Maryland Identification Laws: REAL ID, Costs, and Penalties

Maryland identification laws govern how the Motor Vehicle Administration (MDOT MVA) issues driver’s licenses and non-driver photo ID cards, what those credentials can and cannot be used for under the federal REAL ID Act, and what penalties apply when someone forges, sells, or misuses an ID. Since May 7, 2025, federal enforcement of REAL ID means a Maryland credential (or an acceptable alternative like a passport) is required to board a domestic flight or enter many federal buildings. State law also sets the documentation you must bring to the MVA, the fees you pay, how fast you must report changes, and the criminal consequences for fraud.

Types of ID Maryland Issues

Driver’s License

The standard Maryland driver’s license is both your authorization to drive and your primary photo ID. Maryland issues REAL ID-compliant licenses by default, so yours meets federal security standards for air travel, military base access, and entry to federal buildings, provided you submitted the required citizenship or lawful-status documentation when you applied.1Maryland Department of Transportation Motor Vehicle Administration. Non-Driver Photo ID Card

If you do not drive and do not hold a valid driver’s license or moped permit, you can apply for a non-driver identification card. It shows your photo, address, and date of birth and works as proof of identity and age wherever government-issued ID is accepted, but it does not authorize you to operate a vehicle.2Maryland Department of Transportation Motor Vehicle Administration. Maryland Identification Cards Documentation requirements mirror those for a driver’s license.

Limited-Use License

Under the Maryland Highway Safety Act of 2013, residents who cannot prove lawful immigration status may still apply for a driver’s license by showing Maryland residency and a record of filing Maryland income taxes. The limited-use license is visually distinct from a standard license and cannot be used for federal purposes such as boarding a domestic flight, entering a federal building, or completing employment eligibility verification on Form I-9. Holders who need to fly domestically should carry a passport or another federally accepted ID.

Veteran Designation

Maryland lets veterans add a “veteran” designation to a driver’s license or ID card at no extra charge, with proof of discharge status such as a DD Form 214.3Maryland Department of Veterans and Military Families. Motor Vehicles – Benefits and Services If you do not have discharge paperwork and your discharge was other than dishonorable, a Maryland Department of Veterans and Military Families service office can issue a verification letter the MVA will accept.

What You Need to Apply

The MVA requires you to prove three things: your age, your identity, and that you live in Maryland. Common documents include a birth certificate for age and identity, a utility bill or bank statement for residency, and a Social Security card. The name on your SSA record must match the name you present at the MVA. If you recently changed your name, allow at least 48 hours for the SSA to update its records before your appointment.2Maryland Department of Transportation Motor Vehicle Administration. For a REAL ID-compliant credential, you must also present documents establishing lawful status in the United States, such as a valid U.S. passport, a birth certificate proving citizenship, or a permanent resident card.4Department of Homeland Security. Residents experiencing homelessness can use an address provided by a recognized shelter or service organization to satisfy the residency requirement.

REAL ID Compliance and Federal Use

Federal REAL ID enforcement took effect May 7, 2025. From that date, every air traveler 18 or older must present a REAL ID-compliant driver’s license, state ID, or another TSA-accepted form of identification to clear a security checkpoint for a domestic commercial flight.6Transportation Security Administration. If your Maryland license is not REAL ID-compliant, several alternatives still work for federal purposes: a U.S. passport or passport card, a Global Entry or SENTRI trusted traveler card, or an active-duty, retired, or dependent military ID.6Transportation Security Administration. Maryland Mobile ID

Maryland runs a mobile driver’s license program that lets you store a digital version of your license or ID card on your phone through Apple Wallet, Google Wallet, or Samsung Wallet.7Maryland Department of Transportation Motor Vehicle Administration. Maryland Mobile ID Program The mobile ID can share only the specific detail a verifier needs (for example, confirming you are over 21) without revealing your full name or address. TSA accepts Maryland’s mobile ID at more than 250 checkpoints nationwide, though support varies by airport.8Transportation Security Administration. Participating States and Eligible Digital IDs Your mobile ID must be based on a REAL ID-compliant physical credential to qualify for TSA use, and the MVA recommends carrying your physical card as a backup.

Keeping Your ID Current

Maryland law gives you 30 days to notify the MVA after changing your address or your name, whether by marriage, court order, or common law. For an address change, you must provide your old address, new address, and license number in writing. For a name change, update your records with the Social Security Administration first and wait at least 72 hours before visiting the MVA, because the MVA verifies the new name against SSA records and will not process the change if the databases do not match.9Maryland Department of Transportation Motor Vehicle Administration. Renewing Your Maryland Drivers License

A standard Maryland driver’s license lasts eight years. The MVA notifies you at renewal time if you need to bring updated documents. Holders of limited-term licenses issued to people with temporary lawful status must renew in person, and the license validity period matches the duration of their authorized stay. If your name has changed since the last issuance, you also need to renew in person rather than online.9Maryland Department of Transportation Motor Vehicle Administration. When Your License Can Be Suspended for Non-Driving Reasons

Your Maryland driver’s license can be suspended for reasons unrelated to driving. The most common non-driving trigger is falling behind on child support. Under a law effective October 1, 2025, the MVA can suspend your license if your child support account is 120 or more days out of compliance with a court-ordered support obligation.10Maryland Department of Human Services. New Drivers License Suspension Law The Department of Human Services refers the case to the MVA, and the suspension stays in place until you catch up on payments or enter into a compliance agreement. Other enforcement tools, including income withholding, tax intercepts, and property liens, continue to apply alongside the license suspension.

Criminal Penalties for ID Fraud

Selling or Issuing Incorrect ID Documents

Maryland Criminal Law Section 8-302 targets anyone who sells, issues, or offers to sell an identification card containing a blank space for the holder’s age or date of birth, a false date of birth, an incorrect name, or a wrong address. This is a misdemeanor punishable by up to two years in prison, a fine of up to $2,000, or both.11Maryland General Assembly. Maryland Criminal Law Code Section 8-302 – Blank or Incorrect Identification Card The statute is aimed at producers and sellers of fake or inaccurate IDs, not at someone who merely possesses one.

Identity Fraud

The broader offense is identity fraud under Section 8-301, which covers using someone else’s personal identifying information to obtain benefits, goods, services, or credit. Penalties scale with the dollar value involved:12Maryland General Assembly. Maryland Criminal Law Code Section 8-301 – Identity Fraud

  • $100 to $1,499: misdemeanor, up to one year in prison and a fine of up to $500
  • $1,500 to $24,999: felony, up to five years and a fine of up to $10,000
  • $25,000 to $99,999: felony, up to 10 years and a fine of up to $15,000
  • $100,000 or more: felony, up to 20 years and a fine of up to $25,000

A separate provision targets anyone who manufactures or distributes another person’s personal information without consent, regardless of dollar value. That offense is a felony carrying up to 10 years and a fine of up to $25,000.12Maryland General Assembly. Maryland Criminal Law Code Section 8-301 – Identity Fraud Prosecutors use this provision in data-breach and stolen-identity-trafficking cases, and it applies even when no one has yet used the stolen information to make a purchase.

Voter ID at the Polls

Maryland does not require most voters to show ID when voting in person. The exception is first-time voters who registered by mail, who may be asked for a current photo ID such as a Maryland driver’s license or U.S. passport, or a recent utility bill or bank statement showing their name and address. If you registered in person or online and have voted in Maryland before, you generally sign the poll book and vote without producing an ID.
