A Louisiana firefighter in the statewide Firefighters’ Retirement System can draw a full, unreduced pension at any age with 25 years of service, at age 50 with 20 years, or at age 55 with 12 years. The monthly benefit is the product of three numbers: an accrual rate set by your hire date, your average final compensation, and your total years of creditable service.1Firefighters’ Retirement System. Frequently Asked Questions Everything else — DROP, disability, survivor benefits, COLAs, taxes — layers on top of that basic structure.
Who Is Covered by FRS
The Firefighters’ Retirement System (FRS) is the statewide defined-benefit plan covering most of Louisiana’s full-time firefighters. It has operated since January 1, 1980 and is one of nine statewide pension systems in the state.2Firefighters’ Retirement System of Louisiana. About Firefighters’ Retirement Systems of Louisiana
Not every firefighter in Louisiana is in FRS. Some older municipal fire departments — Alexandria, Baton Rouge, and Monroe among them — run their own locally administered pension funds under separate Title 11 statutes, with different contribution rates and different benefit formulas.3Justia. Louisiana Revised Statutes 11:3113 – Pensions and Benefits If you work for one of those departments, the rules below are not your rules. Check with your department’s pension administrator.
When You Can Retire
FRS members qualify for a full, unreduced retirement benefit under any one of these three combinations:1Firefighters’ Retirement System. Frequently Asked Questions
- 25 years of creditable service at any age
- 20 years of service and at least age 50
- 12 years of service and at least age 55
The 12-year option is the minimum-service path, and while it works, the smaller service total produces a much smaller monthly check. Most firefighters aim for one of the first two thresholds.
If you leave FRS-covered work before qualifying but have at least 12 years of service, you are vested. You keep the right to collect a benefit when you reach the qualifying age. Leave with fewer than 12 years and the pension is gone, though you can request a refund of your own contributions.
How Your Pension Is Calculated
The formula is accrual rate × average final compensation × years of service. The accrual rate is the piece that varies most, and it depends on when you were hired.
Accrual Rates
Firefighters hired on or before December 31, 2014 use a tiered rate: 2.5% for each of the first 12 years, then 3⅓% for each year after that, once you either reach age 50 with more than 12 years of service or hit 30 years at any age. Stay long enough and the higher rate effectively applies to all years worked.4Louisiana Legislature. House Bill No. 33 – Firefighters Retirement Benefit Computation A firefighter in this tier with 25 years of service and a $60,000 AFC can end up around $50,000 a year.
Firefighters hired between January 1, 2015 and August 14, 2016 earn a flat 2.75% per year of service. Those hired on or after August 15, 2016 earn a flat 2.5% per year.4Louisiana Legislature. House Bill No. 33 – Firefighters Retirement Benefit Computation No matter which tier you fall into, the total benefit cannot exceed 100% of your average compensation.
Average Final Compensation
Your average final compensation (AFC) is the average of your highest-paid consecutive months. Hired on or before December 31, 2016? FRS uses your best 36 months. Hired on or after January 1, 2017? The window widens to your best 60 months.5Louisiana Legislature. Digest SB 3 – Average Final Compensation The longer 60-month window tends to produce a lower AFC because it smooths out the overtime spikes that would otherwise carry your peak years.
DROP: Working While Your Pension Accumulates
The Deferred Retirement Option Plan (DROP) lets you lock in your pension calculation, keep working, keep collecting your regular salary, and have your monthly pension payments accumulate in a separate account. You get the lump sum when you actually leave the department.
To enter DROP you need at least 20 years of creditable service and must already be eligible for a service retirement allowance.6Louisiana State Legislature. RS 11:2257 – Deferred Retirement Option Plan How long you can stay in DROP depends on your service: three years with fewer than 30 years of credit, five years with 30 or more.7Louisiana Legislature. House Bill No. 67 – DROP Duration
Money in the DROP account earns interest. Accounts with a begin date on or after July 1, 2023 earn 4% annually, compounded monthly. Accounts opened between July 1, 2011 and June 30, 2023 earn 1.3%. Your pension figure is frozen at the level calculated on your DROP entry date, so raises during DROP do not increase the deposits, and the service years worked during DROP do not push your pension higher after you exit.
Disability Retirement
Firefighters who become totally and permanently unable to perform their duties can apply for disability retirement without meeting the standard age and service thresholds. Applications go through the State Medical Disability Board, which reviews records, conducts examinations, and sends findings to the FRS Board of Trustees, which then makes the call.8Justia. Louisiana Revised Statutes 11:219 – State Medical Disability Board
Service-connected disabilities generally produce a better benefit than non-service-connected ones. In either case, the payment is typically the greater of a minimum percentage of final average compensation or the retirement benefit you had already accrued. Build the medical record early and thoroughly; thin documentation is what stalls or sinks these claims.
Survivor Benefits
If a firefighter dies in active service or after meeting certain service thresholds, FRS pays ongoing monthly benefits to eligible survivors:9Louisiana State Legislature. Louisiana Code RS 11:1151 – Survivor Benefits Members Hired on or Before June 30, 2010
- Surviving spouse with minor children: 75% of the deceased’s average monthly compensation, or $300, whichever is greater. One-third goes to the spouse, two-thirds to the children.
- Minor children without a surviving spouse: the same 75% or $300 floor, paid to whoever has legal custody.
- Surviving spouse without minor children: 50% or $200, whichever is greater. This requires at least 10 years of service (with 2 immediately before death) or 20 or more years total, plus a marriage of at least two years before death.
Children’s benefits end at 18 or upon marriage, extend to age 23 for full-time students, and can continue indefinitely for children with a total and permanent physical or mental disability.
Cost-of-Living Adjustments
FRS retirees can get raises through two separate channels. The automatic annual COLA is tied to your retirement anniversary date, and you qualify once you are at least 55 and have been retired for at least a year. Retire before 55 and your first automatic COLA arrives on the first anniversary after you turn 55.10Firefighters’ Retirement System. Annual Cost of Living Option Form
The second channel is a legislative COLA, which the legislature can grant during a regular session. The FRS Board can also grant one in years the legislature doesn’t act, after that session adjourns. If the legislature grants an increase, the Board cannot add another unless the bill specifically allows it.11Louisiana State Legislature. Louisiana Code RS 11:243 – Cost-of-Living Adjustments Permanent Benefit Increases Restrictions Funding Criteria Legislative COLAs are not frequent, which is why the automatic COLA is the more reliable source of inflation protection.
Taxes and Social Security
Louisiana exempts FRS retirement benefits from state income tax entirely. That covers monthly pension payments, lump-sum distributions, and refunds of your own contributions.12Justia. Louisiana Revised Statutes 11:3292.1 – Exemption From State Income Tax Federal income tax still applies.
Retired public safety officers can also exclude up to $3,000 per year of federal taxable income for health or long-term care insurance premiums, provided the premiums are deducted directly from your pension distribution.13Internal Revenue Service. Publication 575 – Pension and Annuity Income Paying out of pocket and claiming a separate deduction is a different process.
The bigger recent change concerns Social Security. Because FRS-covered work is not covered by Social Security, firefighters who also worked in Social Security-covered jobs used to lose part of their Social Security check to the Windfall Elimination Provision and, for spouses, the Government Pension Offset. Both were repealed by the Social Security Fairness Act, signed on January 5, 2025. The Social Security Administration began adjusting payments on February 25, 2025, with retroactive increases dating back to January 2024.14Social Security Administration. Social Security Fairness Act – Windfall Elimination Provision and Government Pension Offset If you have Social Security credits alongside your FRS pension, your check should now reflect the full amount you earned.
Buying Service Credit to Retire Sooner
If you have gaps in your career or prior military service, you can buy additional credit toward FRS eligibility. Louisiana law lets any FRS member purchase up to four years of credit for regular or nonregular military service by filing an application with proof of service dates and paying the actuarially determined cost.15Justia. Louisiana Revised Statutes 11:153 – Purchase of Service Credit for Military Service Other purchases of qualifying service credit are priced under a separate statute based on actuarial factors like your age and salary at the time of purchase.16Justia. Louisiana Code RS 11:158 – Purchase of Service Credit in Public Retirement Systems Price The cost can be substantial. Ask FRS for the number in writing before you commit.
Pending Change: HB 33
House Bill 33, filed by Representative Mandie Landry, would remove the lower accrual rates for firefighters hired after 2014 and extend the original tiered structure — 2.5% for the first 12 years, then 3⅓% thereafter — to every FRS member.4Louisiana Legislature. House Bill No. 33 – Firefighters Retirement Benefit Computation The bill remains pending in the House Retirement Committee and has not been voted on by the full legislature. Firefighters hired in 2015 or later would see a meaningful benefit increase if it becomes law, so it is worth tracking.
Separately, House Bill 18, which passed both chambers during the 2025 regular session, grants a one-time $2,000 lump-sum payment to eligible FRS retirees and beneficiaries and removes the previous prohibition on paying cost-of-living increases from the system’s funding deposit account.17Louisiana Legislature.
