Opening a group home in Louisiana means obtaining a license from the Louisiana Department of Health (LDH) through its Health Standards Section, and the Louisiana group home licensing requirements you must meet depend entirely on which category of provider you plan to be. The state does not issue a single “group home” license. It licenses Home and Community-Based Services (HCBS) providers, Adult Residential Care Providers (ARCPs) at four distinct levels, and Therapeutic Group Homes (TGHs) for children and youth, each under its own chapter of Title 48 of the Louisiana Administrative Code.1Louisiana Department of Health. Health Standards Section Pick the wrong category and the rest of your preparation is wasted.
Which License Category Fits Your Plan
The population you intend to serve and the number of beds you plan to offer dictate the license. ARCPs break into four levels based on size and services:
- Level 1 serves two to eight unrelated adults in a single-family dwelling.
- Level 2 is a congregate setting for nine to sixteen residents without independent apartments.
- Level 3 serves seventeen or more residents in independent apartments with kitchenettes.
- Level 4 matches Level 3 but adds intermittent nursing services.
Across all four levels, services include lodging, meals, medication administration, help with personal hygiene and dressing, housekeeping, and laundry.2Louisiana Department of Health. Adult Residential Care Provider (ARCP) HCBS community living providers operate under a separate framework for adults with disabilities receiving waiver services.3Louisiana Department of Health. Home and Community Based Service Providers (HCBS) Therapeutic Group Homes, governed by Chapter 62, serve children and youth with behavioral health needs and carry the strictest leadership and staffing requirements of any category.
Physical Space the Building Must Provide
Room-by-room minimums live in Title 48 and vary by license type.
HCBS Community Living
Each separate bedroom must have at least 100 net square feet, excluding bathrooms and closets. A bedroom shared by two people must have at least 200 net square feet, both residents must agree in writing to share, and no bedroom may house more than two people. Efficiency and studio apartments need at least 250 net square feet of floor space. Homes or apartments with separate bedrooms need a living area of at least 190 net square feet, plus 60 net square feet of common space.4Legal Information Institute. Louisiana Administrative Code tit. 48, I-8789 – Community Living
Bathrooms may be shared by no more than four people. Each needs a toilet, sink, and shower or tub with hot and cold running water, plus functional aides for residents who need them. Grab bars go in showers and bathing areas whenever a resident’s needs call for them. A bathroom that opens only into a bedroom belongs to the occupants of that bedroom alone.4Legal Information Institute. Louisiana Administrative Code tit. 48, I-8789 – Community Living
Adult Residential Care Providers
Levels 1 and 2 require at least 100 net square feet for a single-occupancy bedroom and at least 70 net square feet per resident in a shared bedroom, excluding bathrooms and closets. Levels 3 and 4 house residents in apartments: efficiency units need at least 200 net square feet, and apartments with separate bedrooms require a minimum of 100 square feet per bedroom plus at least 190 square feet of living space.5Legal Information Institute. Louisiana Administrative Code tit. 48, I-6891 – Resident Personal Space
Fire Marshal and Accessibility Sign-Offs
No group home opens without passing inspection by the Office of State Fire Marshal. The fire marshal has statutory authority over construction and maintenance of exits and emergency lighting, heating and ventilation, and inspection of structures to reduce fire hazards.6Louisiana State Legislature. Louisiana Code 40:1563 – Powers and Duties Generally Owners must arrange at least an annual inspection and certification of all life safety systems, including fire sprinklers, fire alarms, suppression systems, portable extinguishers, and special locking equipment.7Justia Law. Louisiana Code RS 40:1646 – State Fire Marshal; Life Safety Systems and Equipment Inspections A current fire marshal report has to be on file at every license renewal.
ADA accessibility applies as well. Specific accommodations depend on the building and the residents, but common requirements include accessible entrances, appropriately sized doorways, non-skid surfaces in bathing areas, and grab bars where resident needs call for them.4Legal Information Institute. Staffing, Background Checks, and Training
Who You Can Hire
Before offering a job to any nonlicensed person who will provide care, health-related services, or supportive assistance, the employer must request a criminal history and security check through the Louisiana State Police. The fee is twenty-six dollars per applicant, and State Police return results in writing within thirty days. The applicant must be told in writing that the check is required and must give written permission before records are pulled.8Justia Law. Louisiana Revised Statutes RS 40:1203.2 – Criminal History and Security Checks
Most LDH-licensed providers must also check both the state nurse aide registry and the direct service worker registry. A listing on either for substantiated abuse, neglect, or theft disqualifies the person from employment.9Louisiana Department of Health. DSW Registry
Administrator Qualifications
Running an HCBS facility takes more than a high school diploma. The administrator must be a Louisiana resident with a high school diploma or equivalent and must meet one of three experience tracks:
- A bachelor’s degree plus at least four years working with elderly or developmentally disabled populations.
- At least six years in a health or social service business plus four additional years serving those populations.
- Current registration as a licensed nurse in good standing with at least two years of relevant care experience.10Legal Information Institute. Louisiana Administrative Code tit. 48, I-5055 – Core Staffing Requirements
Therapeutic Group Homes raise the bar further and require a clinical director who holds a license as a mental health professional.
Training and Ratios
Every direct care employee must complete at least 16 hours of training on hire and before providing any care. The curriculum covers internal policies, emergency and safety procedures, recognizing and responding to medical emergencies (including when to call 911 and how to support a resident until help arrives), client rights, and detecting and reporting suspected abuse and neglect.10Legal Information Institute. Louisiana Administrative Code tit. 48, I-5055 – Core Staffing Requirements Completion records go in each employee’s personnel file.
Ratios depend on license type. Therapeutic Group Homes must maintain at least one staff member for every five residents at all times, with a minimum of two staff on duty per shift in each living unit, and at least one staff member must stay awake overnight.11Legal Information Institute. Louisiana Administrative Code tit. 48, I-6247 – Staffing Requirements HCBS and ARCP ratios live in their own chapters of the code and scale to acuity and resident count.
Resident Rights You Must Honor
Any group home that takes Medicaid waiver funding has to comply with the federal HCBS Settings Rule. Residents get the same protections from eviction that Louisiana tenants receive, secured by a lease or other legally enforceable agreement. Each resident must be able to lock the door to their sleeping or living unit, with only appropriate staff holding keys. Shared-unit residents must have a choice of roommates and may furnish and decorate their space within the terms of their agreement.12eCFR. 42 CFR 441.301 – Contents of Request for a Waiver
Residents also control their own schedules, have access to food at any time, and receive visitors of their choosing at any time. The setting must support full access to the greater community, including opportunities for employment in competitive integrated settings. A person-centered service plan, directed by the individual to the maximum extent of their capacity, guides all services. Providers that regiment daily life, restrict visitors, or limit community access risk losing Medicaid certification.12eCFR. 42 CFR 441.301 – Contents of Request for a Waiver
Zoning Pushback and the Fair Housing Act
Local zoning is where many first-time operators get stuck, and knowing your protections before you sign a lease can save months. The federal Fair Housing Act prevents cities and parishes from using zoning to block or restrict group homes for people with disabilities. A local government cannot prohibit group homes in residential districts where similar housing is allowed, cannot require special spacing between group homes, and cannot impose extra procedural hurdles that do not apply to other residences. Neighbors’ fears about a particular disability are not a lawful basis for denial.13U.S. Department of Justice. Group Homes, Local Land Use, and the Fair Housing Act
Local governments must also make reasonable accommodations in land-use and zoning policies when necessary to give people with disabilities equal access to housing. An accommodation is reasonable unless it imposes an undue financial or administrative burden on the government or fundamentally alters the zoning scheme.13U.S. Department of Justice. Group Homes, Local Land Use, and the Fair Housing Act
Financial Viability and Insurance
LDH checks financial viability at initial application and at every renewal. For Therapeutic Group Homes, that means documentation of a line of credit from a federally insured lending institution of at least $50,000, general and professional liability insurance of at least $300,000, and workers’ compensation insurance.14Louisiana Department of Health. Therapeutic Group Homes Other provider types have their own thresholds under their respective chapters. The point is identical across categories: the state wants evidence you can keep the doors open and cover claims if something goes wrong.
Applying for the License
Documentation to Gather First
Form your legal business entity through the Louisiana Secretary of State and then obtain a federal Employer Identification Number from the IRS; doing it in the opposite order causes delays.15Internal Revenue Service. Get an Employer Identification Number A nonprofit organization must be organized and operated exclusively for exempt purposes under Section 501(c)(3), with no net earnings benefiting any private individual.16Internal Revenue Service. Exemption Requirements – 501(c)(3) Organizations
Complete an ownership disclosure form listing every individual or entity with a 5 percent or greater interest, including shareholders, partners, and subcontractors with delegated management responsibilities.17Louisiana Department of Health. Entity/Business Disclosure of Ownership A professional floor plan showing the dimensions and intended use of every room, along with proof of financial viability, rounds out the package.
Mandatory Training, Fees, and Submission
HCBS applicants have to review the licensing regulations and complete mandatory regulatory training videos posted on the LDH website. Only after submitting certificates of completion will the department authorize an initial licensing survey.3Louisiana Department of Health. Home and Community Based Service Providers (HCBS) Many first-time applicants skip this step and stall before desk review.
The initial HCBS licensing fee is $600, with additional charges of $200 for Adult Day Care and $200 to $250 for Community-Based Residential services depending on the module.18Louisiana Department of Health. Health Standards Section Licensing Fees – Waiver Programs Pay by certified check or money order payable to the Louisiana Department of Health. The completed package goes to the Health Standards Section for a desk review that confirms every required document is present before an on-site survey is scheduled.
The Licensing Survey
Once your paperwork clears the desk review, the state schedules an announced on-site inspection. Inspectors walk the property to verify that bedroom dimensions, bathroom configurations, fire safety systems, and accessibility features match the floor plan, and they review written policies and procedures against the applicable chapter of the administrative code.19Legal Information Institute. Louisiana Administrative Code tit. 48, I-5619 – Licensing Surveys You cannot serve any residents until the survey is complete and the provider is found in compliance. After the initial license issues, the department conducts periodic unannounced surveys that often focus on staffing records, training documentation, and resident-rights compliance rather than the building.
Medicaid Enrollment Is a Separate Step
State licensure and Medicaid enrollment are two different processes. After the license issues, you must separately enroll as a Medicaid provider to serve residents funded through Medicaid waivers. Enrollment requires both a basic enrollment packet and the provider-type-specific packet from the Louisiana Medicaid site, submitted together as a single application. A valid National Provider Identifier is required, and incomplete submissions are returned.20Louisiana Medicaid. Provider Enrollment – New Enrollments Because Medicaid funds most group home residents in Louisiana, treating enrollment as an afterthought can leave you licensed but unable to bill for months.
Keeping the License
Louisiana group home licenses renew annually. The renewal application packet must reach LDH at least 30 days before the current license expires. Miss that date and you lose the license by default under voluntary non-renewal. The packet must include a completed application form, the renewal fee, a current State Fire Marshal report, a current Office of Public Health inspection report, and updated proof of financial viability.14Louisiana Department of Health. Therapeutic Group Homes
LDH can impose civil monetary penalties and can suspend, revoke, or decline to renew a license when a provider violates licensing standards. A pending revocation or suspension at renewal time means outright denial, and renewal does not erase any sanction already imposed.14Louisiana Department of Health. Therapeutic Group Homes Build your calendar backward from the expiration date and treat the 30-day window as the latest acceptable filing date, not the target.
