A California marital settlement agreement template needs to do more than fill in names and dates. To produce a judgment a judge will actually sign, the document has to divide community property and debt with specificity, handle retirement accounts correctly, set or reserve spousal support, address custody and guideline child support if there are minor children, include the statutory language California requires, and be paired with the financial disclosures and judgment forms the court expects. Any template you use should be measured against those requirements before you sign it.
Finish Financial Disclosures Before You Draft
You cannot lock in property or support terms until both spouses have exchanged detailed financial information. This exchange is not optional. It reflects the fiduciary duty spouses owe each other and it ensures the MSA rests on verified numbers.
Each spouse serves a Preliminary Declaration of Disclosure on the other. The cover form is FL-140, with several attachments: a Schedule of Assets and Debts (FL-142), an Income and Expense Declaration (FL-150), and copies of tax returns from the prior two years.1California Legislative Information. California Family Code 2104 The FL-142 lists every asset and debt you hold any interest in, community or separate, with estimated values. The FL-150 covers monthly income, expenses, and tax information, and the court uses it to calculate support.2California Courts. Income and Expense Declaration FL-150 After exchanging these, each party signs and serves a Declaration Regarding Service of Declaration of Disclosure (FL-141) certifying the exchange happened.
California also requires a Final Declaration of Disclosure before settlement, but parties settling by MSA can waive it. The waiver must be signed under penalty of perjury and state that both sides completed and exchanged the preliminary disclosures, exchanged current income and expense declarations, and entered the waiver knowingly and voluntarily.3California Legislative Information. California Family Code 2105 Most MSA templates fold this waiver in. Skip it without the formal language and your judgment can get bounced. If the court enters a judgment when disclosure requirements were not met, it must set the judgment aside.4California Legislative Information. California Family Code 2107
Property and Debt Division
California is a community property state. Property acquired by either spouse during the marriage is owned equally by both.5California Legislative Information. California Family Code 760 The court must divide the community estate equally unless both parties agree otherwise in writing.6California Legislative Information. California Family Code 2550 The MSA is that written agreement, so you can divide specific items unevenly as long as the overall deal is balanced or one spouse makes an equalization payment.
The property section should itemize each community asset and debt, assign a current value, and specify which spouse receives it. Be specific. “The 2022 Toyota Camry, VIN [number], valued at $22,000, awarded to Wife” is enforceable. “Wife gets the car” is not. Apply the same detail to debts: every credit card, mortgage, student loan, and car note acquired during the marriage needs to be listed and assigned to one party.7California Courts. Separate Property and Commingling
Not everything gets divided. Property you owned before the marriage, gifts made specifically to you, and inheritances are generally separate property. But separate property can lose its protected status when it gets mixed with community funds. A common example: an inheritance deposited into a joint account used for living expenses, until the inherited funds can no longer be traced.
Property acquired during the marriage in joint form is presumed community property. This presumption can only be overcome by a clear statement in the title document that the property is separate, or by a written agreement between the spouses.8California Legislative Information. California Family Code 2581 If you plan to claim an asset as separate in the MSA, be ready to document a clean paper trail.
Retirement Accounts Need a Separate Order
Retirement benefits earned during the marriage are community property, and the court must ensure each spouse receives their full share.9California Legislative Information. California Family Code 2610 You cannot divide a 401(k), pension, or similar employer-sponsored plan just by writing terms into the MSA. Federal law protects those assets from being paid to anyone other than the plan participant unless a Qualified Domestic Relations Order directs the plan administrator to split the account.10U.S. Department of Labor. Qualified Domestic Relations Orders Under ERISA – A Practical Guide to Dividing Retirement Benefits
The QDRO is a separate document, but your MSA should identify each retirement account, state the community property interest, and commit both parties to cooperating in preparing and filing the QDRO. Skip that language and a decree saying “Wife gets half of Husband’s 401(k)” is unenforceable against the plan administrator. Government and church retirement plans are often outside ERISA. For those, contact the plan administrator to find out what court order they require before they will divide benefits.10U.S. Department of Labor. Spousal Support Clauses
Your spousal support section needs to do one of two things: set a specific payment amount and duration, or reserve the court’s authority to address support later. Leaving support out entirely can permanently waive one spouse’s right to ever request it.
There is no formula for spousal support the way there is for child support. California directs the court to weigh multiple factors: each spouse’s earning capacity, the standard of living during the marriage, the length of the marriage, each party’s age and health, contributions to the other spouse’s career, and any history of domestic violence, among others.11California Legislative Information. California Family Code 4320 It is the most negotiable part of any MSA.
For marriages shorter than ten years, the general benchmark is that the supported spouse should become self-supporting within half the length of the marriage. Six years of marriage points toward roughly three years of support. That’s a guideline, not a ceiling. For marriages of ten years or more, the court presumes a marriage of long duration and retains jurisdiction over spousal support indefinitely, meaning either party can return to court to request modification unless the MSA provides otherwise.12California Legislative Information. California Family Code 4336 A marriage slightly under ten years can also be treated as long-duration if the circumstances support it.
If the MSA sets a specific monthly payment, include the start date, the dollar amount, the termination date or triggering event (such as the recipient’s remarriage or either party’s death), and whether the obligation is modifiable. Parties can agree to make support non-modifiable, meaning neither spouse can ask the court to change the amount later regardless of changed circumstances. That certainty cuts both ways.
Custody and Child Support Clauses
For couples with minor children, custody and support get the most scrutiny. The court has independent authority to reject terms that don’t serve the children’s best interests, even when both parents agreed.
Custody
The MSA must define two types of custody. Legal custody covers who makes major decisions about the child’s education, healthcare, and welfare. Physical custody covers where the child lives and the parenting time schedule. Most agreements include a detailed calendar for the regular weekly schedule, holidays, school breaks, and summer vacation.
Every custody order must also include specific provisions addressing the risk of parental abduction, the basis for the court’s jurisdiction, and a statement that violating the order may result in civil or criminal penalties.13Justia Law. California Family Code 3040-3048 A thorough template will incorporate this language.
Relocation
California law gives a custodial parent the right to change the child’s residence, but the court can prevent a move that would harm the child’s welfare or the other parent’s relationship with the child.14California Legislative Information. California Family Code 7501 A relocation clause requiring advance written notice (typically 45 to 60 days) and a process for the other parent to object gives you an agreed framework instead of starting from scratch during a dispute.
Guideline Child Support
Unlike spousal support, child support follows a mandatory statewide formula based on each parent’s net monthly disposable income and the percentage of time each parent has physical custody.15Judicial Branch of California. Guideline Support Calculators Free online calculators do the math.16California Child Support Services. Guideline Calculator
You can agree to a different amount, but the court will not approve below-guideline support unless both parents make specific declarations: that they are fully informed of their rights, that no one was pressured, that the amount is in the children’s best interests, and that the children’s needs will be adequately met.17California Legislative Information. California Family Code 4065 Include that language verbatim or substantively equivalent, or the judge will reject the agreement. One more point: even with a below-guideline agreement in place, either parent can later request a modification to guideline level without having to prove changed circumstances.
Tax Terms Worth Building In
How you structure the MSA has tax implications, and the rules that apply now catch people who relied on older information.
For any divorce agreement executed after December 31, 2018, spousal support payments are not tax-deductible for the payer and are not taxable income for the recipient.18Internal Revenue Service. Topic No. 452, Alimony and Separate Maintenance Support is simply a transfer with no tax consequence to either side. Child support has never been taxable. The receiving parent does not report it as income, and the paying parent cannot deduct it.19Internal Revenue Service. Alimony, Child Support, Court Awards, Damages If the MSA includes both and the paying spouse falls behind on the total, the IRS treats the shortfall as unpaid child support first, and only the remainder counts as spousal support.
Property transfers between spouses as part of a divorce are generally not taxable events. But the receiving spouse takes over the original cost basis, which means they may owe capital gains tax on appreciation when they eventually sell. An asset worth $200,000 on paper but carrying a very low cost basis is not worth the same as $200,000 in cash. Ignoring tax basis when dividing property is one of the most common and costly mistakes in DIY divorces.
Signing and Incorporation Language
Both petitioner and respondent must sign the agreement to confirm mutual consent. If the respondent never filed a formal response (a default proceeding), many California courts require the respondent’s signature to be notarized to verify it is genuine.
The agreement must contain language stating that both parties intend the MSA to be approved by the court and incorporated into the final judgment as an enforceable order. That incorporation language is what transforms a private contract into a court order. Without it, the MSA may be treated as a contract enforceable only through a breach-of-contract lawsuit rather than through contempt, wage garnishment, or the other tools the family court provides.20Judicial Council of California. The Judgment Package the MSA Attaches To
Filing the MSA alone does not finalize your divorce. You assemble a judgment package and submit it to the Superior Court for judicial review. The standard package includes:
- FL-170, the Declaration for Default or Uncontested Dissolution, which provides the background facts of your case.
- FL-180, the Judgment, which is the document the judge signs. Your MSA is attached as an exhibit, and the FL-180 incorporates its terms by reference.
- FL-190, the Notice of Entry of Judgment, which the clerk mails to both parties after the judge signs.
The FL-180 has checkboxes to attach the settlement agreement for each major topic: custody, child support, spousal support, property division, and attorney fees.20Judicial Council of California. Form FL-180 Judgment Family Law The court’s judgment checklist (FL-182) lists every required document so you can confirm nothing is missing before you file.21California Courts. Judgment Checklist – Dissolution/Legal Separation
A judicial officer reviews the package to confirm it complies with California law, with particular attention to whether child support follows the guideline formula and whether the property division is fair. If something is deficient, the court rejects the package with a notice identifying what needs correction. If the judge approves, they sign the FL-180 and the clerk mails both parties a filed copy of the Judgment and the Notice of Entry of Judgment.22California Courts. The Six-Month Waiting Period
Your divorce becomes final on the date the judgment is entered, but only if the six-month waiting period has passed. No California divorce becomes final until at least six months after the other spouse was served with the petition or formally appeared in the case.23California Legislative Information. California Family Code 2339 You can negotiate, sign, and submit the MSA well before that mark, but the court will not terminate marital status any earlier. Many couples use the waiting period to complete disclosures, draft the agreement, and assemble the judgment package so the divorce finalizes as close to the six-month date as possible.
