Kentucky piercing laws set a minimum age of 16 for most body piercings, require a notarized consent form from a custodial parent or legal guardian for any minor, and hold studios to detailed sanitation and registration standards under 902 KAR 45:070. Ear lobe piercing is the only procedure with no minimum age. Female genital piercing on anyone under 18 is a Class B felony, with no exception for parental consent.
How Old You Have to Be
If you are 18 or older, Kentucky places no age restriction on body piercing and no third-party consent is required. You walk in, show ID, and sign the studio’s paperwork.
For minors, the rules tighten quickly. Under 902 KAR 45:070, a minor must be at least 16 to receive a body piercing, even with a parent or guardian’s permission.1Kentucky Legislative Research Commission. 902 KAR 45:070 Body Piercing and Ear Piercing – Section 7 That means a 14- or 15-year-old cannot legally get a nostril, cartilage, navel, lip, or similar piercing in Kentucky, no matter how willing a parent is to sign off.
The only exception is ear lobe piercing. There is no minimum age for an ear lobe piercing as long as a custodial parent or legal guardian gives consent.
One category is off the table entirely. Genital piercings on females under 18 are prohibited and are classified as female genital mutilation under KRS 508.125.2Kentucky Legislative Research Commission. Kentucky Revised Statutes KRS 508.125 – Female Genital Mutilation The statute reaches pricking, piercing, incising, scraping, and cauterizing the genital area of anyone under 18, and parental consent is not a defense.
Consent Paperwork for a Minor
When a minor is old enough for a piercing, the consent process involves more than a signature on a studio waiver. Kentucky requires a written, notarized statement from the custodial parent or legal guardian, bearing an official seal or assigned notary identification number.1Kentucky Legislative Research Commission. 902 KAR 45:070 Body Piercing and Ear Piercing – Section 7 The notarization has to happen before the form reaches the shop, so plan a stop at a bank, shipping store, or other notary public first.
The form itself must include the government-issued photo ID number of the parent or guardian, plus the minor’s photo ID number if the minor has one.3Kentucky Legislative Research Commission. 902 KAR 45:070 Body Piercing and Ear Piercing The studio also has to keep a copy of the parent or guardian’s photo ID on file. The regulation does not explicitly require the parent to be physically present during the piercing, though many studios add that requirement as their own policy.
What a Legal Studio and Piercer Look Like
Kentucky does not use a traditional state license for piercers. Instead, a piercer must register with the local health department in the county where they work.4Cabinet for Health and Family Services. Tattooing and Body Piercing Frequently Asked Questions To register, they must be at least 18 and show proof of completing an OSHA-compliant bloodborne pathogen training course that allows students to ask questions of an instructor. Registration expires every December 31 and has to be renewed annually, and the piercer must work under a Kentucky-certified studio.3Kentucky Legislative Research Commission. 902 KAR 45:070 Body Piercing and Ear Piercing
A legitimate shop will use sterile, single-use needles for body piercings. Reusing or resterilizing disposable components is prohibited. Ear piercing instruments, which use encapsulated presterilized studs, can only be used on the ear lobe. Using an ear piercing gun or stud anywhere else on the body is banned.
Piercers are also not allowed to work on skin that shows a rash, pimples, open lesions, moles, sunburn, or other signs of an unhealthy condition. If you have any of these at the site, you need written clearance from a physician licensed by the Kentucky Board of Medical Licensure before a piercer can proceed.
Jewelry That Can Legally Go in a Fresh Piercing
The initial jewelry has to be presterilized, smooth (no scratches, nicks, or irregular surfaces), and either internally threaded or threadless. It must also be made from one of five approved materials:3Kentucky Legislative Research Commission. 902 KAR 45:070 Body Piercing and Ear Piercing
- Implant stainless steel
- Solid 14K or 18K white or yellow gold
- Niobium
- Titanium
- Platinum
Gold-plated or gold-filled pieces do not qualify. Only solid gold meets the standard. If a shop offers to put something else in a brand-new piercing, that is a sign they are not following the rules.
Aftercare and Health Information You’re Entitled To
Every studio has to give you written notice before the procedure that piercing carries a risk of infection.3Kentucky Legislative Research Commission. 902 KAR 45:070 Body Piercing and Ear Piercing This applies to all clients, not just minors.
Studios must also provide aftercare instructions in written, verbal, or electronic form, covering how to clean and protect the site, possible side effects during normal healing, activities to avoid while the piercing heals, warning signs of infection such as fever, excessive swelling, redness, or drainage, and a direction to see a doctor if infection symptoms appear.
Inspections and Records
Health inspectors from the state or local health department must inspect body piercing studios at least twice a year and ear piercing studios at least once a year, with additional unannounced inspections allowed at any time.3Kentucky Legislative Research Commission. 902 KAR 45:070 Body Piercing and Ear Piercing Studios have to keep client records, including consent documents and copies of government-issued photo IDs, on file for at least two years.5Kentucky Legislative Research Commission. 902 KAR 45:070 Body Piercing and Ear Piercing
Penalties When the Rules Are Broken
Kentucky’s penalties for piercing violations are tiered, and they escalate fast.
A violation of KRS Chapter 317, which governs the profession, is a Class A misdemeanor punishable by up to 12 months in jail.6Kentucky Legislative Research Commission. Kentucky Revised Statutes KRS 317.991 – Penalties7Kentucky Legislative Research Commission. Kentucky Revised Statutes KRS 532.090 – Sentence of Imprisonment for Misdemeanor Violating a regulation adopted under that chapter, including the sanitation and consent rules in 902 KAR 45:070, is a Class B misdemeanor carrying up to 90 days in jail. Operating without a current registration, piercing a minor without proper notarized consent, and failing health and safety standards all fall in this range.
Female genital piercing on anyone under 18 sits in a different category. Because Kentucky treats it as female genital mutilation under KRS 508.125, the offense is a Class B felony, which carries one to ten years in prison.2Kentucky Legislative Research Commission. Kentucky Revised Statutes KRS 508.125 – Female Genital Mutilation Religious, cultural, or ritual reasons are not a defense, and a parent or guardian who knowingly consents to or permits the procedure faces the same felony charge.
Studios that fail health standards can also lose their certification. Inspectors can order immediate corrective action during routine or unannounced visits, and repeated failures put the shop’s ability to operate at risk.
