Several exemptions, a cap on the county portion, and a few recent law changes shape what you actually pay at the register or collect as a seller.
How the 7% Rate Is Built
The 6% state rate comes from Florida Statute 212.05 and covers retail sales of tangible personal property, certain services, and other taxable transactions.1Florida Legislature. Discretionary Sales Surtax Information for Calendar Year 2026 The county portion is actually two separate half-percent levies, one running through 2032 and the other through 2031, but for a buyer they combine into a single extra cent on the dollar.
The $5,000 Cap on the County Surtax
The 1% county surtax only applies to the first $5,000 of any single item of tangible personal property. Buy a piece of equipment for $8,000 and the surtax adds $50 (1% of $5,000), while the full 6% state tax still applies to the entire $8,000. Items normally sold together as a working unit count as a single item for the threshold.3Florida Legislature. What Gets Taxed
Florida Chapter 212 starts from a broad rule: every retail sale of tangible personal property is taxable unless a specific exemption applies.4Florida Department of Revenue. Florida Sales and Use Tax Furniture, electronics, clothing, appliances, and building materials all fall in. Beyond physical goods, a handful of service categories are also taxable.
Short-Term Lodging
Rentals of living or sleeping accommodations for six months or less are subject to the full 7% sales tax.5Florida Department of Revenue. On top of that 7%, Manatee County levies a 6% tourist development tax, bringing the total on a short stay to 13%. The tourist development tax is remitted to the Manatee County Tax Collector rather than the Florida Department of Revenue, so operators register and file with both agencies.
Admissions
Tickets and entry fees for entertainment venues, sporting events, concerts, and recreational activities are taxable at the point of sale.6Florida Department of Revenue. Florida Administrative Code 12A-1.005 – Admissions For stadium, theater, and similar venue events, the tax is due to the Department on the first day of the month after the event and becomes delinquent on the 21st of that month.
Taxable Services
Florida taxes a narrow list of services. Nonresidential cleaning work — janitorial, office cleaning, floor waxing, and window cleaning of commercial building interiors — is subject to the 7% rate.7Legal Information Institute. Commercial Rent: No Longer Taxed
Florida used to tax commercial real property leases at 2% state plus the county surtax. That tax was repealed effective October 1, 2025.9Florida Department of Revenue. The repeal does not affect transient rentals, parking garages, boat dock fees, or aircraft tie-down charges. Those categories remain taxable.
What’s Exempt
Several everyday categories fall outside the 7% rate.
- Groceries. Food products for human consumption — milk, bread, produce, meat, cereals, canned goods — are exempt. Prepared foods sold for immediate consumption, like restaurant meals, are still taxed.10Florida Senate. - Prescription drugs and medical supplies. Prescription medications are exempt, as are prosthetic and orthopedic devices dispensed on a licensed practitioner’s order. - Purchases for resale. Goods bought for resale rather than personal use aren’t taxed if the buyer provides a valid Florida Annual Resale Certificate. - Exempt organizations. Qualifying nonprofits and government entities — counties, municipalities, school districts, and certain charitable, religious, and educational institutions — can buy tax-free using a Consumer’s Certificate of Exemption (Form DR-14). The organization must pay with its own funds; if an employee pays personally and gets reimbursed, the purchase is taxable.13Florida Department of Revenue. Sales Tax Exemption Certificates
Sellers who accept a fraudulent or expired resale or exemption certificate can be held liable for the uncollected tax on audit, so keep copies of every certificate you rely on.
Florida also enacts sales tax holidays that suspend tax on certain purchases for a limited window. Recent years have included a back-to-school holiday for school supplies, clothing, and computers under set price caps, along with holidays for disaster preparedness supplies and recreational equipment. Dates and eligible items change year to year, so check the Florida Department of Revenue site for the current schedule before planning around one.
Use Tax on Purchases from Out of State
If you buy taxable goods from an out-of-state seller that doesn’t collect Florida sales tax — online, by phone, or while traveling — you owe Florida use tax at the same 7% combined rate.14Florida Department of Revenue. Consumers who aren’t registered dealers file use tax quarterly on Form DR-15MO. Purchases from January through March are due April 1 and late after April 20, and the pattern repeats through the year.14Florida Department of Revenue. Out-of-state businesses selling more than $100,000 into Florida in a calendar year must register and collect the tax themselves, and marketplace platforms like Amazon, eBay, and Etsy collect on behalf of their sellers.15Florida Department of Revenue. If You’re Collecting Sales Tax in Manatee County
Any business making taxable sales in the county needs a Certificate of Registration from the Florida Department of Revenue before collecting the first dollar of tax. Registration is free through the online Florida Business Tax Application or the paper Form DR-1.16Florida Department of Revenue. Filing Frequency and Deadlines
The Department assigns a filing frequency at registration. Most new businesses start monthly; lower-volume filers may go quarterly or semiannually.4Florida Department of Revenue. Florida Sales and Use Tax Whatever the frequency, each return is due by the 20th of the month after the reporting period closes. A return for January sales is due by February 20. Missing that deadline triggers a 10% penalty on the unpaid tax, plus interest at a floating rate set by the Department.18Legal Information Institute. Collection Allowance
File and pay electronically on time and you keep a 2.5% collection allowance as compensation for tracking and remitting the tax. It’s capped: once tax remitted for a single reporting period tops $1,200, no allowance is given on the amount above that.19Florida Legislature. A larger business remitting more than $1,200 in a period gets $30 and nothing beyond that.
Deducting Florida Sales Tax on a Federal Return
If you itemize on your federal return, you can deduct either state sales taxes paid or state income taxes paid, not both. Florida has no state income tax, so the sales tax deduction is the only option for Florida residents, which is worth remembering if you make a major purchase like a vehicle or boat. You can deduct actual receipts or use the IRS optional sales tax tables and add in the tax paid on those large purchases. The federal cap on total state and local taxes applies per tax year.
