Kentucky workers’ compensation is a no-fault insurance system: if you are hurt on the job, your employer’s policy pays your medical bills and roughly two-thirds of your lost wages, and you do not have to prove anyone was at fault. In 2026, weekly wage-replacement checks for total disability max out at $1,277.99 and bottom out at $232.36.1Kentucky Education and Labor Cabinet. 2026 Workers’ Compensation Benefit Schedule In exchange for that guaranteed coverage, you generally give up the right to sue your employer in civil court over the same injury.
Who Is Covered
Almost every employer in Kentucky with at least one employee must carry workers’ compensation insurance. That includes private businesses of any size, state and local government, school districts, and public agencies.2Justia. Kentucky Code 342.630 – Coverage of Employers An employer who skips coverage faces civil penalties of $100 to $1,000 per employee per day of violation, plus possible jail time, and the officers or partners who allowed the lapse are personally on the hook.3Justia. Kentucky Code 342.990 – Penalties – Restitution
A handful of job categories fall outside the mandate:
- Agricultural workers employed solely in agriculture.
- Domestic servants in a private home where fewer than two employees work 40 or more hours a week.
- Short-term home or business maintenance workers hired for 20 consecutive workdays or fewer.
- Religious or charitable volunteers paid only in aid or sustenance.
- Workers whose injuries are governed by federal law, with a carve-out for coal workers under the Black Lung Benefits Act.
- Members of recognized religious sects that have opposed insurance for at least ten years.
- Carpool and vanpool participants during the commute itself.
You can also opt out individually through the Department of Workers’ Claims.4Kentucky Education and Labor Cabinet. An Overview of Kentucky Workers’ Compensation Law
What Counts as a Work Injury
An injury is covered when it arises out of and in the course of employment. Kentucky reads “injury” broadly. A single traumatic event like a scaffolding fall qualifies, but so does a series of events and so does cumulative trauma such as a back condition from repeated lifting or carpal tunnel from assembly work. The condition must be supported by objective medical findings tying it to the job.5Kentucky Legislative Research Commission. Kentucky Code 342.0011 – Definitions for Chapter
Occupational diseases count too when there is a clear causal link between working conditions and the illness. Coal workers’ pneumoconiosis has its own benefit rules under the statute.6Kentucky Legislative Research Commission. Kentucky Code 342.1242 – Kentucky Coal Workers’ Pneumoconiosis Fund
What the Benefits Pay
Kentucky splits wage-replacement benefits into three tiers based on how badly the injury limits your ability to work.
Temporary Total Disability
If you cannot work at all while you recover, you get two-thirds of your average weekly wage, capped at $1,277.99 and floored at $232.36 in 2026.1Kentucky Education and Labor Cabinet. 2026 Workers’ Compensation Benefit Schedule Payments continue until you reach maximum medical improvement, return to work, or move to a permanent rating.
Permanent Partial Disability
Once your doctor says you have reached maximum medical improvement but still have a lasting impairment, the math gets layered. You start with two-thirds of your average weekly wage, capped at 82.5% of the state average weekly wage. That figure is multiplied by your AMA impairment rating and by a severity factor:7Kentucky Legislative Research Commission. Kentucky Code 342.730 – Determination of Income Benefits for Disability
- 0–5% impairment: factor of 0.65
- 6–10%: factor of 0.85
- 11–20%: factor of 1.00
- 21–25%: factor of 1.15
- 26–30%: factor of 1.35
- 31–35%: factor of 1.50
- 36% and above: factor of 1.70
That gives you a base weekly benefit, and the formula keeps going. If you cannot physically go back to the kind of work you were doing when you got hurt, the base is tripled. If you do return to work earning at least what you did before, you receive the base amount while you are employed and double the base during any period you stop working, for any reason.
Older workers and workers with limited schooling get further bumps added to the tripled multiplier. An extra 0.2 is added if you were 50 or older at the time of injury, 0.4 if you were 55 or older, and 0.6 if you were 60 or older. A separate 0.2 is added if you have fewer than 12 years of education, and 0.4 if you have fewer than 8. The bumps stack.7Kentucky Legislative Research Commission. Permanent Total Disability
If you are permanently and totally disabled, you get two-thirds of your average weekly wage, subject to the same $1,277.99 maximum and $232.36 minimum.1Kentucky Education and Labor Cabinet. 2026 Workers’ Compensation Benefit Schedule
All income benefits terminate when you reach age 70 or four years after the date of injury, whichever is later.7Kentucky Legislative Research Commission. Kentucky Code 342.730 – Determination of Income Benefits for Disability
Medical Care
Your employer pays for all reasonable and necessary treatment connected to the injury, including surgery, prescriptions, hospital stays, nursing care, prosthetics, and travel to appointments. No copays, no deductibles.8Kentucky Legislative Research Commission. Kentucky Code 342.020 – Medical Treatment at Expense of Employer For permanent total disability, coverage continues as long as you are disabled. For permanent partial disability, medical benefits run 780 weeks (about 15 years) from the date of injury or last exposure. The Department will notify you in writing before that period ends, and you can file within 75 days of the deadline to ask an administrative law judge to continue coverage if treatment is still necessary.
Vocational Rehabilitation
If the injury leaves you unable to do your old type of work, you are entitled to retraining and job placement services, generally for up to 52 weeks and longer if a judge finds extended rehab is justified.9Kentucky Legislative Research Commission. Kentucky Code 342.710 – Rehabilitation Rights, Duties, and Procedures Refusing court-ordered rehab costs you half your weekly compensation for every week you refuse. If you enroll in a retraining program, you can elect to accelerate income benefits during the program up to two-thirds of your average weekly wage, capped at the state average weekly wage.
Deadlines You Cannot Miss
Tell your employer about the injury as soon as practicable after it happens. The statute does not pin that initial notice to a specific day count, but a delay can shrink or sink the claim, so report every injury right away even if it feels minor.
The formal filing deadline is two years from the date of the accident, or two years after the last voluntary benefit payment, whichever is later. In a death case, the clock runs two years from the date of death.10Kentucky Legislative Research Commission. Kentucky Code 342.185 – Notice of Accident – Claim for Compensation – Limitation
Cumulative trauma runs on a different clock. The two years begin on the date a physician tells you the condition is work-related, not when symptoms first appeared. There is a hard outer limit, though: no cumulative trauma claim can be filed more than five years after the last injurious exposure. Work-related HIV exposure gets its own five-year window from the date of exposure.
How to File a Claim
You open a formal claim by filing an Application for Resolution of a Claim, known as Form 101, with the Department of Workers’ Claims. The form asks for your Social Security number, employment dates, accident details, and every medical provider who has treated the injury.11Kentucky Education and Labor Cabinet. Application for Resolution of a Claim – Injury Gather payroll records from the weeks before the injury too, because your average weekly wage drives the benefit amount.
Once filed, the claim is assigned to an administrative law judge. The employer or insurer can contest the claim on Form 111, triggering a period where both sides collect medical and expert evidence. A benefit review conference gives you a chance to settle. If you do not, the judge holds a hearing and issues a written opinion setting the compensation and future medical coverage.
If Your Employer Retaliates
Kentucky law bars employers from firing, harassing, or discriminating against you for filing or pursuing a workers’ compensation claim.12Kentucky Legislative Research Commission. Kentucky Code 342.197 – Discrimination Against Employees Who Have Filed Claims If an employer retaliates, you can sue in Circuit Court for an injunction to stop the conduct, actual damages, costs, and a reasonable attorney fee. That is a separate civil action from the comp claim itself. A separate protection applies to workers diagnosed with early-stage coal-related pneumoconiosis who have no respiratory impairment: an employer cannot refuse to hire, fire, or limit opportunities based on that diagnosis alone.
What a Lawyer Can Charge
Attorney fees for injured workers are capped on a sliding scale:13Kentucky Legislative Research Commission. Kentucky Code 342.320 – Approval of Attorney’s and Physician’s Fees
- Up to 20% of the first $25,000 of the award.
- Up to 15% of the next $25,000.
- Up to 10% of the remainder.
The total fee cannot exceed $18,000 no matter how large the award, for contracts signed on or after July 14, 2018. All attorney fees must be approved by the Department of Workers’ Claims before they are paid.
Taxes and Social Security
Workers’ compensation benefits are not taxable income. Federal law excludes them from gross income, which covers both weekly payments and lump-sum settlements, and you generally do not report them on your federal return.14Office of the Law Revision Counsel. 26 USC 104 – Compensation for Injuries or Sickness
There is a catch if you also collect Social Security Disability Insurance. Federal law caps the combined total of workers’ compensation and SSDI at 80% of your average current earnings before the disability. If the total runs over, your SSDI check is reduced to bring it back down.15Office of the Law Revision Counsel. 42 USC 424a – Reduction on Account of Workers’ Compensation Average current earnings are usually figured from your highest consecutive five-year period or the single highest year within the five years before the disability began.
Reopening and Medicare Set-Asides
A final award is not necessarily permanent. Either side can ask a judge to reopen a claim based on a change of disability shown by objective medical evidence, fraud, mistake, or newly discovered evidence, generally within four years of the award becoming non-appealable.16Kentucky Legislative Research Commission. Kentucky Code 342.125 – Reopening and Review of Award or Order Reopening cannot touch benefits already paid; it only changes payments going forward.
If you are already on Medicare or expect to enroll within 30 months and you are negotiating a settlement, Medicare’s interests have to be considered. CMS will review a proposed Workers’ Compensation Medicare Set-Aside Arrangement when the claimant is on Medicare and the settlement exceeds $25,000, or when the claimant expects to enroll within 30 months and the settlement exceeds $250,000.17Centers for Medicare & Medicaid Services. Workers’ Compensation Medicare Set Aside Arrangements Ignoring the set-aside can leave you paying for injury-related care yourself until the set-aside amount is used up, so bring it up before signing anything.
