Legal Adult Age in Louisiana: What Changes at 18 and 21

The legal age of adulthood in Louisiana is 18. That’s the age of majority set by Louisiana Civil Code Article 29, and it’s the point at which you can sign binding contracts, consent to your own medical care, vote, and take on legal obligations without a parent in the room.1Justia. Louisiana Civil Code Article 29 – Age of Majority But 18 doesn’t unlock everything. Alcohol, gambling, tobacco, and handgun purchases all wait until 21, and some adult-level criminal consequences can reach you years before 18.

What You Can Do the Day You Turn 18

Contracts become real. A lease you sign at 18 is enforceable. So is a credit card agreement, a car loan, or a cell phone contract. Before 18, most agreements a minor signs can be voided for lack of legal capacity; after 18, there is no parental safety net unless a parent voluntarily co-signs.

Medical decisions shift to you. Doctors and hospitals need your consent, not your parents’. Under HIPAA, your health records belong to you, and a parent who wants access generally needs your written authorization.2HHS.gov. Personal Representatives and Minors Educational records follow the same pattern: FERPA transfers control of school records from your parents to you at 18 or whenever you enroll in a postsecondary institution, though a college can still share records with parents who claim you as a tax dependent.3U.S. Department of Education – Protecting Student Privacy. Civic life opens up. The Louisiana Constitution guarantees the right to register and vote at 18.4Louisiana State Senate. State Constitution of 1974 – Article I Declaration of Rights You can serve on a Louisiana jury if you’re a citizen, 18 or older, and reside in the parish,5Justia. Louisiana Code of Criminal Procedure Article 401 – General Qualifications of Jurors and federal jury service uses the same minimum age.6Office of the Law Revision Counsel. 28 USC 1865 – Qualifications for Jury Service

Hazardous work opens up too. Federal labor law bars 16- and 17-year-olds from 17 categories of dangerous occupations, including roofing, mining, demolition, excavation, operating power-driven meat slicers and bakery equipment, and jobs involving explosives or radioactive materials.7eCFR. Subpart E – Occupations Particularly Hazardous for the Employment of Minors Between 16 and 18 Years of Age At 18 those restrictions fall away.

What Stops When You Turn 18

Child support obligations in Louisiana end automatically at the age of majority. The paying parent doesn’t need to go back to court. Two exceptions extend support: if you’re still a full-time student in a secondary school program, support continues until you graduate or turn 19, whichever comes first; and if you have a developmental disability that began before age 22, a court can order continued support while you remain in secondary school.8Louisiana State Legislature. Louisiana Revised Statutes RS 9:315.22

Social Security survivor and dependent payments for an unmarried child generally stop at 18, with the same kind of extension for full-time secondary students (through graduation or two months after turning 19) and an indefinite continuation for a child whose disability began before age 22.9Social Security Administration. Tax dependency doesn’t end at 18. A parent can still claim you as a qualifying child if you’re under 19 at the end of the tax year, and that cutoff extends to under 24 if you’re a full-time student.10Internal Revenue Service. Qualifying Child Rules Being claimed changes your standard deduction and your eligibility for some credits, so coordinate with your parents at tax time.

What Still Waits Until 21

Reaching 18 does not finish the job. Four significant activities remain restricted until 21, and this is where young adults in Louisiana are most often caught off guard.

Alcohol

You must be 21 to purchase or publicly possess any alcoholic beverage in Louisiana, whether beer, wine, or spirits.11Louisiana State Legislature. Louisiana Revised Statutes RS 14:93.12 – Purchase and Public Possession of Alcoholic Beverages “Public possession” covers streets, highways, and any place open to the public. The exception is when a person under 21 is accompanied by a parent, spouse, or legal guardian who is 21 or older.12Louisiana State Legislature. Louisiana Revised Statutes RS 14:93.10 – Definitions A violation can bring a fine of up to $100 and a 180-day driver’s license suspension, though a first-offense restricted license is available if the loss of driving would create hardship for school or work. The citation isn’t added to your criminal history.

Tobacco and Vaping

Selling tobacco, alternative nicotine products, or vapor products to anyone under 21 is illegal in Louisiana, matching the federal Tobacco 21 law.13Justia. Louisiana Revised Statutes 14:91.8 – Unlawful Sale, Purchase, or Possession of Tobacco, Alternative Nicotine Products, or Vapor Products The only exception for a person under 21 handling these products is when an employer requires it as part of the job.

Gambling

You must be 21 to play any licensed game or slot machine at a Louisiana casino. The rule also bars anyone under 21 from loitering in gaming areas or working as a gaming employee.14Louisiana State Legislature. Louisiana Revised Statutes RS 27:260 – Gaming or Employment in Gaming Prohibited for Persons Under Twenty-One

Handguns

Federal law splits firearm purchases by age. You can buy a rifle or shotgun from a licensed dealer at 18, but a handgun requires 21. This is a federal rule under 18 U.S.C. ยง 922 that applies at every licensed dealer in the country.15Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts

Becoming an Adult Before 18

Louisiana recognizes two routes to legal adulthood before the 18th birthday.

Judicial Emancipation

A minor who is at least 16 can petition a court for emancipation. The court must find good cause and can grant either full emancipation, which gives essentially all adult legal powers, or limited emancipation, which grants only the specific powers the judge lists in the order.16Louisiana State Legislature. Louisiana Civil Code Article 366 – Judicial Emancipation Filing fees vary by parish, and the minor typically needs to show the ability to be self-supporting.

Marriage

A minor who is 16 or 17 and marries is automatically and fully emancipated under Louisiana law. This emancipation cannot be modified or reversed, even if the marriage later ends.17Louisiana State Legislature. Louisiana Civil Code Article 367 – Emancipation by Marriage Since 2019, no one under 16 can marry in Louisiana at all, and a 16- or 17-year-old cannot marry someone of the age of majority if the age gap is three years or more.18Louisiana State Legislature. Louisiana Civil Code Article 90.1 – Impediment of Age

When Minors Can Be Prosecuted as Adults

The juvenile system usually handles offenders under 18, but Louisiana carves out serious exceptions. A child who is 15 or older at the time of the offense and is charged with first degree murder, second degree murder, aggravated rape, or aggravated kidnapping loses juvenile court jurisdiction as soon as a grand jury returns an indictment or the court finds probable cause. The case then proceeds in adult criminal court with adult penalties.19Justia. Louisiana Children’s Code Article 305 – Divestiture

For a broader set of serious offenses, a child who is 14 or older can be transferred for adult prosecution after a hearing, on motion of the district attorney or the court itself.20Justia. Louisiana Children’s Code Article 857 – Transfers for Criminal Prosecution Authority A minor prosecuted as an adult faces the same sentencing range as any adult defendant.

Milestones That Don’t Line Up With 18

A few other age thresholds sit on either side of 18.

Driving. Louisiana uses a three-stage graduated license for drivers under 17. A learner’s permit is available at 15, an intermediate license at 16 after at least 180 days with a clean record on the permit, and a full unrestricted Class E license at 17 after 12 consecutive months with no at-fault crashes, moving violations, curfew issues, or drug or alcohol violations.21Justia. Louisiana Revised Statutes 32:407 – Applications of Minors Full driving privileges arrive a year before adulthood.

Military enlistment. Federal law allows enlistment in the armed forces at 17 with written parental consent; at 18 no consent is required.22GovInfo. 10 USC 505 – Regular Components Qualifications, Term, Grade Every branch accepts applicants starting at 17.23USAGov. Selective Service. Almost all male U.S. citizens and male immigrants must register with the Selective Service System between 18 and 25.24Selective Service System. Who Needs to Register There is no active draft, but failing to register can disqualify you from federal student aid, federal job training, and federal employment.25Office of the Law Revision Counsel. 50 USC 3802 – Registration
