Even with a license, exploding targets are banned on National Forest System lands. Federal regulations prohibit possessing or using an exploding target, firework, or pyrotechnic device in National Forests.10eCFR. 36 CFR 261.5 – Fire This matters in Illinois because the Shawnee National Forest covers a large section of the southern part of the state. The Bureau of Land Management imposes similar restrictions on BLM-managed land through fire prevention orders that vary by region and season.
Violations can bring fines up to $1,000 plus liability for fire suppression and land rehabilitation. Suppression bills are not theoretical. In one reported case, a shooter whose exploding target started a wildfire was billed $168,500 by the federal government for suppression alone.
Fire Liability on Any Land
A Tannerite detonation generates enough heat to ignite dry vegetation. The U.S. Forest Service has attributed at least sixteen wildfires to exploding targets in recent years. In Illinois, starting a fire through the reckless use of explosives can bring criminal charges beyond the explosives offenses themselves, and it exposes you to civil liability for property damage, injuries, and suppression costs on public or private land. A dry summer afternoon can turn a licensed, otherwise lawful shoot into a six-figure problem before any felony charge enters the picture.
If you want to use Tannerite legally in Illinois, there is one path: get the IDNR individual explosives license, get a storage certificate if you plan to keep any mixed material, pick ground that is not National Forest, and read the fire conditions before you pull the trigger. Short of that, keep the two containers unmixed, because mixing is where the felony starts.
