Try an Informal Conference First

This step is optional and costs nothing. Many disputes end here because the appraiser may agree that a data error, an unnoticed condition problem, or a stronger comparable sale justifies a reduction. Skipping the informal conference does not affect your right to file a formal petition, and taking it does not extend your deadline. If you go this route, keep the filing deadline in mind and be ready to file a petition if the conference does not resolve things in time.
Filing Deadlines You Cannot Miss

What You Can Actually Appeal
The most common ground is that your assessed value exceeds what the property would sell for on the open market. Florida law requires assessments to reflect “just value,” which is fair market value as of January 1 of the tax year. If similar nearby properties sold for less than the appraiser’s figure, or your property has physical issues the appraiser missed, you have a legitimate basis.4Florida Senate. Appeals also cover denied exemptions and misclassifications. If your Homestead Exemption or a disability-related benefit was rejected, or your property was coded as commercial when it is residential, the VAB reviews whether the appraiser applied the statutory rules correctly. Those cases turn on eligibility criteria, not market comparisons.
How to File and What It Costs
You file using Form DR-486, the official Petition to the Value Adjustment Board published by the Florida Department of Revenue.7Florida Department of Revenue. Duval County accepts petitions through its online portal at vab.coj.net, where you can upload evidence and pay electronically. Evidence That Wins Appeals
Your TRIM notice lists the Parcel Identification Number and the market and assessed values the appraiser assigned. Incorrect square footage, wrong lot size, or missing depreciation are among the easiest reductions to win.
For valuation appeals, comparable sales do the heavy lifting. Pull records of similar properties that sold near January 1 of the tax year for less than your assessed value. The closer the match in size, location, age, and condition, the better. An independent appraisal from a licensed professional carries substantial weight, especially for unusual properties. If your property has physical problems, bring photographs and contractor repair estimates.
For exemption denials, focus on the specific eligibility requirement the appraiser cited. If Homestead was denied over a residency question, gather utility bills, voter registration, and a driver’s license showing the property as your primary address.
The 15-Day Evidence Exchange
Both sides must exchange evidence before the hearing. Read the appraiser’s package carefully. It will include the property record card and whatever comparable sales or income analysis supported the assessment. Look at each comparable for differences in location, condition, lot size, or sale date that undercut the appraiser’s position. A written point-by-point rebuttal is far more effective than presenting your own evidence and hoping the magistrate draws the connection.
Burden of Proof: The Rule That Decides Most Cases
Florida law places the burden on the property owner. You must prove by a preponderance of the evidence that the assessed value does not represent just value, or that it was based on appraisal practices different from those applied to comparable properties in the county.8The Florida Legislature. 2025 Florida Statutes Chapter 194 – Section 194.301
The appraiser’s assessment also carries a presumption of correctness, as long as the appraiser shows it was based on the statutory valuation criteria and professionally accepted appraisal methods. If you overcome that presumption with solid evidence, the board must set the value based on competent, substantial evidence in the record. If the record does not contain such evidence, the matter goes back to the appraiser with the board’s instructions.
There is an important exception. If your appeal challenges an exemption denial or property classification instead of the dollar value, the appraiser’s decision does not receive that presumption of correctness. What Happens at the Hearing
A special magistrate conducts the hearing. For real estate valuation disputes, that person must be a state-certified real estate appraiser with at least five years of property valuation experience. For exemption and classification disputes, the magistrate must be a member of The Florida Bar with at least five years of ad valorem taxation experience. In either case, the magistrate cannot be a county employee, an elected official, or anyone connected to a local taxing authority.9Florida Senate. You present first. State your opinion of value, walk through your comparable sales, and explain where the appraiser’s figure went wrong. The Property Appraiser’s representative then defends the original methodology. Both sides can question each other’s evidence. Afterward, the magistrate prepares a written recommendation with proposed findings of fact and conclusions of law, and submits it to the VAB clerk. The clerk mails copies to both parties, and the VAB makes the final decision on whether to accept the recommendation.
You can represent yourself, hire an attorney, or bring a licensed tax consultant or property tax agent. Most homeowners handle it themselves. Hearings are less formal than court proceedings, but the magistrate expects organized, credible evidence, not a general complaint that taxes feel too high.
If the VAB Rules Against You
A VAB decision is not the end. Under Section 194.171, you can file suit in circuit court within 60 days from the date the assessment is certified for collection, or within 60 days from the VAB’s final decision if the petition had not received final action before the tax roll was extended.10The Florida Legislature. 2025 Florida Statutes Chapter 194 – Section 194.171
Before filing, you must pay the tax collector the amount of tax you admit in good faith to be owing, receive a receipt, and file that receipt with your complaint. Paying does not concede the assessment was correct, and it stops collection efforts while the suit is pending. You must keep paying taxes in later years that you admit are owed, or the court loses jurisdiction. Because of the cost and complexity, circuit court appeals generally make sense only when the potential reduction is substantial.
After a Successful Appeal
A reduction lowers your annual tax bill, but the change does not hit your mortgage payment right away. Most lenders collect property taxes through escrow and recalculate the account once a year based on an annual analysis.11Consumer Financial Protection Bureau. If the analysis shows a surplus because your taxes dropped, the servicer typically refunds the excess or reduces your monthly payment going forward. Depending on when your reduction lands in the servicer’s cycle, it may take several months to see relief. You can ask the servicer to run an early escrow analysis after you receive official confirmation; some will, many will not.
A refund of property taxes you already paid may be taxable at the federal level if you deducted those taxes on a prior return. Under the tax benefit rule, the refund counts as recovered income to the extent the earlier deduction reduced your federal tax. You would report the taxable portion on Schedule 1 of Form 1040. If the refund arrives in the same year you paid the taxes, you instead reduce your property tax deduction by the refund amount. If you took the standard deduction the year you paid the taxes, the refund is not taxable because you never benefited from the deduction. The federal cap on state and local tax deductions is $40,400 for the 2026 tax year for most filers ($20,200 for married filing separately), so owners already at the cap may not have received an additional federal benefit from the property taxes in the first place.
