Is There a Grace Period for an Expired License in NC?

North Carolina does not have a permanent grace period for an expired license, but a temporary moratorium signed into law on July 1, 2025 functions like one for most drivers right now. Under Senate Bill 391, standard Class C licenses with expiration dates on or after that day stay valid for in-state driving through December 31, 2027.1North Carolina Department of Transportation. What the SB 391 Moratorium Actually Covers

Governor Josh Stein signed SB 391 effective July 1, 2025, creating what the NCDMV calls a “moratorium on the expiration of Class C driver licenses.”1North Carolina Department of Transportation. NCDMV Announces Moratorium on Driver License Expirations If you hold a standard Class C license (the type most North Carolina drivers carry) and its printed expiration date falls on or after July 1, 2025, you can keep driving in North Carolina for up to two years past that date. The relief was enacted to give the NCDMV room to work through service backlogs, and it runs through December 31, 2027.

Three groups are left out. Commercial driver’s licenses are not covered. Licenses that have been suspended, revoked, or canceled are not covered. And licenses that expired before July 1, 2025 are not covered. If you fall into any of those categories, you are driving without a valid license and face the penalties below.1North Carolina Department of Transportation. Where the Moratorium Stops Helping

The moratorium keeps you legal on North Carolina roads. That is close to the full extent of it. The NCDMV itself warns that expired licenses extended under the moratorium “may not be recognized by other states or federal entities.”1North Carolina Department of Transportation. Flying and Entering Federal Buildings

ID Requirements for Federal Facilities A card printed with an expired date will not satisfy a TSA screener, no matter what state law says. Travel with a passport if your license has lapsed.

Starting a New Job

USCIS has issued guidance stating that expired North Carolina licenses covered by the moratorium are not acceptable for Form I-9 employment verification. The moratorium keeps the license valid “for driving purposes only” and does not extend to identity verification for new-hire paperwork.4U.S. Citizenship and Immigration Services. Expired North Carolina Drivers Licenses Are Not Valid for Form I-9 Purposes A new job will require an unexpired passport, passport card, or another document from the I-9 acceptable list.

Insurance Claims

Your auto insurance policy likely stays active even with an expired card, but a claim filed while driving on a technically expired license can turn into a fight. Policies often exclude losses tied to illegal activity, and an insurer unfamiliar with the moratorium, or handling an out-of-state crash, can dispute or delay payment. Renewing on time avoids the question.

Penalties Without the Moratorium

If the moratorium does not apply to you, driving on an expired North Carolina license is an infraction under N.C. General Statute 20-35.5North Carolina General Assembly. North Carolina Code GS 20-35 Officers write it up as a “No Operator’s License” violation, and the usual consequence is a fine plus court costs. Once your license has been expired for more than one year, the same violation also adds three points to your driving record.6North Carolina General Assembly. North Carolina Code 20-16 – Authority of Division to Cancel License or Learner Permit Enough points and the DMV can suspend you, which escalates the whole situation.

One boundary worth stating: an expired license is not the same as a suspended or revoked one. If your license was suspended or revoked, the moratorium does nothing for you, and driving on it is a misdemeanor rather than an infraction. Resolve the underlying issue before getting behind the wheel.

Renewing Before You Need the Safety Net

You can start renewal up to 180 days before your license expires; the NCDMV will not accept an application filed earlier.7North Carolina General Assembly. North Carolina Code 20-7 – Issuance and Renewal of Drivers Licenses A standard license runs eight years for drivers 18 to 65, and five years for drivers 66 and older, expiring on your birthday. The fee is $6.50 per year of validity: $52 for an eight-year renewal, $32.50 for a five-year renewal.8North Carolina Department of Transportation. NCDMV Fees to Increase July 1 Per State Law

If Your License Has Been Expired More Than Two Years

Letting the lapse run past two years changes everything. Online renewal is no longer an option. You will need to visit an office in person and complete a road signs test along with a vision screening, similar to a first-time applicant, and the DMV may require a full knowledge or driving skills test at its discretion.12North Carolina Department of Transportation. 19A NCAC 03B .0201 – Drivers License Examination and Online Renewal The two-year mark is where a minor errand turns into a much bigger project, so handle the renewal before you reach it.
