Massachusetts 1099-NEC Filing Requirements and Deadlines

If you issued a federal Form 1099-NEC for work done by a Massachusetts contractor or vendor, the Massachusetts 1099-NEC filing requirements obligate you to send a copy directly to the state Department of Revenue by January 31, the same day the federal form is due. Filing with the IRS does not cover you, even though Massachusetts participates in the Combined Federal/State Filing Program. Who Has to File

Any payer who issued a federal 1099-NEC reporting $600 or more in non-employee compensation must send a copy to the Massachusetts DOR. The state threshold tracks the federal one, so any payment that triggered a federal 1099-NEC triggers a state filing too. Non-employee compensation means payments to independent contractors, freelancers, and vendors for services in a trade or business. You generally do not file a 1099-NEC for payments to C corporations or S corporations, including LLCs taxed as either. The exception that trips people up is legal services: payments to attorneys go on a 1099-NEC no matter what corporate form the law firm takes.2Internal Revenue Service. Why the Federal Filing Doesn’t Cover You

Massachusetts is a Combined Federal/State Filing state, which sounds like the IRS forwards your data automatically. For the 1099-NEC, it doesn’t. The DOR explicitly requires direct submission of 1099-NEC forms regardless of CF/SF participation, and the same rule applies to Forms 1099-MISC, 1099-DIV, 1099-INT, 1099-K, and 1099-R.3Massachusetts Department of Revenue. The January 31 Deadline

Form 1099-NEC is due to the Massachusetts DOR by January 31, the same date the federal form is due and the same date you must furnish copies to recipients.1Massachusetts Department of Revenue. Massachusetts recognizes automatic federal extensions of time to file.1Massachusetts Department of Revenue. Massachusetts Form 1099 Filing Requirements The catch is that the IRS does not grant automatic extensions for the 1099-NEC. To get any federal extension on a 1099-NEC you must file a paper Form 8809 by January 31 with a written explanation, and the IRS has to approve it. If approved, you get one 30-day extension, and that’s the ceiling.4Internal Revenue Service. Form 8809 Application for Extension of Time To File Information Returns Plan as if January 31 is firm.

How to File

Massachusetts requires electronic filing from any payer submitting 50 or more forms in the 1099 series during the year.5Massachusetts Department of Revenue. DOR E-filing and Payment Requirements Below that threshold, the DOR still prefers electronic submission. The state’s portal is MassTaxConnect.

The federal e-file threshold is much lower. The IRS requires electronic filing when you submit 10 or more information returns across all form types combined for the year, aggregating every 1099, W-2G, 1098, and similar form.6Internal Revenue Service. General Instructions for Certain Information Returns Most businesses that file any meaningful number of 1099-NECs will already be e-filing federally, so it’s simplest to e-file with Massachusetts too.

Paper filing is only permitted if you’re submitting fewer than 50 returns. Paper filers send the state copy of the 1099-NEC with federal Form 1096 to:

Get the TIN Before You Pay

Collecting an accurate Taxpayer Identification Number before you cut the first check is the piece of the process that quietly saves you the most trouble. If a payee doesn’t give you a correct TIN, federal rules require backup withholding at 24% on future payments to that person, and once triggered it isn’t optional.7Internal Revenue Service. Backup Withholding Ask every contractor for a completed W-9 before the first payment. If your volume warrants it, verify the name-TIN combination through the IRS TIN Matching program.

Any backup withholding you did goes in the appropriate box on the 1099-NEC and flows through to the Massachusetts copy, since the state form mirrors the federal one.

Correcting a Filed Form

Found an error after submission? File a corrected form. Electronic filers correct through MassTaxConnect using the same data format as the original, with the file flagged as an amendment.5Massachusetts Department of Revenue. DOR E-filing and Payment Requirements

Federally, a de minimis safe harbor may spare you the correction. If the difference between what you reported and the correct amount is $100 or less, or $25 or less for a withholding amount, the IRS treats the original return as correct.8Federal Register. De Minimis Error Safe Harbor Exceptions to Penalties for Failure To File Correct Information Returns or Furnish Correct Payee Statements The safe harbor doesn’t apply if the recipient asks for a corrected statement, and it addresses federal penalties, not the state filing. Correct the Massachusetts side promptly either way.

What Late or Wrong Filings Cost

Massachusetts and the IRS each impose their own penalties. Both can hit you for the same failure.

Massachusetts

Under Massachusetts General Laws Chapter 62C, Section 33(g), the DOR can penalize a payer up to $100 for each return, document, or data transmission not filed in the prescribed electronic format.9Massachusetts Department of Revenue. TIR 04-12 Penalty for Failure to File, Report or Pay in the Prescribed Format The penalty may be waived for reasonable cause where the failure was not due to willful neglect. Chapter 62C gives the DOR broader authority to penalize late or missing filings and to pursue criminal penalties for willfully false statements. If you get a penalty notice, respond quickly and document what caused the delay.

Federal

Federal penalties for information returns due in 2026 scale with how late you are:10Internal Revenue Service. 20.1.7 Information Return Penalties

  • Filed within 30 days of the deadline: $60 per return, with annual caps of $683,000 (or $239,000 for small businesses with gross receipts of $5 million or less)
  • Filed after 30 days but by August 1: $130 per return, capped at $2,049,000 ($683,000 for small businesses)
  • Filed after August 1 or not at all: $340 per return, capped at $4,098,500 ($1,366,000 for small businesses)
  • Intentional disregard: $680 per return with no cap

These penalties apply to both filing with the IRS and furnishing statements to recipients, so a single missed 1099-NEC can carry two penalty tracks. If you’ve already missed January 31, a late filing still costs less than no filing.

How Long to Keep the Records

Massachusetts requires records tied to your tax filings for at least three years after the return’s due date or your actual filing date, whichever comes later.11Massachusetts Department of Revenue. 830 CMR 62C.25.1 Record Retention The three-year floor extends indefinitely if the DOR suspects fraud or you never filed a required return. Four years of retention on 1099-NEC records, W-9s, payment records, and contracts gives you a workable buffer if a recipient later disputes what you reported or the DOR asks you to substantiate a filing.
