Kings County Sales Tax: Rates, Exemptions, and Use Tax

The Kings County sales tax rate is 8.875 percent, the same rate charged throughout New York City. That total combines a 4 percent New York State tax, a 4.5 percent New York City local tax, and a 0.375 percent surcharge for the Metropolitan Commuter Transportation District. It applies to most retail purchases made in Brooklyn, whether you’re shopping, running a business, or selling into the borough from out of state.

How the Rate Is Built

New York Tax Law sets a 4 percent statewide base on retail sales of tangible personal property and certain services, and that base is uniform across every county.1New York State Senate. New York Tax Law 1105 – Imposition of Sales Tax New York City adds its full 4.5 percent local rate on top.2New York State Senate. New York Tax Law 1210 – Taxes of Cities and Counties The remaining 0.375 percent funds the MTA and applies to sales within the five boroughs and several surrounding counties.

The three layers show up as a single 8.875 percent charge at checkout. Businesses don’t itemize them for the customer, but they do have to track the full amount and remit it to the New York State Department of Taxation and Finance.

What Gets Taxed

Physical Goods

Most tangible personal property sold in Kings County carries the full 8.875 percent rate. Electronics, furniture, appliances, jewelry, and household products are standard examples. If it’s a physical item and no specific exemption applies, assume it’s taxable.

Services

New York taxes a broader list of services than many states. Cleaning, maintenance, and repair work are taxable, along with protective and detective services, parking, and personal grooming services such as haircuts and massages.3NYC311. Prepared Food

Food becomes taxable once it’s heated, sold for on-premises consumption, or prepared and ready to eat. A deli sandwich, a slice of pizza, soup heated at a food store, and anything served in a restaurant all carry the 8.875 percent rate.5New York State Department of Taxation and Finance. Software and Digital Products

Prewritten computer software is taxable regardless of how it reaches you: on a disc, by download, or through remote access in a browser. Off-the-shelf programs, SaaS subscriptions, and cloud-based tools are all subject to sales tax in Kings County.6New York State Department of Taxation and Finance. Computer Software Custom software developed to a specific purchaser’s specifications is the main exception.

What’s Exempt

Groceries

Most unheated, unprepared food sold in the same form you’d find at a grocery store is exempt from all state and local sales tax. Milk, bread, produce, meat, eggs, cereal, and canned goods qualify.7New York State Department of Taxation and Finance. Medications

Prescription drugs are exempt. So are over-the-counter medications like pain relievers, antacids, cough and cold remedies, and dandruff treatments.8New York State Department of Taxation and Finance. Drugstores and Pharmacies

Clothing and Footwear Under $110

Clothing and footwear priced below $110 per item are exempt from both the 4 percent state tax and the 4.5 percent New York City tax.9NYC Department of Finance. Business NYS Sales Tax The threshold is per item, not per transaction. Five shirts at $100 each come out to zero sales tax. One $115 jacket, however, gets taxed at the full 8.875 percent on the entire price, not just the amount over $110.10New York State Department of Taxation and Finance. Clothing and Footwear Exemption

Nonprofits

Qualifying nonprofits can buy free of sales tax, but the exemption isn’t automatic. The organization must be organized and operated exclusively for a recognized exempt purpose and must file Form ST-119.2 with the Tax Department, submitting a copy of its IRS 501(c)(3) determination letter.11New York State Department of Taxation and Finance. Sales Tax Exempt Organizations Misusing an exempt organization certificate can bring a fine of up to $20,000 and possible imprisonment.

Purchases for Resale

Inventory bought for resale isn’t taxed at the wholesale stage. The buyer gives the supplier a completed Form ST-120, Resale Certificate, and the tax obligation shifts to the eventual retail sale. Using the form generally requires being a registered New York sales tax vendor with a valid Certificate of Authority.12New York State Department of Taxation and Finance. Form ST-120 Resale Certificate Contractors can’t use resale certificates, and neither can anyone buying for personal use.

If You Sell in Kings County: Registering and Filing

Every person or business that sells taxable goods or services in Kings County has to register with the Tax Department before making a single sale. Registration happens online through New York Business Express using Form DTF-17, which asks for your federal EIN (or Social Security Number for sole proprietors), the legal names and addresses of all responsible parties, and the physical location of the business.13New York State Department of Taxation and Finance. Register as a Sales Tax Vendor14New York State Department of Taxation and Finance. Instructions for Form DTF-17

Once approved, you’ll receive a Certificate of Authority to display at your business. Don’t start selling before it arrives. Operating without a valid certificate can trigger a civil penalty of up to $500 for the first day and up to $200 for each additional day, capped at $10,000.15New York State Department of Taxation and Finance. How to Register for New York State Sales Tax Willfully selling taxable items without one is also a misdemeanor under New York Tax Law.

Registered vendors file through the Tax Department’s Web File portal. The default schedule is quarterly, with returns due within 20 days after each quarter ends. New York’s sales tax quarters don’t follow the calendar: they run March through May, June through August, September through November, and December through February.16New York State Department of Taxation and Finance. Filing Requirements for Sales and Use Tax Returns

If combined taxable sales in any quarter reach $300,000 or more, you move to monthly filing starting the next month. You stay on monthly until taxable sales fall below $300,000 for four consecutive quarters, at which point you can request a return to quarterly filing. Payment is typically made by ACH debit from a verified business bank account when you submit the return.

Out-of-State Sellers

Selling into New York from another state doesn’t exempt you from Kings County sales tax. Remote sellers must register, collect, and remit once they cross both of two thresholds in the preceding four sales tax quarters: more than $500,000 in gross receipts from tangible personal property delivered into New York, and more than 100 such sales.17New York State Department of Taxation and Finance. Registration Requirement for Businesses With No Physical Presence in New York State Both conditions must be met. Marketplace facilitators such as Amazon and Etsy carry the same obligation for third-party sellers on their platforms.

Use Tax on What Wasn’t Collected

Buy something from an out-of-state seller who doesn’t charge New York sales tax, and you owe use tax at the same 8.875 percent rate. This comes up with online orders from smaller retailers and with goods brought back from trips to other states. Individuals report use tax on their New York State income tax return. Registered businesses report it on their regular sales tax returns. If sales tax wasn’t collected at the point of sale, use tax fills the gap.

Penalties for Late or Missing Payments

Late filing or late payment carries a penalty of 10 percent of the unpaid tax for the first month, plus 1 percent for each additional month, up to a 30 percent cap. More than 60 days late, and the minimum penalty is $100 or the full tax due, whichever is less. A registered vendor who simply fails to file owes a minimum $50 penalty regardless of the tax amount.18New York State Senate. New York Tax Law 1145 – Penalties and Interest

Interest runs on top. New York charges 14.5 percent per year or the underpayment rate set by the Tax Commissioner, whichever is higher, compounded daily from the due date until payment.

Fraud is treated far more harshly: the penalty jumps to twice the tax due, plus interest. Collecting sales tax from customers and keeping it instead of remitting it can lead to prosecution under New York’s penal law. The state treats collected sales tax as money held in trust, and pocketing it is treated the same as theft of government funds.
