Massachusetts smoke and carbon monoxide detector requirements are set by M.G.L. c. 148, §§ 26F and 26F½, and what your home needs depends on when it was built. The type of alarm, whether it must be hardwired, whether alarms must talk to each other, and whether battery backup is required all shift with the construction date. Smoke Alarm Rules by Construction Date
Massachusetts groups homes into three construction eras, and each carries its own standard.
- Homes permitted before 1975 can use battery-powered alarms, hardwired alarms, or a mix. Interconnection is not required.
- Homes permitted between 1975 and August 27, 1997 must have hardwired alarms that are interconnected, so one alarm sounding sets off every alarm in the house.
- Homes permitted after August 27, 1997 must have hardwired, interconnected alarms with battery backup.
Battery-only units will not pass an inspection in any home built after 1975. Wireless interconnection is acceptable in any era, but in post-1975 homes the alarms still need primary power from the home’s wiring; wireless linking does not let you fall back to batteries.2Sturbridge Fire Department. One rule catches many owners off guard. Post-1975 homes must have a smoke alarm inside every bedroom, not just outside sleeping areas. Photoelectric Sensors Near Kitchens and Bathrooms
Any smoke alarm installed within 20 feet of a kitchen or a bathroom containing a bathtub or shower must use photoelectric sensing technology. Ionization alarms are only allowed more than 20 feet from those rooms. Combination alarms that include both technologies can go anywhere as long as the photoelectric component covers the 20-foot zone. Carbon Monoxide Alarms Under Nicole’s Law
M.G.L. c. 148, § 26F½, known as Nicole’s Law, requires carbon monoxide alarms in every home that has fuel-burning equipment or an attached garage.3Commonwealth of Massachusetts. An attached or enclosed garage also qualifies your home even if the living space itself has no combustion source.
CO alarms must be installed on every habitable level of the home and outside each sleeping area. On levels with bedrooms, an alarm must sit within 10 feet of each bedroom door.5Mass.gov. Large apartment buildings where individual units don’t contain combustion equipment can use an alternative detection method, typically monitoring near the boiler room or shared garage rather than inside every unit.5Mass.gov. Smoke and Carbon Monoxide Alarms
Where Alarms Have to Go
Smoke alarms are required on every habitable level, including finished attics and basements. You also need one at the ceiling at the base of each stairway and outside every sleeping area. Both smoke and CO alarms must sit within 10 feet of every bedroom door. Wall-mounted units must be between 4 and 12 inches from the ceiling so they stay in the path of rising smoke and gases.3Commonwealth of Massachusetts. Alarms must be at least 36 inches from HVAC supply vents, ceiling fan blade tips, and bathroom doors. Moving air can push smoke away from the sensor and delay detection. Corners and dead air spaces should also be avoided.
Heat Detectors in Attached Garages
Homes permitted after January 1, 2008 with an attached garage, or a garage with living space above it, must have a heat detector in the garage rather than a smoke alarm. A standard smoke alarm would trigger constantly from exhaust and temperature swings. The heat detector must be hardwired and interconnected with the home’s smoke alarm system.
Replacing Expired Alarms
Smoke alarms must be replaced after 10 years. Most units have a manufacture date printed on the back; if the date is missing or the alarm is older than a decade, replace it.6Mass.gov. Carbon monoxide alarms have a lifespan of seven to 10 years depending on the model. When a CO alarm reaches end-of-life, it typically emits a repeating beep pattern different from its emergency alert. That signal means the sensor can no longer reliably detect carbon monoxide and the unit needs replacing, not a new battery.
An expired alarm will fail a certificate of compliance inspection. Before scheduling a fire department visit, check the dates on every unit; replacing a few alarms is cheaper than paying for a re-inspection.
Certificate of Compliance Before You Sell
You cannot sell or transfer a residential property of one to five units in Massachusetts without a certificate of compliance from the local fire department. Contact your local fire department and schedule the inspection well before closing. An inspector walks the entire home, tests each device, checks placement distances, and verifies that power source and interconnection match the standard for the home’s construction date.7Department of Fire Services. A passing inspection produces a certificate that remains valid for 60 days.8Quincy Fire Department. Inspection fees vary by municipality; expect roughly $50 for a single-family home and more for multi-unit properties, and call your local department for exact pricing.7Department of Fire Services. If the property fails, you’ll need to bring everything up to code and schedule a re-inspection, which may cost an additional fee. Missing the certificate can delay or derail a closing.
Landlord and Tenant Responsibilities
Landlords carry the primary duty. Massachusetts law requires them to install and maintain both smoke and carbon monoxide alarms in every dwelling unit, meet the specifications for the building’s construction date, replace expired units, and repair hardwired systems when they fail.5Mass.gov. Tenants handle day-to-day upkeep: testing alarms, replacing batteries in units that use replaceable batteries, and notifying the landlord when a device malfunctions or reaches end-of-life. A landlord who fails to maintain working alarms faces potential civil liability if a tenant is injured in a fire where faulty or missing detectors contributed to the harm. Records of installation dates, maintenance, and tenant notifications about malfunctioning equipment are far more persuasive in a dispute than verbal assurances.
