Legal Age to Purchase Tobacco in Louisiana: ID, Exceptions, and Penalties

The legal age to buy tobacco in Louisiana is 21. That minimum applies to cigarettes, cigars, smokeless tobacco, vapes, and nicotine pouches, and it covers every retailer in the state. The rule comes from two layers of law working together: the federal Tobacco 21 statute signed in December 2019, which amended 21 U.S.C. ยง 387f to bar any retailer in the country from selling tobacco products to anyone under 21,1Office of the Law Revision Counsel. 21 USC 387f – General Provisions Respecting Control of Tobacco Products and Louisiana Revised Statutes 14:91.8, which makes it illegal for anyone in Louisiana to sell, distribute, buy, or possess these products if they’re under 21.2Louisiana State Legislature. What Products the Age-21 Rule Covers

Louisiana law puts three product categories behind the age-21 wall, each defined in Revised Statutes 26:901.3Justia. Louisiana Revised Statutes Title 26 Section 26:901 – Definitions Tobacco products include cigarettes, cigars, smokeless tobacco, and smoking tobacco. Vapor products cover any device that uses a heating element or electronic circuit to produce vapor from nicotine or another substance, which sweeps in e-cigarettes, vape pens, and the cartridges and e-liquids made for them. Alternative nicotine products are the non-combustible items like nicotine pouches and lozenges that aren’t tobacco and aren’t vapes.

The practical takeaway is that a product doesn’t need to contain actual tobacco leaf to be off-limits. If it delivers nicotine and is meant for human consumption, Louisiana almost certainly treats it as a 21-and-over purchase.

What You’ll Be Asked for at the Register

Every retailer selling tobacco, vapor, or alternative nicotine products in Louisiana has to verify the buyer’s age. Under Revised Statutes 26:911, the clerk must examine a driver’s license, selective service card, or other lawful identification that shows the buyer’s age on its face.4Justia. Louisiana Revised Statutes Title 26 Section 26:911 – Acts Prohibited The requirement applies to every tobacco purchaser, not just customers who look young, so expect to be asked no matter your age.

The LA Wallet app, Louisiana’s official digital driver’s license, is accepted for tobacco purchases through authorization from the Office of Alcohol and Tobacco Control. A retailer can still ask for the physical card if they prefer.

No Exception for Military or Parental Consent

Louisiana does not lower the age for active-duty service members, and federal law doesn’t either. The Department of Defense began enforcing the 21-and-over standard on all military installations in August 2020, so commissaries and base exchanges will not sell tobacco to anyone under 21.5The United States Army. DoD to Implement New Laws for Tobacco Sales Beginning in August There is no parental consent exception either. A parent cannot legally buy tobacco and hand it to a child under 21, and a retailer who takes part in that kind of arrangement faces the same penalties as any other illegal sale.

Penalties if You’re Under 21

Louisiana makes it illegal not only to sell tobacco to someone under 21, but also to buy or possess it under that age. The penalties under RS 14:91.8 escalate with repeat offenses.2Louisiana State Legislature. Louisiana Revised Statutes 14:91.8 – Unlawful Sale, Purchase, or Possession of Tobacco, Alternative Nicotine Products, or Vapor Products; Signs Required; Penalties A first offense can bring a fine of up to $50 or a requirement to complete a tobacco education program. A second offense can mean a higher fine or community service of up to 16 hours. Further violations bring steeper fines and additional service hours.

If the offender is under 18, the case may go to juvenile court, where a judge can order fines, community service, or an educational program. Parents or guardians are typically notified. Some courts run diversion programs that let a first-time offender finish a class and avoid a fine entirely.

One narrow situation that confuses people: employees under 21 are allowed to handle tobacco as part of their job. A 19-year-old cashier ringing up cigarettes for an adult customer isn’t violating the law. The prohibition is on buying and possessing for personal use, not on processing a sale for a qualified buyer.

Clearing a Juvenile Tobacco Record

For cases that go through the juvenile system, Louisiana allows records to be expunged and sealed. Once a court grants expungement, the records are treated as though they never existed, and the person is not required to disclose the arrest or adjudication on job applications, school forms, or other inquiries.6Louisiana State Legislature. Louisiana Children’s Code Article 922 – Expungement and Sealing Order; Effect A parent or guardian can petition the court on the child’s behalf. The process generally requires that the case be closed and any conditions of the sentence satisfied.

Buying Tobacco Online or by Mail

Ordering online doesn’t get you around the age rule. The federal PACT Act requires every delivery seller to verify the buyer’s full name, date of birth, and residential address through a commercially available database made up primarily of government records before accepting an order.7Office of the Law Revision Counsel. 15 USC 376a – Delivery Sales At delivery, someone at least 21 has to sign for the package and show government-issued photo ID. A single shipment can’t exceed 10 pounds.

The U.S. Postal Service effectively bans mailing tobacco products for personal or commercial purposes. The narrow exceptions cover business-to-business shipments by licensed manufacturers and distributors, intra-state mailings within Alaska or Hawaii, and small noncommercial gifts between adults, which are limited to 10 mailings per 30-day period at no more than 10 ounces each. All permitted mailings require adult signature service and age verification at delivery.8Postal Explorer (USPS). Mailability Exceptions for Cigarettes, Smokeless Tobacco, and ENDS Private carriers such as UPS and FedEx have their own policies restricting tobacco shipments, and Louisiana’s age verification requirements apply to any delivery completed inside the state.
