Maine septic system rules are set out in 10-144 CMR Chapter 241 and administered by the Subsurface Wastewater Unit within the Maine Department of Health and Human Services.1Maine Center for Disease Control & Prevention. Subsurface Wastewater Unit The rules control where a system can be placed, how large it must be, who can design and install it, when it must be inspected, and what happens if any of that is skipped. If you are building, replacing a failed system, or buying near the water, the same rulebook decides what you can do and what it will cost.
Setback Distances From Wells, Water, and Buildings
Every part of a septic system must sit a minimum distance from wells, water bodies, buildings, and property lines. For first-time installations, Table 7B of the rules governs. A disposal field serving less than 1,000 gallons per day must stay at least 100 feet from a private drinking-water well. The other first-time distances for a disposal field under 1,000 gallons per day are:
- 100 feet from major water bodies
- 50 feet from minor water bodies
- 20 feet from a full-basement dwelling
- 15 feet from a slab-on-grade or post-foundation dwelling
- 10 feet from a property line

Reduced Setbacks for Replacement Systems
Older lots often cannot fit the first-time distances. Table 8A lets the Local Plumbing Inspector approve tighter setbacks for a replacement system. The disposal-field distance to a major water body can drop to 50 feet, the property-line separation to 5 feet, and the full-basement setback to 10 feet.3Maine Center for Disease Control & Prevention. The well-to-disposal-field distance has its own schedule. Table 7A ties the reduction to how deep the well casing is sealed. A casing sealed deeper than 86 feet allows the setback to fall from 100 feet to 60 feet. A casing between 40 and 55 feet deep only brings the setback down to 90 feet.4Maine Center for Disease Control & Prevention. Subsurface Wastewater Disposal Rules – Table 7A When even the Table 8A replacement distances cannot be met, the Department of Health and Human Services can authorize a further reduction case by case, but only if no practical alternative exists.
How Maine Sizes a Septic System
System size is based on bedrooms, not occupants. Table 4A assigns a daily design flow to each dwelling:
- Two bedrooms or fewer: 180 gallons per day
- Three bedrooms: 270 gallons per day
- Four bedrooms: 360 gallons per day
- Five bedrooms: 450 gallons per day
- Each additional bedroom: add 90 gallons per day
An in-law apartment adds 120 gallons per day regardless of size.5Maine Center for Disease Control & Prevention. Subsurface Wastewater Disposal Rules – Table 4A Those flow figures drive the disposal field area, the distribution piping, and the required tank capacity.
Minimum Tank Capacity
One- or two-bedroom homes need at least 750 gallons of liquid capacity. Three- and four-bedroom homes require 1,000 gallons. Five bedrooms bring the minimum to 1,250 gallons, and each bedroom beyond that adds 250 gallons. No individual tank may hold less than 750 gallons.6Maine Center for Disease Control & Prevention. Subsurface Wastewater Disposal Rules – Table 6A Two or more tanks can be connected in series to reach the required capacity, as long as each successive tank is at least as large as the one before it.
The HHE-200 Permit Application
Every new or replacement system requires a permit, and the process starts with the HHE-200 form, the Subsurface Wastewater Disposal System Application. A licensed site evaluator prepares it for non-engineered systems, and a professional engineer prepares it for engineered ones. The site evaluator digs test pits to examine soil layers, texture, drainage, and the seasonal high-water table. Those observations decide whether the soil can treat wastewater and dictate the type and size of the disposal field. The evaluator then produces a site plan showing every component in relation to buildings, wells, water bodies, and property lines, with elevations and groundwater flow direction. Permit Fees
The applicant submits the completed HHE-200 to the Local Plumbing Inspector and pays the state-scheduled fee. For a complete non-engineered residential system, the fee is $250 plus a $15 water quality surcharge. Other permit types are cheaper:
- Holding tank: $100 plus $15 water quality surcharge
- Non-engineered disposal field only: $150
- Complete engineered system: $200
- Alternative toilet: $50
- Separated laundry system: $35 plus $15 water quality surcharge

Local Plumbing Inspector Review Timeline
If the application is incomplete or does not conform to the rules, the LPI must reject it in writing within 14 days and state the reasons. If it conforms, the LPI must issue the permit as soon as practicable and no later than 20 days from completing the review.9Legal Information Institute. When You Need a Variance: The HHE-204
When site conditions make it impossible to meet the standard rules, the HHE-204 variance request form is filed alongside the HHE-200 as part of a single application package, with complete plans for the proposed system.
First-time-system variances use a point-scoring system. A property within 250 feet of a major water body (the shoreland zone) or inside a regulated subdivision must score at least 65 points. Elsewhere the minimum is 50. Enlarging the disposal area, adding fill, and similar measures earn points. Designs that cannot reach the threshold will not be approved. Most variances are approved locally by the LPI. When the request exceeds the LPI’s authority, typically because the setback reduction goes beyond Table 8A, the application moves to DHHS. The LPI must still sign the variance request forms before they reach the state.10Maine Center for Disease Control & Prevention. Inspections During Installation
A permitted system must pass two inspections: one before installation begins and one before the trench is backfilled.7Maine Center for Disease Control & Prevention. Subsurface Wastewater System Permitting The installer must give the LPI at least 24 hours’ notice before each inspection. During backfill inspection, the LPI verifies that the tank, distribution components, and disposal field sit at the correct elevations and match the approved HHE-200 plan. If anything deviates, the LPI can halt work and require corrections before the system is covered. Once the installation checks out, the LPI issues a Certificate of Approval, the final legal sign-off that the system is safe to operate.

Selling a Home With a Septic System
Maine law sets specific disclosure and inspection duties for property sales. Under Title 33, §173, the seller must disclose the type of system and tank, the tank’s location and size, the leach field’s location, any malfunctions of either the tank or leach field, installation dates, the most recent service date, and the name of the service contractor.11Maine State Legislature. Mandatory Inspection for Shoreland Property
For property within a shoreland area (generally within 250 feet of a major water body, river, or wetland), the seller must provide a written statement about whether the system has malfunctioned during the 180 days before transfer, and the buyer must have the system inspected by a certified professional before purchase. If weather makes a pre-closing inspection impossible, the buyer has nine months after the transfer to complete it. If the inspection reveals a malfunction, the system must be repaired or replaced within one year of the transfer.12Maine State Legislature. Maine Title 30-A 4216 – Transfers of Shoreland Property

Extra Restrictions in the Shoreland Zone
Properties within the shoreland zone carry rules on top of the standard setback tables. Holding tanks are not permitted as a first-time residential waste disposal solution in the shoreland zone. Clearing of woody vegetation for a new system cannot extend closer than 75 feet from the shoreline. Converting a seasonal dwelling in the shoreland zone to a year-round home generally requires a seasonal conversion permit from the LPI, with a $50 state fee.7Maine Center for Disease Control & Prevention. Penalties for Working Without a Permit or Off-Design
Installing or operating a septic system without a permit, or in violation of the approved design, brings civil penalties under Title 30-A, §4452. Starting construction without a required permit draws a fine between $100 and $2,500 per day. Other specific violations run from $100 to $5,000 per day. Courts can also order the violator to correct or remove the non-compliant system. Where a violation is willful, corrective action is mandatory unless it would create a health hazard or environmental damage worse than the violation itself. If the economic benefit of cutting corners exceeds the penalty, the court can double the fine to twice the benefit gained. Ongoing Maintenance Rules
Maine does not impose a general state-mandated pumping schedule for standard septic tanks. The EPA recommends a professional inspection at least every three years and pumping every three to five years, with frequency turning on household size, wastewater volume, solids in the wastewater, and tank capacity.14US EPA. Holding tanks are treated differently. Every holding tank must be pumped at least once per year if the system was used at all during that year. The owner must keep pumping records, water-use records, and the current pumper agreement for three years and make them available to the LPI on request.15Justia Law. Maine Code 10-144 CMR 241 8
Systems with electrical components such as float switches, pumps, or aerobic treatment units need annual inspections. Keep the area over the disposal field planted with grass or shallow-rooted ground cover. Help Paying for a Replacement
Replacing a failed system can run into the thousands. The USDA Section 504 program offers low-interest loans and grants for home repairs, including septic replacement, to homeowners in eligible rural areas whose income falls below the very-low-income limit for their county. Grants are limited to owners aged 62 or older, capped at $10,000 in a lifetime, and repayable if the property is sold within three years.17U.S. Department of Agriculture (USDA) Rural Development. The EPA’s Clean Water State Revolving Fund gives states money to run low-interest loan programs for water infrastructure, including septic upgrades and repairs.18US EPA. Funding for Septic Systems Maine’s CWSRF previously partnered with the Maine State Housing Authority on residential septic repairs, but that specific program has been inactive since 2016.
