Maryland Personal Property Tax Return: Deadlines, Exemptions, and Penalties

Every corporation, LLC, limited partnership, LLP, statutory trust, and business trust formed or registered in Maryland has to file an annual return with the State Department of Assessments and Taxation by April 15, even if it owns nothing.1Maryland General Assembly. Maryland Code Tax – Property 11-101 That is the baseline for Maryland personal property tax return filing requirements. Sole proprietorships and general partnerships only file if they actually own taxable personal property. And any business whose personal property statewide had a total original cost under $20,000 owes no tax and, in most cases, does not have to complete the property portion of the return at all.

Who Has to File

Maryland law pulls in every domestic and foreign corporation, LLC, limited partnership, LLP, statutory trust, and business trust registered to do business in the state.1Maryland General Assembly. Maryland Code Tax – Property 11-101 These entities use Form 1, which combines the annual report (confirming the entity still exists and keeping its charter in good standing) with the business personal property return. A corporation with no assets and no activity still has to file Form 1 every year.

Sole proprietorships and general partnerships operate under a narrower rule. They file only if they own personal property subject to property tax, and they use Form 2 rather than Form 1.2Maryland Department of Assessments and Taxation. 2025 Instructions for Form 2 Sole Proprietorship and General Partnerships Business Personal Property Tax Return

A handful of entity types cannot use the online portal and must send paper forms: government entities, banks, credit unions, savings and loans, trust companies, non-stock cooperatives, public utilities, cable providers, and unincorporated rental property owners in Worcester County and Ocean City.3Maryland Business Express. The $20,000 Exemption

If your business’s personal property statewide had a total original cost below $20,000, that property is exempt from valuation and from the tax, and you do not have to file the personal property return itself, as long as you attest to being under the threshold.4Maryland General Assembly. Maryland Code Tax-Property 7-245 – Exemption for Personal Property Important caveat for registered entities: corporations, LLCs, and the other Form 1 filers still have to submit the annual report half of Form 1 to stay in good standing. The exemption gets you out of the tax, not out of the yearly filing.

Manufacturing equipment is handled separately. Tools, machinery, and manufacturing apparatus used in manufacturing or in research and development are not subject to personal property tax, but the exemption runs through a local application process administered by the county or city.5Maryland Department of Assessments and Taxation. Manufacturing and Research and Development Exemption Application Intangible assets like patents, copyrights, and accounts receivable are outside the scope of the tax, and inventory held for resale is generally exempt as well.

What Goes on the Return

You will need your SDAT identification number before you start. It is assigned when the business is formed or registered and consists of a letter indicating entity type followed by eight digits.6Maryland Business Express. Register Your Business in Maryland – Section: Your Business Identification Numbers The form also asks for the date of formation and a primary business activity code.

The return itself is an inventory of all tangible assets used in the business: furniture, fixtures, tools, machinery, and equipment. Each asset is reported with its original purchase cost and the year acquired, grouped into categories that SDAT uses to apply its own depreciation schedules and arrive at an assessed value.

Two points trip up a lot of filers. First, fully depreciated or expensed assets still have to be reported and remain subject to assessment; a zero book value on your federal return does not take an asset off this one.7Maryland Department of Assessments and Taxation. 2026 Form 1 Instructions Second, leased equipment belongs on the return if your lease makes you responsible for property taxes. Reported original costs should match what your financial statements and federal filings show; discrepancies are what tend to draw a closer look.

How to File and What It Costs

Most businesses file through the Maryland Business Express online portal and pay by eCheck or credit card, with a small convenience fee for card payments. Paper returns go to the Personal Property Division at P.O. Box 17052, Baltimore, Maryland 21297-1052, with a check or money order for the filing fee.8Maryland Department of Assessments and Taxation. The 2026 filing fee depends on entity type:9Maryland Department of Assessments and Taxation. 2026 Form 1 Annual Report and Business Personal Property Return

  • $300 for stock corporations, LLCs, limited partnerships, LLPs, statutory trusts, insurance corporations, and REITs, whether domestic or foreign.
  • $100 for SDAT-certified family farms.
  • $0 for non-stock corporations and foreign interstate corporations.

SDAT will not accept the report without the fee. Once it processes your submission, it mails an assessment notice with the value it has assigned to your property. The county or city where the property sits then applies its local tax rate and sends you a bill, usually in July.

The April 15 Deadline and the 60-Day Extension

Returns are due April 15 every year. If April 15 falls on a weekend, the deadline moves to the following Monday. If you need more time, you can request a free 60-day extension that pushes the deadline to June 15 (or the next business day). The request has to be submitted through SDAT’s online extension portal on or before April 15.10Maryland State Department of Assessments and Taxation. 2025 Instructions for Form 2 Sole Proprietorship and General Partnerships Business Personal Property Tax Return

What Happens If You File Late or Not at All

Filing late triggers a penalty equal to the greater of 1/10 of one percent of the county assessment or a base amount that climbs with how late you are:11Maryland Department of Assessments and Taxation. 2024 Instructions for Form 1 The Annual Report and Business Personal Property Return

  • 1 to 15 days late: minimum $30, maximum $500.
  • 16 to 30 days late: minimum $40, maximum $500.
  • 31 or more days late: minimum $50, maximum $500.

Interest then compounds at 2 percent for every 30-day period (or part of one) the return remains unfiled.11Maryland Department of Assessments and Taxation. 2024 Instructions for Form 1 The Annual Report and Business Personal Property Return Unpaid penalties get referred to the State of Maryland Central Collection Unit, which tacks on a 17 percent surcharge.12Maryland Department of Assessments and Taxation. Frequently Asked Forfeiture Questions

The bigger problem is losing your charter. SDAT publishes a Potential Forfeiture Search between July and September so you can check your status, mails a final forfeiture notice in early October, and forfeiture takes effect in December.12Maryland Department of Assessments and Taxation. Frequently Asked Forfeiture Questions A domestic entity loses its charter; a foreign entity loses its authority to do business in Maryland. Any of these will do it: failing to file a prior-year annual report (domestic), failing to file the current-year report (foreign), leaving a late penalty unpaid, or bouncing the filing-fee check.

Getting reinstated means clearing everything first. Any back returns have to be filed. If any of them show taxable personal property, SDAT processes the assessment, you pay the county or city the resulting tax, and you obtain a tax clearance certificate (a receipt alone will not do). You then file the Articles or Certificate of Reinstatement with a $100 fee for standard processing in six to eight weeks, $150 for expedited handling in seven to ten business days, or an additional $325 online (or $425 in person) for same-day service.13Maryland Department of Assessments and Taxation. If You Think the Assessment Is Wrong

Once the assessment notice arrives, you have 45 days from the date on the notice to appeal. You can file online using the control number on the notice or send the paper appeal form that came with it back to the local assessment office.14Maryland Department of Assessments and Taxation. Assessment Appeal Process Miss the 45-day window and you generally cannot challenge the valuation for that tax year, so put the date on the calendar the day the notice shows up.
