Louisiana Annulment Time Frame: Null Categories and Filing Rules

The time frame for a Louisiana annulment depends on which kind of nullity you’re claiming. If the marriage is absolutely null, there is no deadline at all: you or any person with a legal interest can ask a court to declare it void at any time. If the marriage is relatively null, the window is short and imprecise: it closes the moment the affected spouse “confirms” the marriage by continuing to live as married after the coercion lifts or mental capacity returns.

Two Categories, Two Very Different Clocks

Louisiana’s Civil Code divides invalid marriages into absolutely null and relatively null. The grounds are different, the people who can file are different, and the deadlines are different.

Absolute nullity covers marriages that were structurally defective from the start: no ceremony, marriage by procuration (a stand-in for a spouse), or a marriage contracted in violation of a legal impediment such as bigamy, prohibited family relationships, or the age restrictions.1Justia. Relative nullity covers marriages where consent existed on paper but was defective. Absolutely Null Marriages: No Deadline

Because an absolutely null marriage was never legally valid, Louisiana law imposes no statute of limitations for challenging it. Banks, insurers, and government agencies will not accept your word that the marriage never counted, so a judgment recognizing the nullity is the document that lets you update records.

Relatively Null Marriages: The Confirmation Clock

Relative nullity is where timing gets urgent. Only the spouse whose consent was compromised can file, and the Civil Code does not set a number of months or years. Confirmation means voluntarily continuing to live as married after regaining free will or mental clarity. Someone who was pressured into marriage but then stays in the relationship for months once the pressure ends will likely lose the right to annul. Someone who was too intoxicated or mentally incapacitated to consent, then keeps living with the other party after understanding what happened, is in the same position.

There is no bright-line cutoff. A court asked whether confirmation occurred will look at how long the affected spouse continued the relationship after the impediment to free consent ended, and what they did during that time. The practical rule is simple: if you believe your consent was coerced or you lacked the capacity to consent, file as soon as the duress lifts or your capacity returns. Delay is the single biggest risk to the claim.

Fraud Is Not a Ground, No Matter How Recent

People often assume they have time to annul because they only recently discovered a spouse lied about something serious. In Louisiana, that discovery date does not open any window, because fraud is not a recognized ground for annulment. The Civil Code’s list is exclusive: lack of ceremony, procuration, an impediment, or a vice of consent.

The Louisiana Supreme Court confirmed this in a 2023 decision, holding that fraud is not a recognized ground for declaring a marriage null under Article 94.7Louisiana Supreme Court. Opinion No. 2022-C-01570 If a spouse deceived you about a criminal record, a child, fertility, or anything comparable, the remedy is divorce. No annulment deadline applies because no annulment is available.

Filing Before the Window Closes

Once you know which category applies, the mechanics are straightforward. File a petition in the district court of the parish where either spouse lives. The petition must identify the grounds for nullity and lay out the facts supporting them. The other spouse is formally served and can respond.

If both parties agree the marriage should be declared null, the case can often be resolved in a single hearing. If it is contested, the petitioner carries the full burden of proof. For absolute nullity, that means proving no ceremony occurred, the marriage was by procuration, or an impediment existed. For relative nullity, the petitioner must prove both that consent was defective and that they never confirmed the marriage afterward. The second half is often the harder half.

Why Filing Timing Still Matters Even Without a Statutory Deadline

Absolute nullity has no deadline, but waiting can still cost you.

The putative spouse doctrine in Article 96 protects a spouse who entered the marriage in good faith, letting them keep the civil effects of marriage (including community property protections) as though it had been valid. In bigamy cases, that good-faith protection continues until the marriage is formally declared null or the good-faith spouse enters a valid new marriage.8Justia. Federal taxes create a second timing pressure. Immigration adds a third clock. The Civil Code gives you unlimited time for absolute nullity and a short, confirmation-driven window for relative nullity.
