Lewis County NY Sales Tax Rate: Exemptions, Services, and Filing

The Lewis County NY sales tax rate is 8%, made up of New York’s 4% state sales tax and a 4% local tax imposed by Lewis County. That combined rate applies to most retail sales of goods, many services, and certain digital products delivered within the county.

How the 8% Breaks Down

The state’s 4% is the baseline that applies everywhere in New York.1New York State Department of Taxation and Finance. Sales Tax Rate Publications Lewis County’s 4% local portion includes a standard 3% that most New York counties are authorized to charge, plus an additional 1% specifically authorized for Lewis County by the state legislature.

That extra 1% isn’t permanent. It’s currently extended through November 30, 2027, and requires periodic reauthorization. If the legislature lets it lapse, the combined rate would drop to 7%. Until then, 8% is the figure to plan around.

What’s Fully Exempt

Several common purchases carry no sales tax at all in Lewis County.

Groceries and Unprepared Food

Most food sold for home consumption is exempt, including bread, dairy, fruits, vegetables, meat, and similar staples, as long as they’re sold unheated and in the same form a retail food store would sell them.2New York State Department of Taxation and Finance. Listings of Taxable and Exempt Foods and Beverages Sold by Food Stores and Similar Establishments Dietary supplements and health foods also qualify.

The exemption ends the moment the food is “prepared.” Food sold heated, food meant to be eaten on the premises, and food arranged on a plate or platter ready to eat are all taxable at the full 8%.3New York State Department of Taxation and Finance. Food and Food Products Sold by Food Stores and Similar Establishments A hot rotisserie chicken from the deli counter is taxable. A raw chicken from the meat case is not. Bakery items are exempt as packaged groceries but become taxable when sold with utensils or for eating in the store.

Prescription Drugs and Medical Equipment

Prescription and over-the-counter drugs intended to treat, prevent, or diagnose illness are exempt from both the state and local portions. Medical equipment used for treatment or to correct physical incapacity qualifies too, along with prosthetic devices, hearing aids, and eyeglasses.4Legal Information Institute. New York Comp. Codes R. and Regs. Tit. 20 528.4 – Drugs and Medicines The equipment has to be primarily and customarily used for medical purposes. Items that would be useful even without an illness or injury don’t qualify.

Where Lewis County Charges More Than You May Expect

Two categories are commonly assumed to be tax-free in New York but aren’t fully exempt in Lewis County.

Clothing and Footwear Under $110

New York State exempts clothing and footwear priced under $110 per item from the 4% state tax.5New York State Department of Taxation and Finance. Clothing and Footwear Exemption Lewis County has not elected to match that exemption locally, so the full 4% county tax still applies.6New York State Department of Taxation and Finance. A $90 pair of shoes in Lewis County costs $3.60 in sales tax (4% local only). Clothing and footwear priced at $110 or above are taxed at the full 8%. The $110 threshold is per item, not per transaction, so a $95 shirt and a $105 pair of pants are evaluated separately.

Residential Energy

New York exempts residential purchases of electricity, natural gas, propane in containers of 100 pounds or more, fuel oil, coal, wood for heating, and steam from its 4% state tax.7New York State Department of Taxation and Finance. This split applies only to residential use; commercial and industrial energy follow different rules.

Services Taxed at 8%

Sales tax isn’t limited to physical goods. New York taxes a specific list of services at the same combined rate, including repair, maintenance, and installation of personal property.9New York State Senate. New York Tax Law TAX 1105 Paying someone to fix an appliance, service a lawnmower, or install a water heater means the labor charge is taxable.

Other taxable services include parking and garaging motor vehicles, interior decorating, and certain information services. Real property maintenance such as landscaping or janitorial work is taxable. Capital improvements to real property, like a new roof or an addition, are generally exempt when the contractor provides a proper exemption certificate.

Collecting and Filing the Tax

Businesses collect the 8% at the register and remit it to the New York State Department of Taxation and Finance, which distributes the local share back to the county. Most vendors file quarterly on Form ST-100, the New York State and Local Quarterly Sales and Use Tax Return.10New York State Department of Taxation and Finance. New York’s sales tax quarters don’t match the calendar. The four periods are:

  • March 1 through May 31, due June 20
  • June 1 through August 31, due September 20
  • September 1 through November 30, due December 20
  • December 1 through February 28 or 29, due March 20

Each return is due no later than 20 days after the end of its quarter.11New York State Department of Taxation and Finance. Remote Sellers and Marketplaces

Out-of-state businesses have to collect the 8% once they cross both of New York’s economic nexus thresholds: more than $500,000 in gross receipts from sales delivered into the state and more than 100 transactions during the preceding four sales tax quarters. Both thresholds must be met; hitting only one doesn’t trigger the obligation.14New York State Department of Taxation and Finance. Registration Requirement for Businesses with No Physical Presence

Sellers on marketplace platforms like Amazon or Etsy generally don’t collect Lewis County tax themselves. Under New York’s marketplace facilitator rules, the platform collects and remits for third-party sellers. If you also sell through your own website, those direct sales are measured separately against the nexus thresholds.
