IT-2 Tax Form: New York W-2 Summary, Filing, and Penalties

The IT-2 tax form is New York State’s required summary of every federal W-2 you received during the tax year, and you file it together with your state income tax return. It gives the Department of Taxation and Finance a structured record of your wages and withholding that it can match against what your employers reported, so your state, New York City, and Yonkers withholding credits actually land on your return.

Who Has to File Form IT-2

If you file a New York State income tax return and received at least one federal W-2, you must complete Form IT-2.1New York State Department of Taxation and Finance. IT-2 Summary of W-2 Statements This holds whether you file Form IT-201 as a full-year resident or Form IT-203 as a nonresident or part-year resident, and it covers both spouses on a joint return.

One rule catches people off guard: you report every W-2, even if it shows zero New York State, New York City, or Yonkers wages or withholding.1New York State Department of Taxation and Finance. IT-2 Summary of W-2 Statements A side job in New Jersey with no New York amounts anywhere on the W-2 still gets its own record on your IT-2.

There’s also a less common trigger. If you had foreign earned income but didn’t receive a federal W-2 for it, you still complete Form IT-2. Foreign earned income here includes salaries, wages, commissions, bonuses, professional fees, and certain noncash income.1New York State Department of Taxation and Finance. How to Fill Out Each W-2 Record

Pull together every federal W-2 you and your spouse received for the year. You’ll create one W-2 record on Form IT-2 for each W-2, copying the information exactly as it appears on the federal form.1New York State Department of Taxation and Finance. IT-2 Summary of W-2 Statements

For each record, enter the employer identification number from box b and the employer’s name and address with ZIP code from box c, exactly as shown. Accuracy on these fields matters because the state’s automated systems use the EIN to match your reported withholding against employer filings. If you have foreign earned income and the employer’s identification number doesn’t fit in the space provided, leave box b blank.1New York State Department of Taxation and Finance. Transfer your New York State withholding from box 17 of your W-2 into the corresponding IT-2 field (box 17a). Complete the locality boxes 18 through 20 only if your W-2 reports New York City or Yonkers wages and withholding.1New York State Department of Taxation and Finance. If your federal W-2 lists more than four items in box 12 or box 14, use an additional W-2 record for the overflow. Repeat the identifying information in boxes a, b, and c, then enter only the extra box 12 or box 14 items. Don’t use that additional record to report withholding from a different state for the same wages.1New York State Department of Taxation and Finance. IT-2 Summary of W-2 Statements

All dollar amounts go in as whole numbers. The cents are preprinted as zeros on the form, so drop anything under 50 cents and round 50 cents or more up to the next dollar.2New York State Department of Taxation and Finance. Instructions for Form IT-201 Full-Year Resident Income Tax Return That means $1,247.39 becomes $1,247 and $1,247.50 becomes $1,248. Use the same rule on your IT-201 or IT-203.

Before you file, check that the totals from all your IT-2 forms match the withholding amounts on your primary return. A mismatch between IT-2 totals and lines 72 through 74 of Form IT-201 is a common trigger for processing delays or manual review.

What Form IT-2 Doesn’t Cover

Form IT-2 is only for W-2 wage statements. Pensions, retirement distributions, gambling winnings, and government payments go elsewhere.

If you received a federal Form 1099-R showing New York State, New York City, or Yonkers withholding from a pension, annuity, retirement plan, or IRA, that goes on Form IT-1099-R instead.3New York State Department of Taxation and Finance. When and How to Submit It

Form IT-2 isn’t a standalone document. It travels with your New York State income tax return. For tax year 2025, the filing deadline is April 15, 2026.5New York State Department of Taxation and Finance. Filing Due Dates You can request an automatic six-month extension using Form IT-370, but that extension only moves the filing date, not the payment date. Tax you owe is still due by April 15.

When you e-file, your tax software handles the IT-2 formatting. It prompts you for each W-2’s data, populates the digital IT-2 fields, and transmits everything with your return. If you file on paper, submit Form IT-2 as a complete page. Don’t tear apart or separate the individual W-2 records, and don’t include the instruction page from the back. Use as many copies of Form IT-2 as you need to cover all your W-2s.1New York State Department of Taxation and Finance. IT-2 Summary of W-2 Statements

Don’t send your actual federal W-2 forms with your New York return. Keep those originals for your records.4New York State Department of Taxation and Finance. Remote Workers With New York Withholding on Their W-2

If you live outside New York but work remotely for a New York-based employer, you may find New York withholding on your W-2 that you weren’t expecting. New York applies the “convenience of the employer” rule: wages paid by a New York employer are treated as New York-source income unless the employee works remotely out of necessity rather than personal convenience.6New York State Department of Taxation and Finance. New York Tax Treatment of Nonresidents and Part-Year Residents In practice, many out-of-state remote workers have New York taxes withheld and need to report that withholding on Form IT-2 when filing a nonresident return on Form IT-203.

Proving your remote work was required by the employer, not just allowed, is on you. One path is showing you were specifically directed to work from another state. Another is establishing that your home office qualifies as a bona fide employer office under New York’s primary and secondary factor tests.7New York State Department of Taxation and Finance. Withholding Tax Requirements If you can’t meet those tests, your W-2 will show New York withholding and you report it on IT-2 regardless of where you physically worked.

What Happens If You Skip or Misreport IT-2

Leaving out Form IT-2 isn’t just a paperwork issue. Without it, the Department of Taxation and Finance has no structured record of your withholding to match against employer data. Your claimed withholding credits can get held up or denied until you supply the missing information, which can push a refund back by weeks or months.

If a withholding error leads to understating your tax, New York’s penalty rules apply. Negligence or careless errors trigger an addition of 5% of the deficiency plus 50% of the interest that accrued on the underpaid amount. A substantial understatement, meaning a gap larger than the greater of 10% of the tax due or $2,000, carries a 10% penalty on the underpayment tied to that understatement. Fraud brings an addition equal to twice the entire deficiency.8New York State Senate. New York Tax Law 685 – Additions to Tax and Civil Penalties

Interest also runs on any unpaid tax. For the second quarter of 2026, New York charges 8.5% annually on income tax underpayments, compounded daily, with the rate adjusting each quarter.9New York State Department of Taxation and Finance. Interest Rates 4/1/2026 – 6/30/2026

Keep Your W-2s for at Least Three Years

New York requires you to keep records and supporting documents for at least three years after filing your return. That includes your federal W-2s, your copies of Form IT-2, and anything else that backs up the withholding you claimed.10New York State Department of Taxation and Finance. Recordkeeping for Individuals If the state later questions your withholding because an employer’s filing doesn’t match what you reported, those original W-2s are your proof. Three years is the floor; hold them longer if your situation involves multi-state wages or foreign income.
