The Loudoun County Zoning Ordinance controls what you can build and what activities you can conduct on every parcel of unincorporated land in the county. The Board of Supervisors adopted a wholesale rewrite on December 13, 2023, replacing the Revised 1993 Zoning Ordinance that had governed the county for three decades. If you owned property before that date, your district name almost certainly changed, and the rules that apply to your lot may have changed with it. A small set of properties stayed under older rules: commercially and industrially zoned parcels in the Route 28 Tax District that were administered under the 1972 ordinance still follow it, and applications already in progress in December 2023 may finish under the 1993 rules.1Loudoun County, VA. Finding Your Zoning District
The current ordinance drops the old letter-number system (R-1 through R-24 and the like) in favor of named districts grouped by development intensity.2Loudoun County Zoning Ordinance. The rural districts, Agricultural Rural-1 (AR-1) and Agricultural Rural-2 (AR-2), keep residential density very low to preserve farmland. AR-1 allows one dwelling per 20 acres at base density; AR-2 requires 40.3Loudoun County. Transition districts (Transitional Residential, Transition Small Lot Neighborhood, Transition Compact Neighborhood, and Transition Community Center) bridge rural and suburban areas. Suburban districts (Suburban Neighborhood, Suburban Compact Neighborhood, Town Center, Commercial Center) carry the higher-density housing and retail typical of the eastern county. Urban districts (Transit Related Center and Urban Employment) are the most intense, built around transit and employment centers. Office and industrial districts (Office Park, Industrial Park, General Industry, Mineral Resource – Heavy Industry) separate heavier uses from housing. Two special categories round out the map: the Joint Land Management Area, for coordination with incorporated towns, and Planned Unit Development, a flexible district with standards negotiated during approval.
What You Can Build on Your Lot
Each district carries its own physical development rules covering how big a structure can be, where it can sit, and how much of the lot it can cover.
Setbacks fix the minimum distance from front, side, and rear property lines. They tend to widen in rural districts, where the point is to keep buildings apart. Minimum lot sizes vary just as sharply: an AR-1 parcel needs 20 acres per dwelling at base density, while suburban and transition districts served by public water and sewer can allow lots as small as 10,000 square feet.3Loudoun County. Height limits and lot coverage ratios also apply. Coverage caps the share of your parcel that can be occupied by buildings and impervious surfaces like pavement, which helps the county manage stormwater. The exact numbers depend entirely on your district, so pull the ordinance’s tables for that district before you design anything.
What You Can Do on Your Lot
Every district includes a use table sorting activities into three permission levels.
Uses permitted by right need no public hearing. As long as you meet the development standards, you can proceed. Special exception uses are potentially allowed but require discretionary approval because they could affect neighboring properties; the Board of Supervisors reviews the request and can attach conditions.6Loudoun County Zoning Ordinance. When the Board reviews a special exception, it weighs factors like traffic, noise, and demand on public infrastructure. For residential special exceptions involving affordable housing, state law requires the Board to account for how any conditions it imposes would affect affordability.7Virginia Code Commission. If Your Existing Use No Longer Fits the New District
Because the 2023 rewrite reshuffled districts across the entire county, some uses and structures that were legal before December 13, 2023 no longer match the rules that now apply to their parcel. Virginia law protects these nonconforming (or “grandfathered”) situations, but the protection has conditions. You can keep a nonconforming use going, but if you discontinue it for more than two years, you lose the right to resume it. A stronger protection kicks in when the county itself signed off on the structure. If the county issued a building permit, the building was constructed according to that permit, and a certificate of occupancy was issued, the structure cannot be declared illegal and ordered removed because of a later zoning change. The same shield applies where an owner incurred substantial expense relying in good faith on a building permit, or has paid property taxes on the structure for more than fifteen years.7Virginia Code Commission. If your use might now be nonconforming, verify the status in writing with the Zoning Administrator early. Don’t assume it carries over automatically.
Asking for a Variance
A variance is relief from the physical development standards — a setback, a dimension, a lot rule — not permission for a use the district doesn’t allow. If the shape of your lot, its topography, or some other physical quirk makes strict compliance an exceptional difficulty, you can apply to the Board of Zoning Appeals. Virginia law makes you meet all five of these:
- You acquired the property in good faith and did not create the hardship.
- The variance won’t substantially harm adjacent or nearby properties.
- The condition causing the hardship is unique to your lot, not a widespread problem better handled by amending the ordinance.
- The variance won’t allow a use the district doesn’t permit or change the zoning classification.
- The relief isn’t available through a special exception or another modification process in the ordinance.
Financial hardship alone won’t get you there. The hardship has to come from the land itself, not the cost or inconvenience of complying. That’s where most variance applications fail.7Virginia Code Commission. Code of Virginia – Article 7 Zoning
Rezoning and Proffers
If you need something the current district simply doesn’t allow, the tool is a zoning map amendment (a rezoning). Applications go through Loudoun’s online LandMARC portal, which handles submissions, plan uploads, and tracking.8Loudoun County, VA. LandMARC Land Management Applications Research Coordination A rezoning package normally includes the legal description and parcel identification number, a site or concept plan, and a written justification tied to the Comprehensive Plan. The Department of Planning and Zoning’s legislative review page lists the specific forms.9Loudoun County, VA. 10Loudoun County, VA. Fee Schedules and Payment Options Incomplete submissions come back, and resubmission can add months.
As part of a rezoning, an owner can offer voluntary conditions called proffers: limits below what the new zoning would otherwise allow, land dedications, road improvements, and similar commitments. Proffers must be signed by everyone with an ownership interest and notarized before the Board of Supervisors hearing. Once accepted, they become part of the zoning for that specific property and bind future owners; every later development application must substantially conform, and no county official can approve work that deviates. After administrative review, a rezoning goes to a Planning Commission hearing for public input and a recommendation. The commission is advisory; it prepares the ordinance and map at the governing body’s direction but doesn’t make the final call.13Virginia Code Commission. The Board can also accept amended proffers during its hearing if the changes are more restrictive and don’t materially alter the proposal.11Loudoun County Zoning Ordinance. One factor tends to matter more than any other: whether your proposal is consistent with the 2019 Comprehensive Plan’s vision for that area.14Loudoun County, VA. Loudoun County Comprehensive Plan The plan itself is policy, not law, but the ordinance translates it into enforceable rules, and staff and the Board weigh alignment with the plan heavily.15Loudoun County. Appealing a Zoning Decision
The Board of Zoning Appeals is a separate body from the Board of Supervisors. It hears appeals of the Zoning Administrator’s decisions, decides variance applications, and reviews certain special exception matters such as errors in building location and sign development plans. It also interprets district boundaries on the official map where their location is unclear. It cannot rezone property or move district boundaries; those powers belong to the Board of Supervisors, and BZA provisions are strictly construed.16Loudoun County Zoning Ordinance. If you disagree with a BZA decision, you have 30 days to file a petition for a writ of certiorari with the clerk of the circuit court. The petition must name the governing body, the landowner, and the original applicant as necessary parties. The court can affirm, reverse, or modify the BZA’s decision, but the BZA’s findings are presumed correct, and you have to prove by a preponderance of evidence that the board erred. For special exception appeals, you can also prevail by showing the board applied the wrong legal principles or that the decision was plainly wrong and violated the ordinance’s purpose. Filing the petition does not automatically halt the project; a restraining order requires a separate request and a showing of good cause.17Virginia Code Commission. Federal Limits on What the County Can Do
Some categories of land use sit partly outside the county’s discretion because federal law constrains it.
For wireless facilities, the Telecommunications Act of 1996 bars localities from banning wireless service outright or unreasonably discriminating among providers, requires any denial to be in writing and supported by substantial evidence, and forbids rejecting a facility based on the health effects of radio frequency emissions where it complies with FCC standards. For religious land use, the Religious Land Use and Institutionalized Persons Act (RLUIPA) blocks zoning rules that substantially burden religious exercise unless the county shows a compelling interest pursued through the least restrictive means, and it prohibits treating religious assemblies less favorably than comparable nonreligious ones.19Office of the Law Revision Counsel. 42 U.S. Code Chapter 21C – Protection of Religious Exercise in Land Use and by Institutionalized Persons
For housing accessibility, the Fair Housing Act requires the county to grant reasonable accommodations in zoning rules when necessary to give people with disabilities an equal opportunity to use and enjoy a dwelling. This can mean exceptions to occupancy limits, setbacks, or other standards for group homes and similar facilities, and courts have treated unnecessary delays as a failure to accommodate.
