Maine Hunter Orange Requirements: Exemptions, Penalties & Common Mistakes

To hunt legally in Maine during the firearms deer season, you must wear two articles of hunter orange clothing: a solid hunter orange hat and a torso-covering garment, like a jacket, vest, coat, or poncho, that is at least 50% hunter orange. Both articles must be in good condition and visible from all sides. The Maine hunter orange requirements apply to anyone hunting with a firearm or crossbow during that season, with a few specific exemptions covered below.1Maine State Legislature. The Two-Article Rule in Detail

Title 12, Section 11203 of the Maine Revised Statutes sets out the requirement. The hat has to be solid-colored hunter orange. The second article has to cover a major portion of your torso and be at least half hunter orange by surface area.1Maine State Legislature. Maine Code Title 12 – Hunter Orange Clothing

A small decal or logo on an otherwise solid orange garment is fine and does not disqualify it. What does matter is visibility from every angle. A hunter orange vest hidden under an outer jacket, pack, or shoulder straps doesn’t satisfy the law, and a worn or heavily faded garment can also put you out of compliance.

What Counts as Hunter Orange

Maine doesn’t accept any shade of orange. The statute defines hunter orange as a daylight fluorescent orange with a dominant wavelength between 595 and 605 nanometers, an excitation purity of at least 85%, and a luminance factor of at least 40%.2Maine State Legislature. Maine Code Title 12 – Definitions In practical terms, that is the high-visibility blaze orange sold for hunting. A regular orange flannel or a burnt-orange sweatshirt will not qualify.

Camouflage patterns with orange accents generally fail the 50% torso rule unless the orange genuinely covers at least half the visible surface. If you want certainty, pull a solid orange vest over your other layers.

When the Rule Applies

The two-article requirement is tied to the open firearms season on deer. For 2025-26, that season runs November 3 through November 29 and includes the muzzleloader portion.3Legal Information Institute. 09-137 CMR ch 16 04 – Hunter Orange Requirements for Hunting of Wild Birds and Wild Animals Youth deer days, October 24-25 for the 2025-26 season, carry the same requirements because all standard deer hunting laws apply.

Moose Hunting

If you’re hunting moose with a firearm or crossbow during the regular moose season, the rule is lighter: one article of solid hunter orange, visible from all sides. But if your moose hunt falls on dates that overlap with the firearms deer season in your Wildlife Management District, the full two-article rule applies.3Legal Information Institute. 09-137 CMR ch 16 04 – Hunter Orange Requirements for Hunting of Wild Birds and Wild Animals Check the season dates for the WMD on your permit before you head out.

Archery

Hunter orange is not legally required if you’re hunting with a bow and arrow, because the statute attaches the mandate to firearms and crossbows. The Maine Department of Inland Fisheries and Wildlife still recommends that archery hunters wear at least one article of orange when moving through the woods, particularly during overlapping firearms seasons.4Maine Department of Inland Fisheries & Wildlife. Laws Pertaining to Hunting Equipment A bowhunter in full camouflage is effectively invisible to anyone with a rifle in the same woods.

Exemptions

Two exemptions exist in the statute.

Waterfowl hunters are not required to wear hunter orange when hunting from a boat, from a blind, or in conjunction with decoys. The nature of waterfowl hunting makes blaze orange counterproductive.1Maine State Legislature. Maine Code Title 12 – Hunter Orange Clothing

If you have a religious objection to wearing hunter orange, you may substitute bright red for both required articles. Red is the only alternative color permitted, and the exemption does not drop the two-article structure: you still need a hat and a torso garment, just in bright red.1Maine State Legislature. Penalties

A first violation is a civil infraction with a fine between $100 and $500.1Maine State Legislature. Maine Code Title 12 – Hunter Orange Clothing5Maine State Legislature. Maine also belongs to the Interstate Wildlife Violator Compact, an agreement among 47 states that recognizes hunting, fishing, and trapping license suspensions across state lines.7Maine Department of Inland Fisheries & Wildlife. Hunting License Information A suspension in Maine can follow you to every other compact state, and an unpaid citation alone can block license purchases elsewhere. If you hunt in more than one state, even a minor orange violation can carry outsized consequences.

Mistakes That Get People Cited

A few patterns come up again and again. The most common is thinking a blaze orange cap by itself is enough. It isn’t; the torso garment is a separate requirement. The second is wearing an orange vest under a jacket or beneath pack straps that break up its visibility, which fails the “visible from all sides” test.

Hunters who switch weapons mid-day sometimes trip over the rule as well. The orange requirement follows the weapon and the season, not the hour: if you shoulder a rifle or crossbow after a morning of bowhunting during firearms deer season, the two articles have to go on first. The same applies if you’re accompanying a young hunter on youth deer day. Standard deer hunting laws apply, so the youth needs the hat and the torso garment too.
