Maryland Mesothelioma Lawsuit: Deadlines, Venues & Verdicts

A Maryland mesothelioma lawsuit is a personal injury or wrongful death claim brought by someone diagnosed with mesothelioma after asbestos exposure, almost always filed on the dedicated asbestos docket at the Circuit Court for Baltimore City. You generally have three years from diagnosis to sue, and three years from death (or ten years from the death, whichever expires first) to bring a wrongful death case.1Maryland People’s Law Library. Who Can File and When

A living mesothelioma patient can file a personal injury claim. If the patient has died, a personal representative of the estate brings the wrongful death action on behalf of the family.2The Lanier Law Firm. Maryland Mesothelioma Lawyer

Maryland’s general statute of limitations for personal injury is three years, set by Courts and Judicial Proceedings § 5-101. For mesothelioma, the clock usually begins at diagnosis under the discovery rule, which recognizes that a patient cannot sue for a disease they do not yet know they have.1Maryland People’s Law Library. Wrongful death carries its own deadline: three years from the date of death, or ten years from the death itself, whichever comes first.2The Lanier Law Firm. One historical wrinkle still matters for older exposures. Under the Court of Appeals decision in Duffy v. CBS Corp., Maryland treats the injury as having arisen at the time of asbestos exposure, not at diagnosis. Workers whose last exposure predated the state’s statute of repose can still sue decades later, because the statute cannot be applied retroactively to bar a claim that already arose.5Justia. Duffy v. CBS Corp.

Where the Case Will Be Heard

The Circuit Court for Baltimore City runs a dedicated Asbestos Case Management Program for every personal injury and wrongful death case involving asbestos exposure. The program is overseen by Senior Judge W. Michel Pierson. As of September 2025, the active docket held roughly 15,000 cases.6Baltimore City Circuit Court. Asbestos Case Management7File&ServeXpress. Even if the exposure happened elsewhere in Maryland, the case will likely end up in Baltimore. Under Maryland Rule 16-306, a circuit court in another county can transfer an asbestos action to Baltimore City for placement on a Special Inactive Pretrial Docket, as long as Baltimore City is a proper venue. The rule applies to actions filed on or after December 8, 1992.8New York Codes, Rules and Regulations. Maryland Rule 16-306

Asbestos cases are exempt from Maryland Electronic Courts and do not appear on the state’s public case search. Filings go through the File & ServeXpress platform. The court uses different scheduling templates for standard mesothelioma cases, expedited cases for living mesothelioma plaintiffs, and non-mesothelioma asbestos claims.6Baltimore City Circuit Court. Expect a status conference. Since 2017, the court has required credible evidence of asbestos-related impairment before a case can proceed. What You Can Recover

Damages in a Maryland mesothelioma case fall into three buckets: economic, noneconomic, and punitive.

Economic damages cover medical bills, lost wages, and other out-of-pocket losses. There is no statutory cap on them.10SG Legal Group. Maryland Noneconomic Damages Cap Legislative Debate

Noneconomic damages, which cover pain, suffering, and loss of companionship, are capped. The base cap started at $500,000 for causes of action arising on or after October 1, 1994, and rises by $15,000 each year. For causes of action arising on or after October 1, 2025, the cap is $965,000 for a single beneficiary. A wrongful death case with two or more beneficiaries can recover up to 150 percent of the cap, which comes to $1,447,500.11Justia. Maryland Code, Courts and Judicial Proceedings § 11-10810SG Legal Group. Maryland Noneconomic Damages Cap Legislative Debate

Whether the cap applies at all depends on when the cause of action arose, not when the suit was filed. In John Crane Inc. v. Scribner, the Court of Appeals held that an asbestos cause of action arises when the plaintiff is first exposed to the fibers. Because the cap took effect on July 1, 1986, exposures before that date are not subject to it. The jury in Scribner found the plaintiff’s mesothelioma arose before the cap and awarded $5.24 million.12FindLaw. John Crane Inc. v. Scribner

Punitive damages have no statutory ceiling. The Baltimore jury that returned the $1.56 billion verdict against Johnson & Johnson in December 2025 awarded $59.8 million in compensatory damages and $1.5 billion in punitive damages.3Fierce Pharma. Lawsuits and Bankruptcy Trust Claims Are Separate Tracks

Many of the companies responsible for Maryland asbestos exposure no longer exist. Bethlehem Steel filed for bankruptcy in 2001 and dissolved by 2003.13Mesothelioma.com. Bethlehem Steel Corporation Wallace & Gale, the Baltimore insulation contractor, filed for Chapter 11 in 1984, and its settlement trust was established in 2002.9The Baltimore Sun. Thousands of Maryland Asbestos Poisoning Lawsuits Being Dropped or Dismissed When companies like these went through bankruptcy, Section 524(g) of the U.S. Bankruptcy Code required them to set up trust funds for current and future victims.

More than 60 active trusts exist nationally, originally funded with roughly $37 billion. About $25 billion remains. Most mesothelioma patients file claims against 20 or more trusts simultaneously, and the process typically resolves within three to six months. Average total recovery across multiple trusts runs between $300,000 and $400,000, though individual trust payments vary widely.14Asbestos.com. Asbestos Trust Funds

Trust claims are independent of lawsuits against solvent defendants and of VA disability benefits. You can pursue all three at once.4SWMW Law. Asbestos Trust Funds

Where Maryland Exposure Typically Happened

Identifying the sites and products that caused your exposure is central to the case. Maryland’s industrial history, concentrated around the Port of Baltimore, produced a cluster of recurring defendants.

Shipyards sit at the top of the list. Asbestos was used extensively in insulation, gaskets, valves, and pipe coverings at the Bethlehem Steel Sparrows Point Shipyard, Bethlehem Fairfield Shipyard, Key Highway Shipyard, Curtis Bay Shipyard, Maryland Drydock, and Todd Shipyard.15Respectforyou.com. Steel mills and factories are a second cluster. The Bethlehem Steel mill at Sparrows Point generated more than 3,000 asbestos lawsuits against the company on its own.13Mesothelioma.com. Bethlehem Steel Corporation Other industrial sites include Crown Cork & Seal canning plants, the W.R. Grace chemical plant, Black & Decker, General Motors, General Electric, and the Mack Truck plant in Hagerstown.15Respectforyou.com. Maryland Asbestos Exposure Sites

Power plants used asbestos in boilers, turbines, and insulation. Documented sites include Baltimore Gas & Electric facilities, Chalk Point Generating Station, Calvert Cliffs Nuclear Power Plant, and the H.A. Wagner Power Plant.15Respectforyou.com. Maryland Asbestos Exposure Sites

Military installations are another significant source. Aberdeen Proving Ground, Fort Meade, Patuxent River Naval Air Station, the U.S. Naval Academy in Annapolis, Bethesda Naval Hospital, Edgewood Arsenal, and multiple Naval Ordnance facilities all had documented asbestos use.16Baron & Budd. Exposure to consumer products counts too. Recent Maryland Verdicts

In December 2025, a Baltimore City jury awarded $1.56 billion to Cherie Craft, who was diagnosed with peritoneal mesothelioma in January 2024. The verdict against Johnson & Johnson consisted of $59.8 million in compensatory damages and $1.5 billion in punitive damages. The company announced it would appeal, and its legal chief called the award “egregious and patently unconstitutional.” J&J has reduced large talc verdicts on appeal before — a $4.7 billion Missouri verdict from 2018 was later cut to $2.1 billion. The company faces more than 67,000 pending talc cases nationally.3Fierce Pharma. Baltimore Jury Orders J&J to Pay $1.5B, Largest-Ever Award to Talc Plaintiff

Other Maryland verdicts give a more typical range. A machinist and shipyard worker who developed mesothelioma from asbestos rope at a South Baltimore shipyard received $15.3 million.13Mesothelioma.com. Bethlehem Steel Corporation In the 2017 Loch Raven High School case, a plaintiff who contracted mesothelioma after exposure to insulation installed by Wallace & Gale during the school’s 1972 construction won $14.6 million at trial. The amount was reduced to roughly $7.3 million after adjustments for cross-claims, and the Maryland Court of Special Appeals affirmed the verdict in September 2018.17Maryland Courts. Wallace & Gale Asbestos Settlement Trust v. Busch The consolidated Carter cases decided by the Maryland Court of Appeals in 2014 produced per-plaintiff recoveries, after statutory reductions and settlement credits, of roughly $2 million to $2.9 million.18FindLaw. Legal Rules That Shape Maryland Asbestos Cases

Most Maryland asbestos claims proceed under strict liability, which holds manufacturers and suppliers responsible if a product was harmful when used as intended due to a design defect, manufacturing defect, or failure to warn. Negligence claims can also be brought.2The Lanier Law Firm. Maryland Mesothelioma Lawyer

Maryland follows contributory negligence rather than comparative fault. If the plaintiff is found to have contributed to their own injury, recovery can be barred entirely.2The Lanier Law Firm. Maryland Mesothelioma Lawyer

Smoking is a common issue in lung cancer cases, and Maryland law handles it in a way that favors plaintiffs. In Carter v. Wallace & Gale Asbestos Settlement Trust, the Court of Appeals held that death from lung cancer is a legally indivisible injury: a defendant whose asbestos was a “substantial contributing factor” is liable for the full injury, even if the decedent’s smoking also contributed. The same ruling clarified that family members pursuing wrongful death as “use plaintiffs” did not need to file formal pleadings before January 1, 2013, so long as they gave knowing consent and actively participated in the litigation before the limitations period expired.19Maryland Courts.
