Is THCA Legal in Nebraska? State Laws, Penalties, and Driving

THCA is not legal in Nebraska in any practical sense. The state measures cannabis products using a total THC standard that adds THCA into the calculation, and high-THCA flower, vapes, and concentrates fail that test by a wide margin. Once a product crosses the 0.3% total THC line, Nebraska treats it as marijuana, a Schedule I controlled substance, and possession carries criminal penalties regardless of what the label says.

Why Nebraska Counts THCA as THC

Nebraska’s Hemp Farming Act defines legal hemp as cannabis containing no more than 0.3% delta-9 THC on a dry weight basis.1Nebraska Legislature. Nebraska Code 2-503 – Terms, defined Anything above that line falls out of the hemp definition and into the controlled substances schedule, where both marijuana and tetrahydrocannabinols sit in Schedule I.2Nebraska Legislature. Nebraska Revised Statute 28-405 – Controlled Substances Schedules Enumerated

The sellers of THCA flower lean on the fact that raw, unheated plant material contains very little delta-9 THC. That argument does not work in Nebraska. The state operates under USDA hemp rules because it does not have its own approved state plan, and the USDA requires testing that accounts for the conversion of THCA into delta-9 THC. The formula is: Total THC = (0.877 × THCA) + delta-9 THC.3eCFR. 7 CFR 990.1 – Meaning of Terms The 0.877 multiplier reflects how much of the THCA actually becomes active THC when heated.

Run the numbers on a typical THCA product. Flower marketed at 15% THCA and 0.2% delta-9 THC comes out to roughly 13.4% total THC. That is more than 40 times the legal threshold. No commercially available high-THCA flower passes this test, which is why the entire category is illegal in Nebraska even when it is sold openly in other states.

Possession Penalties for Marijuana

Because high-THCA products test as marijuana, possessing them triggers the penalties in Neb. Rev. Stat. § 28-416. The scale is weight-based:4Nebraska Legislature. Nebraska Revised Statutes 28-416 – Prohibited Acts Possessing a Controlled Substance

  • One ounce or less, first offense: infraction with a $300 fine, and the court may order a drug education course.
  • One ounce or less, second offense: Class IV misdemeanor, $400 fine, up to five days in jail.
  • One ounce or less, third or later offense: Class IIIA misdemeanor, $500 fine, up to seven days in jail.
  • More than one ounce up to one pound: Class III misdemeanor.
  • More than one pound: Class IV felony.

Concentrates and vape cartridges count by their total weight, so even a few grams of a potent extract can push a charge into a heavier bracket than the same person might assume from the flower rules.

Does “Hemp” on the Label Help?

No. Nebraska law enforcement looks at what the product is, not what the package says. An officer who finds suspected cannabis during a stop or search can send it to a laboratory, and if the total THC comes back above 0.3%, you face possession charges whether the jar said “hemp,” “THCA,” or anything else. A certificate of analysis showing low delta-9 only, without a total THC figure, does not establish compliance under the standard Nebraska uses.

Delta-8, Delta-10, and Synthetic THC

The same reasoning sweeps in other hemp-derived intoxicants. The Nebraska Attorney General treats delta-8 THC, delta-10 THC, and related cannabinoids produced by chemically converting hemp-derived CBD as illegal synthetic THC. The office relies on the Schedule I listing that covers “synthetic equivalents of the substances contained in the plant” along with derivatives and isomers of similar chemical structure.2Nebraska Legislature. Nebraska Revised Statute 28-405 – Controlled Substances Schedules Enumerated CBD from compliant hemp is the one hemp cannabinoid category that clearly stays on the legal side of the line, provided the finished product tests under 0.3% total THC.

Buying Online or Driving Through the State

The 2018 Farm Bill bars states from blocking the interstate transportation of hemp produced in compliance with the federal program.5Office of the Law Revision Counsel. 7 USC 1639o – Definitions That protection only reaches products that actually meet the federal total THC standard. High-THCA flower does not, so bringing it into Nebraska from a looser-regulation state offers no legal cover. A Nebraska officer who finds it in your car during a traffic stop will treat it as marijuana.

Ordering THCA products online does not change the analysis. The point of enforcement is possession inside Nebraska, not the shipping label. CBD products from a reputable source that stay under the 0.3% total THC limit are a different matter, and a third-party certificate of analysis showing total THC is a sensible thing to carry if you travel through the state with them.

Driving After Using Any THC Product

Nebraska has no per se blood THC limit. Instead, Neb. Rev. Stat. § 60-6,196 makes it illegal to drive while under the influence of any drug to a degree that appreciably impairs your ability.6Nebraska Legislature. Nebraska Revised Statute 60-6,196 – Driving Under Influence of Alcoholic Liquor or Drug Penalties Prosecutors build these cases from officer observations, field sobriety performance, and chemical test results. A first-offense drug DUI is a Class W misdemeanor; with probation, you face a $500 fine and a 60-day license revocation with a mandatory ignition interlock, and without probation the revocation runs six months.7Nebraska Legislature. Nebraska Revised Statute 60-6,197.03 – Driving Under the Influence Penalties THC metabolites can show up in blood or urine for weeks after use, well past any actual impairment, and that lingering positive gives prosecutors extra evidence even when you were not high behind the wheel.

Jobs and Firearms

Nebraska gives workers no employment protection for off-duty cannabis use. Workplace drug panels screen for THC metabolites and cannot tell whether the THC came from illegal marijuana or from a product sold at a gas station as hemp. A positive result can cost you your job, and a full-spectrum CBD oil with trace THC can be enough to trigger one.

Firearms are the other serious collateral risk. Federal law prohibits any “unlawful user of or addicted to any controlled substance” from possessing firearms or ammunition.8Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Marijuana is a Schedule I substance federally, and using high-THCA products that qualify as marijuana puts you in the prohibited category. Checking “no” to the drug use question on ATF Form 4473 while regularly using these products is itself a federal offense.

Retailer Enforcement and Pending Legislation

Despite the state’s position, THCA and delta-8 products are still sold in Nebraska stores. The Attorney General has responded with a statewide litigation campaign under the Consumer Protection Act, the Uniform Deceptive Trade Practices Act, and Nebraska’s Pure Food Act. Several retailers have settled, agreeing to stop selling prohibited hemp products and destroy remaining inventory, with breach penalties starting at $18,000 for a first violation and climbing to forfeiture of all gross revenues for repeat violations.9Nebraska Attorney General. Nebraska Attorney General Mike Hilgers Announces Four New Successful Settlements in Delta-8 Enforcement Criminal referrals are on the table for retailers who refuse to comply.10Nebraska Attorney General. Announcement of New Developments in Delta-8 Enforcement Efforts The takeaway for a shopper: finding a product on a shelf does not mean the product is legal, and it does not shield the buyer.

The Legislature has been considering LB316, which would write the total THC testing standard directly into Nebraska statute and limit hemp product sales to CBD-only products. As of early 2026 it had not passed and carries over into the current session.11Nebraska Legislature. LB316 – Prohibit Conduct Relating to Hemp Other Than Cannabidiol Products Even without it, the state’s enforcement posture already treats high-THCA and synthetic THC products as illegal, and that is the posture to plan around.
