Kansas Form TR-42: Lienholder Consent, Filing, and Status

Kansas Form TR-42 is the “Request and Consent for Kansas Title to be Issued With Lien and Mailed Out of State,” the document that lets the Kansas Division of Vehicles print a paper certificate of title for a financed vehicle and mail it directly to another state’s titling office.1Kansas Department of Revenue. Request and Consent for Kansas Title to be Issued With Lien and Mailed Out of State Kansas holds titles with an active lien in electronic form only, so no paper title exists for you or your lender to hand over when you move. TR-42 collects the lender’s notarized consent and the new state DMV’s formal request, which together authorize Kansas to produce the paper title with the lien still recorded and send it where your new registration can be completed.

When You Need to Use TR-42

The usual trigger is a move. You financed a car, truck, motorcycle, or trailer while living in Kansas, you have since relocated, and your new state’s DMV needs a Kansas paper title to issue its own. Kansas will not give you one directly while a lien is on file — the Division of Vehicles holds the record electronically and will not print an original or duplicate paper title to a Kansas resident with a lienholder listed.2Kansas Department of Revenue. The same problem can come up if you buy a vehicle with a Kansas title from a private seller in another state and the seller’s lender still holds the lien. Whatever the path, the condition is the same: an electronic Kansas title has an active lien, and a different state’s DMV needs the paper document to process its own title and registration.

Who Fills Out Each Section

You do not complete TR-42 by yourself. Two separate parties fill out two separate sections, and Kansas needs both to arrive together before it will act.1Kansas Department of Revenue. Request and Consent for Kansas Title to be Issued With Lien and Mailed Out of State

  • Your lienholder — the bank, credit union, or finance company shown on the Kansas title — fills out and signs the consent portion. The signature must be notarized. Kansas will reject the form if it is not.
  • An authorized representative at your new state’s DMV completes the request portion, listing the office name, address, and a contact person so Kansas knows exactly where to send the printed title.

Your job as owner is to move the form between those two parties. You don’t sign it, but your name and your new out-of-state address appear on it, and that address must be in the state where the vehicle will be titled and registered. Kansas will not mail the title to you or to your lender. It goes only to the requesting DMV office.1Kansas Department of Revenue. Completing the Form

The form is on the Kansas Department of Revenue’s Division of Vehicles forms page under the Title section, and can also be downloaded directly as a PDF from ksrevenue.gov.3Kansas Department of Revenue. Vehicles Forms and Publications Print it and send copies to both parties, or coordinate so one party completes its section and forwards the form to the other.

Vehicle and Owner Information

The top of the form asks for four pieces of vehicle data: model year, make, license plate number, and VIN.1Kansas Department of Revenue. Request and Consent for Kansas Title to be Issued With Lien and Mailed Out of State Enter the owner name or names exactly as they appear on the Kansas title record, followed by the owner’s new street address, city, state, and zip code. That address must be in the state where you plan to title and register the vehicle, not a Kansas address.

Lienholder Consent

Your lender fills in its name and full mailing address and then signs a consent statement authorizing the Kansas Titles and Registrations Bureau to print a paper title showing the lien and send it to the new state’s DMV.1Kansas Department of Revenue. Request and Consent for Kansas Title to be Issued With Lien and Mailed Out of State A notary public must witness the authorized agent’s signature and apply a seal with the commission expiration date. Notarization is the single most important requirement on the form. Without it, Kansas will not process the request. Most lenders have notaries on staff and handle this internally. If yours is slow, tell them you cannot register the vehicle in your new state until this form is signed.

New Titling Jurisdiction Request

An official at your new state’s DMV completes the bottom section with the office name, an attention line for a specific contact, the office mailing address, and the official’s printed name and date.1Kansas Department of Revenue. Request and Consent for Kansas Title to be Issued With Lien and Mailed Out of State Some DMVs will fill in this section as part of your in-person visit to start registration. Others may not be familiar with Kansas’s electronic title system, so bring a printed copy of the form to your first visit and explain what you need.

Submitting the Form

Once both the lienholder section and the new DMV section are complete, send the form to the Kansas Titles and Registrations Bureau by one of three methods:1Kansas Department of Revenue. Request and Consent for Kansas Title to be Issued With Lien and Mailed Out of State

  • Mail: Kansas Department of Revenue, Division of Vehicles, P.O. Box 2505, Topeka, KS 66601-2505
  • Fax: 785-296-3852
  • Email: kdor_tr@ks.gov

Pick one. Kansas specifically warns against sending the form by more than one method. Don’t fax it and also mail it, and don’t fax it twice. Duplicate submissions cause processing confusion and delays.1Kansas Department of Revenue. If the lender and the DMV complete their portions separately, one of them should forward the paper to the other so a single fully completed form goes to Topeka.

What Happens Next

Kansas reviews the form against its electronic title record. One prerequisite can stop the process cold: if the owner never completed a title application for the vehicle in Kansas in the first place, the title cannot be issued until that application is on file.1Kansas Department of Revenue. Request and Consent for Kansas Title to be Issued With Lien and Mailed Out of State This is most likely to come up when someone bought a vehicle and moved before finishing the Kansas titling paperwork.

When the record checks out, Kansas prints a paper certificate of title showing the lien and mails it to the DMV office listed on the form. The form itself does not promise a specific turnaround. General Kansas title processing runs anywhere from 10 to 40 days depending on the circumstances, and extra research or documentation can push that longer.4Kansas Department of Revenue.
