Lancaster PA Sales Tax: Rate, Exemptions, and Hotel Surcharge

Sales tax in Lancaster, Pennsylvania is a flat 6%, the state rate set by Pennsylvania’s Tax Reform Code with no county or city tax added on top.1Pennsylvania Department of Revenue. Sales, Use and Hotel Occupancy Tax That same rate applies everywhere inside the county, from Lancaster City to Lititz, Ephrata, Columbia, or any township in between. Only Philadelphia (2%) and Allegheny County (1%) have adopted a local surcharge under Pennsylvania law.2Pennsylvania Code and Bulletin. Pennsylvania Code 61 Pa Code 60.16 – Local Sales, Use and Hotel Occupancy Tax Lancaster never has. A $1,000 purchase here carries $60 in sales tax; the same purchase in Philadelphia carries $80.

What You Pay 6% On

Pennsylvania taxes most tangible personal property — physical items you can carry out of a store. Electronics, furniture, appliances, jewelry, cosmetics, and office supplies all ring up at 6%.3Pennsylvania General Assembly. Pennsylvania Code 72 PS 7202 – Imposition of Tax

Cars and Other Titled Vehicles

Buying a car, truck, motorcycle, trailer, boat, or ATV in Lancaster triggers the 6% tax, and a private sale doesn’t change that. Pennsylvania pulls titled vehicles out of the “isolated sale” exception that otherwise lets individuals sell personal property tax-free.4Legal Information Institute. Pennsylvania Code 61 Pa Code 32.4 – Isolated Sales The tax is collected when you title or register with PennDOT. If the purchase price looks low compared with fair market value, the Department of Revenue can reassess the tax based on what the vehicle is actually worth.5Pennsylvania Department of Revenue. Streaming, Apps, and Digital Downloads

Since Act 84 of 2016, the 6% also applies to digital goods delivered electronically: e-books, downloaded music, streaming video subscriptions like Netflix and Hulu, apps, games, and digital audiobooks.6Pennsylvania Department of Revenue. Tax on Digital Products Taxability follows your billing address, so a Lancaster billing address means Pennsylvania tax.

What’s Exempt

Pennsylvania exempts several categories that many other states tax, which pulls the real tax burden on day-to-day spending well below the 6% headline rate.

Clothing and Shoes

Ordinary clothing and footwear are not taxed. Jeans, t-shirts, sneakers, coats, dresses, and underwear are all tax-free at the register.7Pennsylvania General Assembly. Pennsylvania Code 72 PS 7204 – Exclusions From Tax The exceptions catch people off guard. You will pay 6% on:

  • Formal wear, such as tuxedos and evening gowns
  • Accessories like handbags, belts, scarves, jewelry, and watches
  • Real or imitation fur clothing where fur is the most valuable component
  • Sporting equipment and clothing worn only during sports — athletic uniforms, helmets, cleats, ski jackets

The dividing line is whether the item works as ordinary daily wear. A regular winter coat is exempt. A ski jacket meant only for the slopes is not.

Groceries

Unprepared food from grocery stores, supermarkets, and farmers markets is exempt. Raw meat, produce, dairy, bread, cereal, and canned goods all qualify. Tax kicks in once food is prepared or ready to eat: restaurant meals, deli sandwiches, hot buffet food, sushi from a prepared-food counter, and self-service salad bars are all taxable.8Pennsylvania Department of Revenue. Retailers Information (REV-717) Soft drinks, sports drinks, and flavored water are taxable even at a grocery store. Plain bottled water and 100% fruit juice are not.

Medicine and Medical Supplies

Both prescription and over-the-counter medications are exempt. So are crutches, wheelchairs, hearing aids, eyeglasses, prosthetics, and most medical supplies. This runs broader than many states, which usually exempt only prescription drugs.

Household Essentials

Residential utilities — electricity, natural gas, heating oil — are exempt, along with basic residential telephone service. Disposable hygiene products like diapers and toilet paper are exempt, as are textbooks and newspaper subscriptions.

Hotel Stays Add 5% on Top

The one place a Lancaster County purchase carries more than 6% is a hotel room. Visitors staying in county hotels, motels, or bed-and-breakfasts pay a combined 5% local hotel tax on top of the state’s 6%, split between a 3.9% hotel room rental tax and a 1.1% excise tax. The money funds the Lancaster County Convention Center and local tourism promotion.9Lancaster County Convention Center Authority. Funding The total tax on a Lancaster hotel room is 11%.

Online and Out-of-State Purchases

If you buy something from an online or out-of-state seller that doesn’t collect Pennsylvania tax at checkout, you still owe the 6%. It’s called use tax, and it applies to the same goods at the same rate as sales tax. The usual scenario is a smaller online shop that isn’t registered to collect PA tax.

Pennsylvania residents can report use tax on their annual PA-40 income tax return through myPATH or Fed/State e-File.10Pennsylvania Department of Revenue. Use Tax for Individuals If you already paid sales tax to another state on the same item, Pennsylvania credits that amount. You’d owe only the difference, and only if the other state’s rate was lower than 6%.

Yard Sales and Private Sales Between Individuals

Selling personal belongings to another person — a used couch on Craigslist, tools at a yard sale, baby gear to a neighbor — generally qualifies as an “isolated sale” and carries no sales tax. The exemption covers infrequent, non-recurring sales by someone who isn’t in the business of selling that type of property.4Legal Information Institute. Pennsylvania Code 61 Pa Code 32.4 – Isolated Sales A few categories stay taxable no matter who’s selling:

  • Vehicles, boats, ATVs, and aircraft that need to be registered or licensed
  • Business inventory, even in a one-time sale
  • Sales held on the same premises as licensed retailers (flea markets, for example)

Nonprofits running fundraising sales lose the isolated-sale protection once they hold sales on more than three occasions or more than seven days in a calendar year.

If You’re Running a Business in Lancaster

Any business selling taxable goods or services in Lancaster needs a Pennsylvania sales tax license before collecting tax from customers. Registration runs through the myPATH portal, which replaced the old PA-100 paper form, and you’ll need a Federal Employer Identification Number along with basic business information.11Commonwealth of Pennsylvania. Register My Business for Taxes

New accounts start on a quarterly filing schedule. Each November, the Department reviews your third-quarter collections (July through September) and may change your frequency for the next year: $600 or more moves you to monthly, $75 to $599.99 keeps you quarterly, and under $75 drops you to semi-annual.12Pennsylvania Department of Revenue. How Is My Filing Period for Sales Tax Determined

When a customer claims an exemption — for resale, manufacturing, or because they’re a qualifying nonprofit — the seller must collect a completed REV-1220 exemption certificate within 60 days of the sale and keep it on file for at least four years.13Pennsylvania Department of Revenue. Pennsylvania Tax Unit Exemption Certificate (REV-1220) An incomplete or invalid certificate shifts liability for the uncollected tax to the seller. Nonprofits with an exemption number starting with “75” must also submit a REV-1715 for purchases of $200 or more.

Missing a filing deadline triggers a penalty of 5% of the unpaid tax per month, up to 25%, plus interest on the balance. Businesses that collect sales tax but fail to send it to the state face a sharper consequence: Pennsylvania treats collected tax as money held in trust for the Commonwealth, and the Department of Revenue can pursue individual officers, owners, or managers personally for the unpaid amount.14Pennsylvania Department of Revenue. Use Tax Voluntary Compliance Program A claim that you didn’t personally benefit or didn’t intend to defraud the state isn’t a defense. Former officers who don’t remove their names from Department records can face assessments for periods after they’ve left.
