Under Los Angeles cannabis laws, adults 21 and older can possess up to 28.5 grams of cannabis flower and up to eight grams of concentrate, use cannabis inside a private residence where the owner permits it, buy from retailers licensed by both the city and the state, and grow up to six plants per household. The rest of the rules are about where those freedoms stop: public spaces, cars, workplaces with federal ties, federal property, and shops operating without a license.
How Much You Can Carry and Who Qualifies
California Health and Safety Code 11362.1 sets the possession ceiling for adults 21 and over at 28.5 grams of flower (about an ounce) and eight grams of concentrate. You can give those same amounts to another adult as a gift. Cannabis within those limits cannot be used as the basis for a detention, search, or arrest.1California Legislative Information. California Health and Safety Code 11362.1
Go over the limit and the picture changes fast. For anyone 18 or older, carrying more than 28.5 grams of flower or more than eight grams of concentrate is a misdemeanor carrying up to six months in county jail, up to a $500 fine, or both. People aged 18 to 20 who stay within the standard amounts face an infraction with a fine of up to $100.2California Legislative Information. California Code HSC 11357 Anyone under 18 is routed into drug education and community service rather than fines.
Where You Can Actually Use It
Legalization did not create a right to light up anywhere. State law prohibits smoking or ingesting cannabis in any public place, which covers sidewalks, parks, beaches, restaurants, bars, and anywhere else open to the public.3California Legislative Information. California Code HSC 11362.3 You also cannot smoke cannabis anywhere tobacco smoking is already banned, which in Los Angeles sweeps in most indoor workplaces and many outdoor dining areas.
The reliable safe zone is inside a private residence where the owner allows it. Renters should read the lease, because landlords can prohibit cannabis use on their property. California law authorizes licensed consumption lounges under Business and Professions Code 26200, but these remain rare in Los Angeles as of 2026.
The 1,000-Foot School Buffer
A 1,000-foot buffer applies around schools, day care centers, and youth centers whenever children are present. Smoking or vaping cannabis anywhere inside that zone is illegal, with one narrow exception: you may consume inside your own home (or a licensed lounge, if one is nearby) provided the smoke or vapor is not detectable on the school or facility grounds. Possessing or using cannabis directly on those grounds while children are present is prohibited outright.3California Legislative Information. California Code HSC 11362.3
Driving Rules
Cannabis behind the wheel is treated the way alcohol is. California Vehicle Code 23152(f) makes it illegal to drive while under the influence of any drug, and cannabis is squarely within that prohibition.4California Legislative Information. California Code VEH 23152 Passengers cannot smoke or ingest cannabis in a moving vehicle either.3California Legislative Information. California Code HSC 11362.3
Open-container rules mirror alcohol too. Having an opened or unsealed package, or loose flower not in a container, while driving is an infraction with a fine of up to $100. Keep opened products in the trunk and you avoid the issue. Medical patients with a valid ID card get a limited exception: they can keep opened cannabis in the passenger area if it is in a sealed or closed container.5California Legislative Information. Buying From a Licensed Retailer
Los Angeles regulates its cannabis market through the Department of Cannabis Regulation (DCR), which vets applicants, issues city licenses, and enforces compliance.6City of Los Angeles. Department of Cannabis Regulation Every legal dispensary must hold a city license from the DCR and a state license from the California Department of Cannabis Control. You can verify any retailer’s status through the DCR’s search tool before you visit, or through the state’s online license search for delivery operators.7Department of Cannabis Control. Unlicensed operations skip mandatory testing for pesticides, heavy metals, and potency.
What You Will Pay in Tax
Legal cannabis carries a heavy tax load. The state excise tax on gross receipts from retail cannabis sales is 15%, a rate that took effect in October 2025 and is scheduled to remain through at least June 2028.9California Department of Tax and Fee Administration. Tax Rates – Special Taxes and Fees The City of Los Angeles adds a 10% local cannabis business tax on adult-use retail sales.10California Department of Tax and Fee Administration. Tax Facts for Cannabis Businesses Regular state and local sales tax applies on top. The combined effective rate on a dispensary purchase often exceeds 35%, which is the main reason legal prices remain above the illicit market.
Why Most Shops Still Want Cash
Federal banking law continues to create friction at the register. The SAFE Banking Act, which would have given banks and credit unions legal protection for serving cannabis businesses, has not been enacted as of 2026. Visa and Mastercard network rules prohibit transactions involving marijuana sales regardless of state legality. Most dispensaries rely on ATM-style debit transactions or cashless point-of-sale systems, and many keep an ATM on site. This is an industrywide constraint, not a sign that a particular retailer is sketchy.
Growing at Home
California law allows adults 21 and older to grow up to six living plants per household. That ceiling applies to the residence, not to each person, so two adults sharing an apartment share one six-plant limit.11California Legislative Information. California Health and Safety Code 11362.2
The plants, and any harvested cannabis above 28.5 grams, must be kept in a locked space that is not visible from any public area. An indoor closet, a locked spare room, or a secure greenhouse all qualify. An open backyard garden visible from the sidewalk does not. Cities can layer additional rules on top of the state baseline and can prohibit outdoor cultivation outright, but they cannot ban indoor growing in a private residence.11California Legislative Information. California Health and Safety Code 11362.2
Renters should check the lease; landlords can prohibit cultivation on their property. And selling any home-grown cannabis without a commercial license is illegal no matter the quantity. Personal use only.
Your Job and Your Cannabis Use
Under AB 2188, which took effect January 1, 2024, California employers cannot discriminate in hiring or employment based on off-duty, off-site cannabis use. They also cannot penalize you based on a drug test that detects only nonpsychoactive cannabis metabolites, the residue that lingers long after any impairment is gone.12California Legislative Information. California Assembly Bill 2188
The carve-outs matter. Construction trades are entirely exempt. So are positions requiring a federal background investigation or security clearance, and any role subject to federal drug-testing requirements. AB 2188 also does not permit on-the-job use or showing up impaired.
Federal employees and federal contractors fall outside California’s protections. Federal workers remain subject to drug testing and face discipline up to termination for any marijuana use, even off-duty, even in California. Federal contractors must maintain a drug-free workplace under FAR 52.226-7, which requires employees to abstain from controlled substances and report any drug conviction within five days.13Acquisition.GOV. Drug-Free Workplace Commercial drivers and others in Department of Transportation safety-sensitive roles are tested under 49 CFR Part 40, which still treats marijuana as prohibited. A positive marijuana test means immediate removal from duty, and a California medical card is not a defense.
Federal Law Still Matters
In April 2026 the federal government rescheduled certain marijuana products from Schedule I to Schedule III of the Controlled Substances Act. The rescheduling covers FDA-approved marijuana products and marijuana subject to a state-issued medical marijuana license.14Federal Register. Schedules of Controlled Substances – Rescheduling of FDA-Approved Products This is a partial change, not full legalization. Recreational marijuana outside a state medical license remains Schedule I.
Cannabis is still illegal to possess or use on federal land regardless of the rescheduling. National parks, federal courthouses, VA hospitals, military installations, and post offices all follow federal rules. The California Department of Cannabis Control warns specifically that federal land is off-limits.15Department of Cannabis Control. What’s Legal
Flying With Cannabis
As of 2026, the TSA allows medical marijuana in both carry-on and checked bags, with caveats. TSA officers do not actively search for marijuana, but if a substance is discovered during screening, TSA refers the matter to local, state, or federal law enforcement, and the final call on whether an item passes rests with the individual officer.16Transportation Security Administration. Medical Marijuana Leaving LAX with a small amount is unlikely to cause problems. Landing somewhere else is another question: the moment you arrive in a state where cannabis is illegal, you are subject to that state’s laws.
Why the Unlicensed Shop Down the Street Is a Problem
Los Angeles treats unlicensed cannabis operations seriously. Operating without a license violates LAMC Section 104.15, a misdemeanor punishable by up to $1,000 in fines, up to six months in jail, or both. Each day of continued operation counts as a separate offense.17Los Angeles Municipal Code. Los Angeles Municipal Code SEC 104.15 – Enforcement and Penalties for Unlawful Cannabis Related Activity
The city can also pursue civil penalties of up to $20,000 per day and seek injunctions to shut operations down. The Department of Water and Power is authorized to disconnect utilities at locations confirmed to be conducting unlicensed cannabis business. For a customer, the real cost of buying from these shops is untested product and no legal recourse when something goes wrong.
