Why Your Refund Might Be Delayed

Disputing an Offset

If you think the debt behind an offset is wrong, you dispute it with the CCU, not the Comptroller. The Comptroller runs the mechanical intercept; the CCU controls the underlying debt. You have 15 days from receiving the intercept notice to request an investigation into whether the debt is valid or the amount is right.7Legal Information Institute. Md. The CCU will investigate and issue a determination. If they rule against you, you can request a formal administrative hearing, which is subject to judicial review under Maryland’s Administrative Procedure Act.5Legal Information Institute. Md. Injured Spouse Relief on a Joint Return

If you filed a joint Maryland return and your refund was intercepted because of your spouse’s debt, you may be able to recover your share by filing Maryland Form 502INJ, which lets you claim the portion of the refund tied to your income and withholding. If you file Form 502INJ, you cannot also split the refund into multiple accounts using Form 588.
