Local Law 94: NYC Sustainable Roof Coverage and Filing

Local Law 94 of 2019 requires private building owners in New York City to make the entire roof a “sustainable roofing zone” — covered by solar panels, a green roof, or a combination of the two — whenever they put up a new building or fully replace an existing roof.1New York City Department of Buildings. When the Requirement Kicks In

Two situations trigger compliance: filing a permit for a new building after November 15, 2019, or replacing an entire roof deck or roof assembly on an existing one. Size and use do not matter. A partial repair or patch does not trigger the rule. What 100 Percent Coverage Actually Means

The entire roof, minus specific excluded areas, must be a sustainable roofing zone. Most buildings end up with a mix — solar on the sunniest sections, vegetation on the rest. The code sets thresholds that determine which system belongs where:

  • Contiguous roof areas of at least 200 square feet (or at least 100 square feet on residential buildings of five stories or fewer) must carry solar panels if the space can hold at least 4 kW of generating capacity.3UpCodes. New York City Building Code 2022 – Sustainable Roofing Zone
  • Low-slope areas (2:12 or shallower) that cannot support 4 kW of solar must be covered with a green roof system instead.1New York City Department of Buildings. Local Law 94 of 2019

Green roof systems must meet the Building Code’s design standards, including ANSI/SPRI RP-14 and VF-1 for wind uplift and vegetation, with a growing medium and drought-resistant plants that manage stormwater.5UpCodes. Roof Area That Doesn’t Count

Several categories of rooftop space come out of the calculation before you figure out how much solar or vegetation you need:4New York City Department of Buildings. Solar and Green Roofs

  • Fire access paths and setbacks required by the Fire Code, Construction Codes, or Zoning Resolution, including the access paths in Fire Code Section 504.4.
  • Mechanical equipment and rooftop structures such as cooling towers, HVAC units, parapets, guardrails, solar thermal systems, and water towers.
  • Stormwater management infrastructure.
  • Playgrounds, participant sport areas for schools and sports facilities, and roof terraces accessory to the building’s use and documented on the Certificate of Occupancy or an approved DOB filing.

An exclusion removes area from the calculation. It does not shrink the coverage percentage. Whatever roof space is left after exclusions still must be fully covered by solar, a green roof, or a mix.

Structural Analysis and Documentation

Before anything gets filed, a licensed Professional Engineer or Registered Architect must perform a structural analysis confirming the roof can carry the additional load. Green roofs are heavy: a saturated growing medium can add 15 to 30 pounds per square foot, and older buildings often need reinforcement. The professional signs and seals a report detailing load-bearing capacity and any upgrades required.

The design professional certifies the figures and describes the technical specifications of the chosen systems. Numbers on the form must match the project drawings. Discrepancies draw objections during review and stretch the timeline.

p>A structural roof analysis usually runs between $350 and $950 depending on complexity. Green roof installation runs roughly $10 to $35 per square foot, so a 5,000-square-foot green roof lands somewhere between $50,000 and $175,000 before incentives.

Filing Through DOB NOW: Build

All filings go through DOB NOW: Build, the city’s online portal for licensed professionals.7New York City Department of Buildings. Filing fees scale with the estimated cost of construction:9New York City Administrative Code. New York City Administrative Code 28-112.2 Schedule of Permit Fees

  • One- to three-family dwellings: $130 minimum for the first $5,000 of construction cost, plus $2.60 per additional $1,000.
  • Larger buildings under seven stories: $280 minimum for the first $3,000, plus $10.30 per additional $1,000.
  • Buildings seven stories or taller: $290 minimum, plus $17.75 per additional $1,000.

DOB reviews the plans for code compliance, and objections must be answered with additional data or a revised design before a construction permit issues. Expect several weeks for the review cycle, longer if mechanical exclusions or reinforcement plans need extensive backup.

Incentives and the LL97 Connection

New York City offers a property tax abatement of $10 per square foot of green roof, capped at $200,000 or the property tax owed that year, whichever is less. Properties in designated community districts qualify for an enhanced $15 per square foot rate under the same cap. The program runs through June 30, 2027.10New York State Senate. For commercial properties, the federal Section 48E clean electricity investment tax credit is still available at a 6 percent base rate, or 30 percent if prevailing wage and apprenticeship requirements are met. The One Big Beautiful Bill Act, signed in July 2025, tightened the timeline: solar projects must begin construction by July 4, 2026, or be placed in service by December 31, 2027, to qualify. The bigger financial angle for many owners is Local Law 97, the city’s building emissions cap. Most buildings over 25,000 square feet face greenhouse gas limits that tighten over time, with a penalty of $268 per metric ton of CO2 over the limit.13NYC Buildings. Green roofs cut cooling loads, which shrinks a building’s footprint indirectly. For owners staring down five- or six-figure annual LL97 penalties, adding solar during a mandatory roof replacement often pays back faster than expected.

Ongoing Maintenance

A green roof requires a written maintenance plan prepared by a licensed professional engineer, registered architect, or licensed landscape architect. The plan must cover:

  • Semi-annual full inspections of the entire green roof system.
  • Monthly drain inspections to confirm drains are free of debris.
  • A plant replacement plan for vegetation that dies or is damaged.

The drainage layer must be designed so drains stay accessible for inspection and cleaning.11NYC Department of Buildings. Green Roofs Owners claiming the tax abatement must maintain the system for at least four years. Letting vegetation die or drains clog during that window can void the abatement.

Solar panels need lighter attention: periodic cleaning, annual checks on inverters and wiring, and output monitoring if the system counts toward LL97 compliance.

Penalties for Non-Compliance

The Department of Buildings inspects active construction and issues violations for projects that fail to meet the sustainable roofing zone rules.15NYC311. Solar or Green Roof Non-Compliance The law does not set a penalty unique to Local Law 94, so DOB enforces it under the general civil penalty framework, which is graduated by severity:16New York City Administrative Code.   • Lesser violations: up to $500 per violation.
  • Major violations: $1,000 to $10,000 per violation, plus up to $250 per month the violation remains uncorrected.
  • Immediately hazardous violations: $2,500 to $25,000 per violation, plus up to $1,000 per day until corrected.

The daily and monthly accruals add up quickly. An open violation can also hold up your Certificate of Occupancy, delay tenant move-ins, and complicate refinancing or a sale. Building compliance into the project from the start is far cheaper than trying to retrofit after DOB flags it.
