Maryland’s smoking laws ban smoking and vaping inside almost every public space and workplace in the state, set 21 as the minimum age to buy any tobacco or vape product, and let counties and cities add stricter rules on top. The statewide indoor ban has been in effect since February 1, 2008, and it applies equally to cigarettes and to e-cigarettes.1Maryland General Assembly. Where You Cannot Smoke or Vape
Maryland’s Clean Indoor Air Act, codified in Title 24, Subtitle 5 of the Health-General Article, prohibits smoking and vaping in four broad categories: indoor areas open to the public, indoor government meeting spaces, government-owned mass transit (including buses, trains, taxis, and limousines), and indoor workplaces.1Maryland General Assembly. In practice that reaches every restaurant, bar, retail store, office, gym, theater, and government building in the state. It also covers common areas of apartment buildings and other multi-unit housing. Because the law reaches all indoor workplaces, it applies inside private offices that customers never enter, not only public-facing rooms. The statute uses “vaping” alongside “smoking,” so e-cigarettes and similar devices face the same restrictions as traditional tobacco.
The Narrow Exceptions
Section 24-505 carves out a short list of places where the ban does not apply, and the list is tighter than most people assume.2Maryland General Assembly. Maryland Code 24-505 – Scope
- Private homes and private vehicles. If you run a licensed home child care operation, or if the vehicle transports children as part of a child care or health care service, the exemption disappears.
- Hotel and motel guest rooms, up to 25% of which may be designated as smoking rooms.
- Retail tobacco businesses whose primary business is selling tobacco products and accessories. A convenience store that happens to sell cigarettes does not qualify.
- Tobacco manufacturers, importers, wholesalers, and processors, within their own facilities.
Any business relying on one of these exceptions must post signs telling people that smoking or vaping is permitted on the premises.
Minimum Age to Buy Tobacco and Vapes
Since October 1, 2019, Maryland has prohibited tobacco sales to anyone under 21. The rule covers cigarettes, cigars, smokeless tobacco, e-cigarettes, vape pods, and e-liquids.3Maryland Department of Health. Retailers have to check a valid driver’s license or government-issued photo ID. School and employer IDs are not acceptable.3Maryland Department of Health. Product placement matters too. Maryland retailers may not store or display tobacco where customers can reach it directly; only the owner, operator, or an agent can handle the product, which in practice means behind the counter or in a locked case.5Justia. Retailer Penalties for Selling to Under-21
Maryland fines climb sharply with each offense:
- First violation: $300.
- Second violation within two years: $1,000.
- Each additional violation within two years of the prior one: $3,000.

The FDA runs its own undercover compliance checks and issues a warning letter for a first violation, $365 for a second within 12 months, $727 for a third within 24 months, and up to $14,602 for a sixth within 48 months. How Much Tobacco Is Taxed
Maryland’s cigarette excise tax is $5.00 per pack of 20.7Alcohol, Tobacco, and Cannabis Commission. What Is the Current Maryland Excise Tax on Cigarettes Add the $1.01 federal excise tax and the combined tax on a pack, before any local levies, is over $6.
Electronic smoking devices carry a 20% sales and use tax on the taxable price. The rate took effect July 1, 2024, when Senate Bill 362 raised it from 12%. The same legislation increased the excise rate on other tobacco products such as cigars and pipe tobacco.8Maryland Comptroller. On the federal regulatory side, products containing nicotine from any source now fall under FDA authority, including synthetic nicotine not derived from the tobacco plant. Counties and Cities With Stricter Rules
Maryland lets local governments regulate smoking more strictly than the state baseline, and several do.
Montgomery County
Bill 35-18 banned smoking in outdoor restaurant seating areas, including patios, decks, and porches. The ban covers e-cigarettes and vaping in those spaces, violations carry a $50 fine, and enforcement is complaint-based.10Montgomery County Council. Prince George’s County
CB-24-2012 restricts smoking inside public housing and senior citizen housing. The Housing Authority of Prince George’s County has declared all its properties smoke-free, covering apartment units and townhomes.12Prince George’s County Government. Baltimore City
Baltimore City has moved to ban tobacco use within 50 feet of playgrounds, schoolyards, and city athletic fields, as part of a broader push to keep outdoor recreational spaces used by children smoke-free.
Federal Property Inside Maryland
Federal facilities in Maryland run on federal rules, not state ones. Under Executive Order 13058 and the Federal Management Regulation, smoking is prohibited inside all buildings owned, rented, or leased by the executive branch, and designated interior smoking areas were eliminated as of June 2009.13General Services Administration. Outdoors, on property controlled by the General Services Administration, smoking is prohibited in courtyards and within 25 feet of doorways and air intake ducts, and individual agencies can set tighter rules.13General Services Administration. Where federal employees work in privately owned leased space, the more restrictive rule wins, whether that is the federal policy or the local ordinance.
Mailing Tobacco and Vape Products
Under the federal Prevent All Cigarette Trafficking (PACT) Act, sending cigarettes, roll-your-own tobacco, or smokeless tobacco through the U.S. Postal Service is illegal. Nonmailable tobacco deposited in the mail can be seized, and senders face criminal fines, imprisonment, and civil penalties. The Preventing Online Sales of E-Cigarettes to Children Act extends similar USPS delivery restrictions to electronic nicotine delivery systems.
