To operate a small vehicle transporting school pupils in Massachusetts, you must meet the 7D vehicle requirements under Massachusetts General Laws Chapter 90, Section 7D: the vehicle carries no more than eight passengers plus the operator, holds a 7D registration with distinctive pupil plates, carries a specific equipment list, passes a safety inspection twice a year, and is driven by someone holding a separate 7D driver certificate issued by the Registry of Motor Vehicles.1General Court of Massachusetts. What Counts as a 7D Vehicle
A 7D vehicle is a motor vehicle carrying no more than eight passengers in addition to the operator, used in the business of transporting school pupils for hire under a contract or other arrangement.1General Court of Massachusetts. Not every vehicle carrying students needs a 7D. The statute exempts vehicles carrying up to fourteen passengers when the driver is an uncompensated parent or a person chosen by all the passengers’ parents, and it exempts vehicles used by a private school, childcare center, camp, or special needs program for activities that don’t follow a fixed daily route.1General Court of Massachusetts. The seat belt requirement still applies even when the vehicle is exempt from 7D itself.
Registering the Vehicle
The RMV runs 7D registrations through two online portals. A business first registers as a new business partner on the Community Portal for document submission, which takes roughly five to seven business days to approve. Once approved, the business designates at least one eServices Administrator who manages access to the eServices Portal, where you view vehicles, renew or cancel registrations, replace titles, and update garaging addresses.3Massachusetts Registry of Motor Vehicles. There is no fee to participate in the 7D program itself.3Massachusetts Registry of Motor Vehicles. Required Equipment
The equipment list goes well beyond what a standard passenger vehicle carries. The RMV’s pre-trip inspection form specifies each item that must be present and functional before the vehicle leaves the lot:4Mass.gov. Pre-Trip Inspection for School Pupil (7D) Drivers
- Seat belts at every seating position, including child seats or booster seats where needed
- Front and rear alternating flashing lights, both red and amber school bus signal lamps
- An interior school bus light indicator visible to the driver whenever the exterior lights are active
- An audible back-up alarm
- A fire extinguisher rated 2A10BC or higher, mounted within reach of the driver
- A first aid kit and a body fluid clean-up kit
- Two chock blocks and three reflective triangles
- A seat belt cutter in the driver’s compartment
- Front and rear pupil plates and current registration
- A child reminder system on any vehicle of model year 2018 or newer
- A fire and evacuation blanket on wheelchair-equipped vehicles
The child reminder system requirement catches some operators off guard: any 7D vehicle built in 2018 or later must have one, designed to prevent a child from being left on the vehicle. Wheelchair-equipped vehicles must also have a working wheelchair lift that gets inspected along with the rest of the vehicle. Under the standards those lifts must meet, the lift handles a minimum 600-pound load and accommodates a wheelchair measuring 30 by 48 inches, and vehicles 22 feet and under need at least one wheelchair securement location.5Federal Transit Administration. Inspections
7D vehicles carry two layers of inspection.
Semi-Annual Station Inspection
The vehicle must be inspected twice per year at a licensed Safety Inspection Station under 540 CMR 21.00.6Mass.gov. 540 CMR 21.00 – Semiannual Safety Inspection of School Pupil Transport Vehicles Inspectors evaluate service and parking brakes, steering, every light on the vehicle (headlights, directionals, stop lights, reverse lights, four-way flashers, license plate light, and the school bus light system), tires with a minimum tread depth of 4/32 inch, mirrors, exhaust, fluid leaks, doors, wipers, horn, and structural condition. A passing vehicle gets a semi-annual 7D inspection sticker. Daily Pre-Trip Inspection
Before each day of operation, the driver runs through the RMV’s pre-trip checklist, covering the same mechanical components as the station inspection plus confirmation that all required equipment is present and working. Operators complete one inspection sheet per day per vehicle and keep the records available for RMV audits.4Mass.gov. Seat Belts Are Mandatory for Everyone
No person may operate a 7D vehicle, and no passenger may ride in one, unless the operator and all passengers are wearing a properly adjusted and fastened safety belt.1General Court of Massachusetts. Flashing Lights and Loading
The flashing light system works the same way it does on a full-size school bus. Approaching a stop to pick up or discharge students, the driver activates the alternating amber warning lights. Once stopped and students are boarding or exiting, the red signal lights must flash continuously and stay on until every passenger is seated and buckled.7Mass.gov. When students need to cross the road during unloading, the driver is responsible for their safety and must have them cross in front of the vehicle while the red lights are active. Using the flashing red lights for any purpose other than loading or discharging pupils is prohibited.7Mass.gov. Guide to School Pupil Transport Vehicles (7D) The interior indicator lamp gives the driver a continuous visual warning whenever the exterior lights are on.
Driver Certificate Requirements
Every 7D driver holds a separate certificate from the RMV. It is not a license endorsement. To apply, the driver must:
- Be at least 21 years old and hold a valid Class A, B, C, or D driver’s license for the three continuous years immediately before applying
- Pass both a Criminal Offender Record Information (CORI) check and a Sex Offender Registry Information (SORI) check
- Complete two hours of pre-service training through the prospective employer, approved by the Registrar
- Pass a written knowledge test, an eye exam, and a physical examination
- Have a satisfactory driving record
A one-year certificate costs $15. Drivers over 70 who are insulin-dependent diabetic or have had a hypoglycemic episode receive a six-month certificate for $7.50 instead.9Mass.gov. Automatic Disqualifications
Some criminal history is a permanent bar. Anyone classified as a sex offender under Section 178C of Chapter 6, and anyone convicted of the use, sale, manufacture, distribution, or trafficking of controlled substances under Chapter 94C, cannot hold a 7D certificate. A conviction for operating under the influence of alcohol or drugs within the preceding five years also disqualifies an applicant, and a disposition under Section 24D (the alternative disposition for a first-offense OUI) counts as a conviction for 7D purposes.10General Court of Massachusetts. Renewal Training
Renewal takes more training than the initial certificate. Since July 1, 2020, every renewal applicant must complete eight hours of in-service training before the RMV will issue a new certificate.11Mass.gov. Insurance
A standard personal auto policy will not cover a 7D operation. Most personal policies exclude any vehicle used as a livery conveyance or for commercial passenger transport, and a 7D vehicle falls squarely within that exclusion. Operators need a commercial auto policy written for passenger transportation, and premiums for small student transport operations commonly run into the thousands of dollars per year depending on fleet size, location, and claims history. Beyond Massachusetts compulsory bodily injury and property damage minimums, operators should look at uninsured and underinsured motorist coverage and higher liability limits given the passengers involved.
Penalties for Non-Compliance
Section 7D applies the equipment and operational requirements of Section 7B to 7D vehicles, and violations carry consequences at both the vehicle and driver level.1General Court of Massachusetts. Drivers who skip pre-trip inspections, operate without a valid certificate, or allow unbuckled passengers face suspension or revocation of their 7D certificate.8Massachusetts Registry of Motor Vehicles. Apply for a School Pupil Transport (7D) Drivers Certificate Because the RMV requires a satisfactory driving record as a condition of holding the certificate, ordinary traffic violations can independently threaten eligibility. Beyond direct penalties, a compliance gap creates a straightforward negligence argument in any lawsuit following an incident, which is why operators treat the pre-trip inspection sheet and the driver certificate file as records worth keeping cleanly.
