To fight a Maryland speed camera ticket, request a District Court trial within 30 days of the mailing date and build your defense around one of four openings: you were not the driver, the citation is missing required information, the camera’s calibration or operator records are incomplete, or the location lacked proper warning signs. The maximum fine is $40, no points attach to your license, and the violation cannot be recorded on your driving record.1Maryland General Assembly. Maryland Code Transportation 21-809 That keeps the stakes low, but the same statute that caps the penalty also gives you the tools to contest it.
Request Your Trial Within 30 Days
Payment is due within 30 days of the date the citation was mailed.2Maryland Courts. Traffic If you plan to contest, your trial request has to be in before that window closes. The citation itself includes a request form, usually at the bottom, along with the mailing address and instructions. For work zone citations run through the SafeZones program, the signed form must be returned at least five days before the due date printed on the citation.3Maryland SafeZones. Frequently Asked Questions You can also submit a not-guilty plea and request a hearing through the Maryland Online Resolutions system. The court then mails you a notice with a date and time.
At the hearing, the burden sits with the jurisdiction. Bring everything you have: the citation, the photograph, any records you’ve requested from the issuing agency, photos of the location, and any documentation supporting your defense. The court can consider any evidence it finds relevant, so the door is wider than the specific defenses listed in the statute.
Defense: Someone Else Was Driving
Speed camera citations go to the vehicle’s registered owner, not the driver. If you were not behind the wheel, ยง 21-809(f)(3) lets you challenge on that basis. You send a sworn or affirmed letter to the District Court by certified mail, return receipt requested, stating that you were not operating the vehicle at the time of the violation, and you include any corroborating evidence.1Maryland General Assembly. Maryland Code Transportation 21-809
You are not required to name the actual driver. Establishing that you were not driving is enough. If you do identify the driver, the court clerk forwards that information to the issuing agency, which can mail a new citation to that person within two weeks.1Maryland General Assembly. Maryland Code Transportation 21-809 Worth thinking about before naming a family member or friend.
The same subsection covers stolen vehicles and stolen plates. A timely police report showing the car or tags were not in your possession at the time of the violation is a complete defense.
Defense: The Citation Is Missing Required Information
Every valid speed camera citation must include your name and address, the vehicle’s registration number, the violation charged, the location, date, and time of the violation, a copy of the recorded image, the penalty amount, and a signed statement from a law enforcement officer or authorized technician confirming the violation based on the image.1Maryland General Assembly. Maryland Code Transportation 21-809 A citation missing any of those elements is defective.
Compare the citation against the photograph carefully. If the license plate in the image is unreadable, or the plate number in the image does not match the plate number printed on the citation, the statute explicitly defines that mismatch as an erroneous violation.1Maryland General Assembly. Maryland Code Transportation 21-809 Check the timestamp against the authorized enforcement window as well. School zone cameras only operate Monday through Friday, 6 a.m. to 8 p.m.4MDOT State Highway Administration. Automated Speed Enforcement School Zones A ticket stamped on a Saturday or at 9 p.m. on a weekday is captured outside authorized hours, which the statute lists as an erroneous violation.
Also confirm the sworn statement from the officer or technician is present. Without that attestation, the state has not met the minimum the statute requires.
Defense: Request the Equipment Records
Three separate documents have to exist before a speed camera citation is enforceable, and each one is admissible in court. Requesting them from the issuing agency before your hearing is one of the strongest preparation steps available.
- A daily set-up log, signed by the camera operator, confirming that the manufacturer-specified self-test was completed successfully before the system captured any images that day.1Maryland General Assembly. Maryland Code Transportation 21-809
- An annual calibration certificate, issued by an independent laboratory that is not affiliated with the camera manufacturer. If the certificate is expired on the date of your violation, the statute defines the citation as an erroneous violation.1Maryland General Assembly. Maryland Code Transportation 21-809
- A signed training certificate showing the operator who set up the system completed manufacturer training.1Maryland General Assembly. Maryland Code Transportation 21-809
If the jurisdiction cannot produce the daily log for your violation date, a current calibration certificate, or the operator’s training certificate, the state’s proof that the system was accurate weakens. That gap is something you can raise directly at the hearing.
Defense: Warning Signs Were Missing or Improper
Drivers have to be given notice before entering an automated enforcement zone. Signs must alert motorists that speed cameras are active, and on state highways the signage has to conform to MDOT SHA specifications, identifying the roadway as a school zone, displaying the posted speed limit, and noting the presence of the camera system.4MDOT State Highway Administration. Automated Speed Enforcement School Zones
If the location where you were cited had no visible warning signs, or the signs were blocked, obscured by vegetation, or placed after the camera instead of before it, that is a viable challenge. Photograph the location as soon as possible after receiving the citation so the condition of the signage on a date close to the violation is preserved. Non-compliant signage undermines the argument that you had fair notice.
Where and When Cameras Can Fire
Maryland speed cameras only operate in school zones and highway work zones, and the system can only capture vehicles traveling at least 12 miles per hour above the posted speed limit.1Maryland General Assembly. Maryland Code Transportation 21-809 If you were doing 10 or 11 over, the camera should not have triggered. That 12 mph threshold is written into the statutory definition of a speed monitoring system, so a citation issued below it is defective on its face. The same threshold applies to work zone cameras run through SafeZones.3Maryland SafeZones. Frequently Asked Questions
What Happens If You Ignore the Ticket
A $40 citation grows quickly if left alone, which is why filing a timely trial request beats simply not paying.
- Days 0 to 30: the original $40 fine is due.
- Days 31 to 60: a second notice arrives with a 30-day extension. No added fees yet.
- Days 61 to 90: a third notice goes out. For Maryland-plated vehicles, MDOT MVA places a non-renewal flag on your registration, meaning you cannot renew until the ticket is resolved, and the MVA adds a $30 fee payable separately.3Maryland SafeZones. Frequently Asked Questions
- After 90 days: the unpaid citation goes to the State of Maryland Central Collection Unit, which adds a 17% collection fee on top of the unpaid balance.3Maryland SafeZones. Frequently Asked Questions
The registration hold is the sharpest edge. Multiple unpaid citations can sit quietly until the moment you try to renew your tags, and then everything has to be cleared before the MVA will process the renewal. Filing your trial request inside the 30-day window keeps that door closed.
