There is no state sales tax on food in Oklahoma. Since August 29, 2024, the state’s 4.5% sales tax has not applied to food and food ingredients bought for home consumption.1Oklahoma Tax Commission. Combined local rates in Oklahoma’s biggest cities currently run from about 3.5% to just over 4%.
What You’ll Actually Pay at the Register
House Bill 1955 set the state rate on groceries to zero, but it left every municipal and county tax untouched.1Oklahoma Tax Commission. State Sales Tax on Food and Food Ingredients Local governments fund police, fire, and roads from that money, and they still collect it on food.

What Counts as Tax-Exempt Food
Oklahoma defines food and food ingredients broadly: anything in liquid, solid, frozen, dried, or concentrated form sold to be eaten or drunk for taste or nutritional value.3Oklahoma Tax Commission. Oklahoma Sales and Use Tax Guide for Prepared Food and Food Ingredients That covers most of what you put in a cart:
- Meat, poultry, and fish
- Fruits, vegetables, and eggs
- Milk, bottled water, and soft drinks
- Bread, pasta, flour, and baking supplies
- Frozen meals, chips, and snack foods
- Candy
Candy and soft drinks surprise some shoppers because many states tax both at the full rate. Oklahoma treats them as food, so neither carries the state tax.1Oklahoma Tax Commission. State Sales Tax on Food and Food Ingredients
A quick label test sorts out the borderline cases. A Nutrition Facts panel almost always means the item is exempt from state tax. A Supplement Facts or Drug Facts panel means the full 4.5% still applies.
Items That Still Get the Full 4.5% State Tax
Not everything edible qualifies. These categories still carry the 4.5% state rate on top of local taxes:3Oklahoma Tax Commission. Oklahoma Sales and Use Tax Guide for Prepared Food and Food Ingredients
- Alcoholic beverages: beer, wine, and spirits, wherever sold.
- Dietary supplements: anything with a Supplement Facts panel, including protein powders, vitamins, and herbal extracts.
- Tobacco products: cigarettes, cigars, and chewing tobacco.
- Marijuana products, including infused edibles.
- Over-the-counter medications carrying a Drug Facts or Active Ingredients label.
- Prepared food, with important exceptions below.
Prepared Food: Taxed or Not
Prepared food is where most confusion happens. Food becomes “prepared” when the seller does something beyond selling it: heating it, mixing two or more ingredients, or providing utensils like forks, plates, or straws.1Oklahoma Tax Commission. Restaurant meals always get the full tax treatment for the same reason. The restaurant heats, mixes, and typically provides utensils.
When Prepared-Looking Food Stays Exempt
Several situations keep seemingly prepared food on the exempt side:1Oklahoma Tax Commission. State Sales Tax on Food and Food Ingredients
- Raw items you have to cook at home to avoid foodborne illness, such as a marinated steak from the butcher counter.
- Food the seller only sliced, cut, or repackaged, like pre-sliced watermelon.
- Deli items sold cold by weight or volume without utensils.
- Products assembled by a third-party manufacturer, such as frozen pizzas and canned soups.
- Food sold unheated that you need to actually cook at home, not just reheat, and that comes without utensils.
Small details decide the rate. Cold pasta salad sold by the pound without a fork is exempt. The same pasta salad warmed and handed over with a fork is fully taxable.
Stores That Mainly Sell Prepared Food
When prepared food makes up more than 75% of a seller’s total food sales, everything the store sells, including bottled water, candy, and packaged snacks, gets the full 4.5% state rate.4Cornell Law Institute. OAC 710-65-13-573 – Prepared Food Sales Percentage That’s why a bag of chips grabbed at a restaurant or food truck can cost more in tax than the identical bag at a grocery store.
SNAP and WIC Purchases Pay No Tax at All
Pay with SNAP benefits and no sales tax applies, not even local tax. Federal law bars states from collecting sales tax on food bought with SNAP, and any state that tried would lose the program.5Office of the Law Revision Counsel. 7 USC 2013 – Establishment of Supplemental Nutrition Assistance Program The same holds for WIC.
If you split a purchase between SNAP and cash or a debit card, only the non-SNAP portion carries local sales tax. Whatever the benefits cover stays completely tax-free.
