Rates by Location

Colorado’s statewide sales tax is 2.9%.2Justia. Colorado Code 39-26-104 – Property and Services Taxed La Plata County adds 3%, so unincorporated areas come to 5.9%.1La Plata County. Sales Tax Information Inside the three municipalities, the combined rates are:

  • Durango: 9.4% (2.9% state + 3.0% county + 3.5% city)3City of Durango. Sales, Use and Lodgers Tax
  • Bayfield: 8.9% (2.9% state + 3.0% county + 3.0% town)

What Gets Taxed and What’s Exempt

The tax applies broadly to retail sales of tangible personal property: furniture, electronics, clothing, building materials, and similar physical goods.2Justia. Colorado Code 39-26-104 – Property and Services Taxed Most professional services that don’t transfer a physical product are outside the tax base.

Common exemptions include:

  • Grocery food for home consumption, matching the federal food stamp program’s definition. Prepared food, hot beverages, and carbonated drinks don’t qualify.
  • Farm equipment such as tractors, irrigation systems, and dairy equipment with a per-unit price of at least $1,000, used directly in farming. Repair parts qualify regardless of price.4Justia. Colorado Code 39-26-716 – Exemptions – Farm Equipment and Farm Close-Out Sales
  • Diapers and feminine hygiene products, exempt from state sales tax under 2022 legislation.
  • Prescription drugs and certain medical devices, generally exempt at the state level.

La Plata County is a statutory county, so it generally follows the state’s exemption framework. Before assuming a large purchase is tax-free, confirm with the Colorado Department of Revenue’s rate lookup tool.5Colorado Department of Revenue – Taxation. How to Look Up Location Codes and Tax Rates

Getting a Sales Tax License

Any business selling taxable goods or services in the county needs a Colorado sales tax license before its first sale. New registrations use form CR 0100, filed through the Department of Revenue.6Colorado Department of Revenue – Taxation. CR 0100 – Colorado Sales Tax and Withholding Account Application Form DR 0594 is only for renewing an existing license. You’ll need your EIN (or SSN for sole proprietors), a physical address, an NAICS code, and an estimate of monthly sales. The sales estimate sets your filing frequency. Filing Schedule and Due Dates

How often you file depends on how much sales tax you collect each month:9Colorado Department of Revenue – Taxation. Sales Tax Filing Information

  • $15 or less per month: file annually, due January 20.
  • Under $600 per month: file quarterly, due the 20th of the month after the quarter ends.
  • $600 or more per month: file monthly, due the 20th of the following month.
  • $75,000 or more per year in state sales tax: pay by Electronic Funds Transfer, also due the 20th.

If the 20th falls on a weekend or holiday, the deadline moves to the next business day. Most businesses file electronically through Revenue Online, entering gross sales, deductions, and tax due. Paper returns are accepted if postmarked by the due date.

Vendor Fee Elimination in 2026

Colorado retailers used to keep a small percentage of state sales tax collected as compensation for the work of collecting and remitting it. That vendor fee was eliminated effective January 1, 2026.10Colorado General Assembly. HB25B-1005 Eliminate State Sales Tax Vendor Fee Retailers, remote sellers, and marketplace facilitators now remit 100% of what they collect.

Penalties for Late Filing

Miss a deadline and the penalty is the greater of $15 or 10% of the unpaid tax, plus 0.5% per month that the tax remains unpaid, up to a maximum of 18%.11Colorado Department of Revenue – Taxation. Tax Topics – Penalties and Interest Interest accrues on top. One missed quarterly return on a small liability may cost only $15. Let several periods pile up and the compounding charges can take a serious bite out of what you originally owed.

Use Tax on Untaxed Purchases

Use tax covers purchases where sales tax wasn’t collected at the register, typically online orders from out-of-state sellers that don’t collect Colorado tax, or items bought on trips to other states and brought home. The state use tax rate is 2.9%, matching the sales tax.12Colorado Department of Revenue – Taxation. Consumer Use Tax Guide If you already paid sales or use tax to another state on the same item, you can credit that against what Colorado would charge. Individuals generally report use tax once a year.

Motor vehicles are the exception: use tax on a vehicle is paid to the county clerk at registration, not to the Department of Revenue.12Colorado Department of Revenue – Taxation. Consumer Use Tax Guide The state-administered use tax only covers the state’s share; for any county use tax beyond that, contact La Plata County directly.

Remote Sellers and Marketplace Facilitators

Out-of-state sellers that exceed $100,000 in Colorado sales during the current or prior calendar year must obtain a sales tax license and start collecting. You have 90 days from crossing the threshold before collection must begin.13Colorado Department of Revenue – Taxation. Out-of-State Businesses Missing that window doesn’t excuse tax owed on later sales.

Marketplace facilitators such as Amazon and Etsy carry the collection obligation for sales made through their platforms, including the La Plata County portion since the county tax is state-collected.14Colorado Department of Revenue – Taxation. Marketplace Facilitators If you sell only through a qualifying marketplace, the platform handles the math. If you also sell through your own website or at local events, those direct sales are on you.

Lodging and Short-Term Rentals

Short-term lodging inside the county but outside city limits carries an extra tax. On top of regular sales tax, the county imposes a 2% lodging tax on rentals under 30 consecutive days.15La Plata County. Lodging Tax Information It applies to hotels, motels, bed-and-breakfasts, vacation rentals, campgrounds, and trailer parks. Owners or their management companies collect and remit both taxes. Inside Durango, the city has its own lodging tax rules, so operators there should check directly with the city. The upshot for travelers: a hotel night in the county is taxed noticeably higher than a retail purchase at the same address.
