Maryland Marital Settlement Agreement: Coverage and Enforcement

A marital settlement agreement in Maryland is a written contract between spouses that resolves the issues raised by a divorce — property, alimony, and, when there are children, custody and support. When both spouses sign one and file it with the divorce complaint, the court can grant an absolute divorce on the ground of mutual consent with no separation period and no need to prove fault. The agreement is a contract first and a court order second, and those two identities shape everything about how it is written, approved, and enforced.

What the Agreement Does in a Divorce

Maryland Family Law § 8-101 authorizes spouses to make “a valid and enforceable deed or agreement that relates to alimony, support, property rights, or personal rights.”1Maryland General Assembly. Family Law § 8-101 Family Law § 7-103(a)(3) then lets a court grant an absolute divorce on mutual consent when both spouses have signed a written settlement agreement resolving all issues of alimony, property distribution, and the care, custody, access, and support of any minor or dependent children.2Maryland General Assembly. Family Law § 7-103 If the agreement addresses child support, a completed child support guidelines worksheet must be attached, and neither spouse may file a pleading to set the agreement aside before the divorce hearing.3People’s Law Library. A mutual-consent divorce has no separation or waiting period, which makes it the fastest route to a final decree for couples who can agree.4Maryland Legal Aid. Divorce Basics Couples who cannot agree on all issues have to proceed under one of the other no-fault grounds that have been available since Maryland’s October 1, 2023 divorce overhaul: six-month separation or irreconcilable differences.5Maryland Volunteer Lawyers Service. The terms “separation agreement,” “marital settlement agreement,” and “property settlement agreement” are used interchangeably under Maryland law. Signing one does not end the marriage. You remain married and cannot remarry until a court enters the final decree.6People’s Law Library. Separation Agreements

What the Agreement Has to Cover

The standard court form, CC-DR-116 (revised October 2025), is organized around four core topics: alimony, marital property, child custody, and child support.7Maryland Judiciary. Marital Settlement Agreement, Form CC-DR-116 Couples with straightforward finances can often use the template as-is. The form itself warns that it may not be adequate for situations involving significant assets, business interests, or defined benefit pension plans.6People’s Law Library. Separation Agreements

Property

Maryland follows equitable distribution. Marital property generally includes everything either spouse acquired between the date of marriage and the date of divorce, regardless of how it is titled: real estate, vehicles, bank accounts, business interests, and retirement contributions made during the marriage.7Maryland Judiciary. Marital Settlement Agreement, Form CC-DR-116 Property acquired before the marriage, inheritances, and gifts from third parties stay with the owner, along with anything directly traceable to those sources. Commingling non-marital property with marital property can cause a court to treat the whole asset as marital.8People’s Law Library. Marital and Non-Marital Property in Maryland

An MSA lets spouses divide property on their own terms rather than leaving a court to issue a monetary award after weighing statutory factors.8People’s Law Library. Marital and Non-Marital Property in Maryland The tradeoff is finality. Property division terms written into the agreement cannot be changed by a court once the decree is entered.7Maryland Judiciary. Marital Settlement Agreement, Form CC-DR-116

If the marital home carries a conventional mortgage, a 2025 change matters. Maryland House Bill 1018 (Chapter 202), effective October 1, 2025, requires lenders to allow an existing conventional mortgage to be assumed by one spouse in connection with a divorce decree, so long as the assuming spouse qualifies for the loan. The law applies retroactively to conventional loans originated before the effective date, provided the divorce is granted on or after October 1, 2025.9Maryland General Assembly. Chapter 202, HB 1018 Assumption is not automatic; the remaining spouse still has to meet the lender’s credit standards. The agreement should name the spouse who will assume, set a timeline for the application, and include a fallback plan if the lender denies the request.

Alimony

Maryland recognizes three types of alimony: pendente lite (temporary support during the divorce), rehabilitative (support for a set period), and indefinite (open-ended, typically where a spouse has limited employability or a large earnings gap). When spouses agree on alimony terms in an MSA, the court is generally bound by them.10People’s Law Library. Alimony in Maryland Under Family Law § 8-103, a court retains the power to modify alimony later unless the agreement expressly waives alimony or states that its alimony terms are “not subject to any court modification.”11Maryland General Assembly. Family Law § 8-103 If you want certainty, the clause has to say so.

An MSA can also go beyond what a court would order on its own. Spouses may agree that alimony payments cover the mortgage on the family home, for instance, while court-ordered alimony is limited to periodic monetary payments.10People’s Law Library. Alimony in Maryland Unless the agreement specifies otherwise, alimony ends on the death of either spouse, the recipient’s remarriage, or a court finding that termination is necessary to avoid a “harsh and inequitable result.”

Taxes split along federal and state lines. For any divorce agreement executed after December 31, 2018, the federal Tax Cuts and Jobs Act eliminated the payer’s deduction and the recipient’s obligation to report alimony as income.12Internal Revenue Service. Divorce or Separation May Have an Effect on Taxes Maryland did not adopt that federal change. On a Maryland state return, alimony remains deductible for the payer and taxable to the recipient.13Divorce.law. Alimony Tax Implications, Maryland

Child Custody and Support

Child-related provisions are different from everything else in the agreement because they are never fully final. The court reviews custody and support terms against the “best interests” of the children before incorporating them into the decree.2Maryland General Assembly. Family Law § 7-103 Even after incorporation, custody, parenting time, and support can be modified when circumstances change.11Maryland General Assembly. Family Law § 8-103 Parents cannot waive child support by private agreement; the right belongs to the child, and the court can set support regardless of what the spouses have written.7Maryland Judiciary. Marital Settlement Agreement, Form CC-DR-116

Maryland’s child support guidelines use a formula based on each parent’s share of combined gross income.14People’s Law Library. Legal Overview of Child Support If the agreed-upon amount deviates from the guidelines, the court must find the deviation is in the child’s best interest. A completed worksheet — CC-DR-034 for primary custody or CC-DR-035 for shared physical custody — has to be filed with the MSA.7Maryland Judiciary. Marital Settlement Agreement, Form CC-DR-116

Retirement Accounts

Dividing a retirement account almost always requires a Qualified Domestic Relations Order, a separate court order that directs the plan administrator to pay a portion of benefits to the other spouse. A division clause inside the MSA alone will not avoid tax penalties or compel a plan administrator to distribute funds. The CC-DR-116 form does not include a QDRO template, so a couple with retirement assets needs additional drafting. Delay can cost the receiving spouse value through participant loans, withdrawals, or lost survivor benefits.15People’s Law Library. Qualified Domestic Relations Order

What’s Permanent and What Isn’t

Three different rules apply to the three main pieces of the agreement, and the differences matter when you sign.

  • Property division is permanent. Once the decree is entered, a court cannot change it.7Maryland Judiciary. Marital Settlement Agreement, Form CC-DR-116
  • Alimony is modifiable by default. If you want it to be unchangeable, the agreement has to say so explicitly or expressly waive alimony altogether.11Maryland General Assembly. Family Law § 8-103
  • Child custody and support are always modifiable when circumstances change, and the court must approve the initial terms as being in the child’s best interest.2Maryland General Assembly. Family Law § 7-103

Incorporated or Merged: How the Agreement Is Enforced

How the MSA is treated in the final decree controls what happens if someone later breaks it. Maryland law draws a sharp line between two choices.16Maryland General Assembly. Family Law § 8-105

Merged into the decree. The agreement ceases to exist as a separate contract and becomes purely a court order. Enforcement runs through the court’s contempt power, which can mean fines, attorney’s fees, or in some cases incarceration. If the agreement contains a term the court lacks statutory authority to enforce, such as paying for a child’s college tuition after emancipation, contempt may not be available.

Incorporated but not merged. The agreement becomes part of the court order and also survives as an independent contract. That dual status gives the aggrieved party two paths: contempt proceedings or a breach-of-contract lawsuit, which can produce money damages, specific performance, or an injunction.

The standard CC-DR-116 form asks that the agreement be “incorporated, but not merged,” and the People’s Law Library recommends that choice for all separation agreements to keep the broadest range of enforcement options open.6People’s Law Library. Separation Agreements

Making Sure the Agreement Is Actually Binding

Because an MSA is a contract, standard contract rules apply. There has to be a valid offer and acceptance, and both spouses have to enter the agreement freely and voluntarily.7Maryland Judiciary. Marital Settlement Agreement, Form CC-DR-116 Each spouse has the right to consult a lawyer before signing. Choosing not to do so will not, by itself, invalidate the agreement.

The Supreme Court of Maryland’s decision in Pattison v. Pattison (No. 33, Sept. Term 2024, filed July 23, 2025) shows how strictly these contract rules bite. The wife sent her husband a signed property settlement agreement with a cover letter requiring him to sign it that same day. He signed three days late. The Court held that the wife’s deadline was a valid condition of her offer. The husband’s late signature became a counteroffer, the wife’s silence afterward did not count as acceptance, and the proposed agreement was a “nullity.” An integration clause inside the document did not override the external deadline.17Supreme Court of Maryland. Pattison v. Pattison, No. 33-24 The practical takeaway: deadlines and conditions in a cover email are real, and a signed-looking draft is not necessarily a binding contract.

Grounds for Setting an Agreement Aside

Adults are presumed to have the capacity to contract, so a signed MSA carries a presumption of validity. A spouse trying to void it has to prove one of the recognized grounds:

  • Fraud — a spouse misrepresented or concealed a material fact to induce the other to sign.
  • Duress or undue influence — a spouse was compelled to agree or could not exercise free will.
  • Unconscionability — the terms are so one-sided they “shock the conscience of the court.” Maryland courts have said an agreement does not have to be equal to be valid; it must be “so egregious that it gives all the benefits of the agreement to only one party.”18Maryland Judiciary. Unreported Opinion, No. 1054s20

Reopening a judgment that incorporates the agreement is harder still. A party generally has to allege “extrinsic fraud” — fraud that prevented a fair adversarial process — under Maryland Rule 2-535(b). Claims about assets concealed during negotiations are usually classified as “intrinsic fraud” and are not enough to reopen an enrolled judgment, though the aggrieved spouse may still pursue independent contract or tort claims.19Maryland Judiciary. Unreported Opinion, No. 2463s16 And a breach of one covenant does not automatically excuse performance of another unless the agreement explicitly links them, so one spouse falling behind on a car payment does not undo the other spouse’s waiver of alimony.20Maryland Judiciary. Unreported Opinion, No. 0947s15

Revoking the Agreement

An MSA can be revoked in two ways: by a later written agreement between the spouses, or by the spouses resuming life together as a married couple. Resumed cohabitation does not automatically revoke the agreement. It is evidence of intent to revoke that a court then evaluates.6People’s Law Library. Separation Agreements

Reaching Agreement When You’re Stuck

Couples who want to settle but cannot get to terms on their own have options short of a courtroom fight. Divorce mediation is an out-of-court process in which a neutral mediator helps spouses identify disputed issues and negotiate solutions. Sessions are confidential, either party can stop at any time, and a reached agreement is drafted, reviewed by attorneys, signed, and submitted to the court.21People’s Law Library. Divorce Mediation Collaborative divorce uses a team approach: each spouse retains a specially trained attorney, and the group may include divorce coaches, child specialists, and neutral financial professionals. Both attorneys attend every negotiation session, so each spouse has legal guidance in real time.22Collaborative Law Maryland. Collaborative Divorce FAQ

Drafting It Carefully

Maryland courts interpret MSA provisions by their “plain, ordinary, and usual meaning,” and a provision is ambiguous if a “reasonably prudent person” could read it two ways. Ambiguity opens the door to outside evidence of intent, which means more hearings and more expense.6People’s Law Library. Separation Agreements A few points worth getting right in the document:

  • Retirement accounts need a separate QDRO; language in the MSA alone will not divide the account.
  • Mortgage assumptions still require lender approval under HB 1018, so the MSA should include a fallback if the lender says no.
  • If alimony terms are meant to be final, the agreement has to say so in clear language or the court can modify them later.11Maryland General Assembly. Family Law § 8-103
  • If the agreement contains Social Security numbers, federal tax IDs, or full account numbers, a Notice Regarding Restricted Information (Form MDJ-008) has to be filed, and the parties may petition to seal the record.7Maryland Judiciary. Marital Settlement Agreement, Form CC-DR-116

If You’re Doing This Without a Lawyer

A self-represented spouse can prepare and file an MSA, though the People’s Law Library describes doing so as “risky,” particularly where there are complex assets, retirement benefits, or real estate.6People’s Law Library.
