Kentucky’s No Pass No Drive law, codified at KRS 159.051, lets the state deny or revoke a driver’s permit or license for any student aged 15 through 17 who fails too many classes, misses too much school, or drops out. Two failures trigger it: not passing at least four courses in a semester, or racking up nine or more unexcused absences. It applies to public school, private school, homeschool, and Job Corps students alike.1Kentucky Transportation Cabinet. No Pass/No Drive Law (HB 32)
Who the Law Covers
Every Kentucky student between 15 and 17 falls under the law, no matter what kind of school they attend.1Kentucky Transportation Cabinet. No Pass/No Drive Law (HB 32) Once a student turns 18 or graduates, the law stops applying, but a suspension already on the record does not lift on its own. That last point trips up families every year.2Kentucky Department of Education. No Pass No Drive FAQ
The Two Triggers
Failing Grades
A student is academically deficient if they did not receive passing grades in at least four courses, or the equivalent, during the preceding semester.3Justia. Kentucky Code 159.051 – Loss of License or Permit by Student for Dropping Out of School or for Academic Deficiency – Procedures for Reinstatement For a standard six-class schedule, that is roughly two-thirds of the course load. Block schedules or reduced schedules should be checked with the school, since the “equivalent” language leaves room for interpretation.
Unexcused Absences
Nine or more unexcused absences in a single semester is treated the same as dropping out.3Justia. Kentucky Code 159.051 – Loss of License or Permit by Student for Dropping Out of School or for Academic Deficiency – Procedures for Reinstatement One detail worth flagging: days missed because of a disciplinary suspension count as unexcused under this law.4Kentucky Department of Education. No Pass/No Drive Law A week’s suspension can put a student five days closer to the threshold without a single skipped class.
Schools usually report at the end of a semester, but they can report earlier if a student has already crossed the absence line.3Justia. Kentucky Code 159.051 – Loss of License or Permit by Student for Dropping Out of School or for Academic Deficiency – Procedures for Reinstatement
Getting a Permit or License in the First Place
Any 15-to-17-year-old applying at a Driver Licensing Regional Office has to bring a School Compliance Verification Form. Without it, no permit and no license.1Kentucky Transportation Cabinet. No Pass/No Drive Law (HB 32) Public and private school students get the form from their school. Homeschoolers and alternative education students get it from the local school district office. The only teens who can skip the form are those with proof of high school graduation or a GED transcript.
What Happens After a Report
When a student trips one of the triggers, the school administrator notifies the superintendent, and the superintendent has ten days to send the student’s name and Social Security number to the Kentucky Transportation Cabinet.3Justia. Kentucky Code 159.051 – Loss of License or Permit by Student for Dropping Out of School or for Academic Deficiency – Procedures for Reinstatement The Cabinet then suspends the permit or license.
This is an administrative suspension. No hearing beforehand. The student gets a letter from the Transportation Cabinet explaining the revocation.4Kentucky Department of Education. No Pass/No Drive Law From that point on, driving is illegal, and any traffic stop will surface the suspension. Driving on it becomes a separate offense.
Getting the License Back
The standard path is one full semester of compliance after the suspension. The student works with the school to obtain a signed and dated School Compliance Verification Form confirming they passed the required number of courses and stayed under the absence threshold, then submits it to the circuit court clerk.1Kentucky Transportation Cabinet. No Pass/No Drive Law (HB 32)
Summer school can shorten the wait. If a student who lost driving privileges at the end of spring attends summer school, and their combined spring and summer results add up to at least four passed courses (or the equivalent), they can reapply at the end of the summer semester rather than waiting for fall grades.2Kentucky Department of Education. No Pass No Drive FAQ Schools do not always volunteer this option, so families should ask.
No reinstatement fee applies unless the license has been suspended for a year or more. After a year, the student has to retake the written and eye exams.2Kentucky Department of Education. No Pass No Drive FAQ
Hardship Waivers
A hardship waiver is meant for genuine crises, not inconvenience. The typical fact patterns are a teenager who is the only available driver in a household with no other way to reach work, school, or medical appointments, or a teen parent with no other way to get a child to daycare.5Kentucky Department of Education. Kentucky’s No Pass/No Drive Law
The waiver does not come from the school. The student applies at the local District Court judge’s office using AOC Form 298. The district judge decides, and the school follows the court order.5Kentucky Department of Education. Kentucky’s No Pass/No Drive Law Bring documentation: employment records, medical necessity letters, or proof that no one else in the household can drive.
Turning 18 or Graduating With a Suspension Still Active
The law stops applying at 18 or on graduation, whichever comes first. The suspension does not clear itself. A student in this position has to visit the circuit court clerk’s office with proof of age to start reinstatement.2Kentucky Department of Education. No Pass No Drive FAQ No compliance form is needed at that point, but the clerk visit is mandatory. Skipping it means driving on a suspended license, which is its own offense regardless of age.
Homeschool and Out-of-State Situations
Homeschoolers are covered. A homeschooled student obtains the School Compliance Verification Form from the public school district where they live, after the homeschool has been registered with the local county board of education.1Kentucky Transportation Cabinet. No Pass/No Drive Law (HB 32) If a student withdrew from a public school to homeschool, the district reports them as compliant, because homeschools do not have access to the state reporting portal.2Kentucky Department of Education. No Pass No Drive FAQ
Grades and absences from a school in another state do not carry over. The law only starts running once the student enrolls in a Kentucky school.2Kentucky Department of Education. No Pass No Drive FAQ Kentucky residents who attend school out of state have to get the compliance form from their local Kentucky district, have it signed by a representative of the out-of-state school, and submit it to the circuit court clerk in their county.
Students With Disabilities
The statute allows local school boards to adopt modified standards for alternative education students, part-time students, and special needs students. It does not provide a blanket exemption for any student with an IEP or a disability, and whether a specific district has adopted modified standards varies. Parents should ask the school administration directly what policy the district has in place.
