Massachusetts Paid Family and Medical Leave (PFML) is a state program that replaces part of your paycheck and protects your job when you need time off for your own serious illness, a new child, a sick family member, or certain military-related situations. The maximum weekly benefit for 2026 is $1,230.39.1Mass.gov. How PFML Weekly Benefit Amounts Are Calculated and/or Changed The Department of Family and Medical Leave (DFML) runs the program, which is funded by payroll contributions from employers and workers.
Who Qualifies
Most W-2 employees of Massachusetts businesses are covered automatically. Your employer withholds PFML contributions from your paycheck and reports your wages to the DFML every quarter. If your employer offers an approved private plan that meets or beats the state benefit, that plan replaces the public fund, but you still have coverage.
Benefits require a minimum amount of earnings in your base period, which is the last four completed calendar quarters. The threshold adjusts yearly using a formula tied to 30 times the PFML weekly benefit amount. For 2025, you needed at least $6,300 in total base-period wages. Full-time, part-time, and seasonal work all count toward that floor.
Self-employed people can opt in, but once you do, you have to stay in and keep paying for at least three years. If you receive 1099-MISC income from a business where contractors make up at least half the workforce, that business must cover you. If contractors make up less than half and the business doesn’t cover you, you can opt in on your own.2Mass.gov. Paid Family and Medical Leave Coverage for Self-Employed Individuals
Federal employees, most municipal employees, and independent contractors who haven’t opted in or been covered by a hiring business are the main groups left out.
Reasons You Can Take Leave
You can take up to 26 weeks of combined family and medical leave in a single benefit year, with separate caps for each type:3Mass.gov. Paid Family and Medical Leave (PFML) Overview and Benefits
- Up to 20 weeks of medical leave for your own serious health condition.
- Up to 12 weeks of family leave to bond with a new child in the first 12 months after birth, adoption, or foster placement.
- Up to 12 weeks of family leave to care for a family member with a serious health condition.
- Up to 26 weeks to care for a family member who is a covered service member with a serious injury or illness sustained or aggravated during active duty.
- Up to 12 weeks for a qualifying exigency arising from a family member’s active-duty deployment.4Mass.gov. PFML: About Leave for Family Members of Covered Military Personnel
You can mix leave types in the same benefit year, but the 26-week ceiling still applies. “Family member” is defined broadly: spouses, domestic partners, children, parents, parents of a spouse or domestic partner, grandchildren, grandparents, and siblings.
Taking Leave in Smaller Blocks
Medical leave, family caregiving leave, and military-related leave can be taken intermittently or on a reduced schedule. The minimum increment is one hour, and the DFML tracks time in 15-minute multiples; nothing under 15 minutes gets paid.5Mass.gov. Latest Guidance from the Department of Family and Medical Leave You can’t submit a claim for intermittent benefits until you’ve accumulated at least eight hours of leave, unless more than 30 days have passed since you started taking it. Bonding leave on an intermittent or reduced schedule requires your employer’s agreement.
What You’ll Get Paid
Your weekly benefit comes from your individual average weekly wage (IAWW) measured against the state average weekly wage (SAWW), which is $1,922.48 for 2026. The formula has two tiers:1Mass.gov. How PFML Weekly Benefit Amounts Are Calculated and/or Changed
- The portion of your IAWW at or below 50% of the SAWW ($961.24) is replaced at 80%.
- Anything above that line is replaced at 50%.
The total is capped at 64% of the SAWW, which puts the 2026 maximum at $1,230.39. As an example, if your average weekly wage is $1,000, the first $961.24 is replaced at 80% ($769.00) and the remaining $38.76 at 50% ($19.38), for a weekly benefit of about $788. Higher earners hit the cap.
The Seven-Day Waiting Period
Benefits don’t start on day one. The first seven calendar days of your leave are unpaid, and they still count against your total available leave time.6General Court of Massachusetts. Acts of 2018 Chapter 121 You can use accrued sick time, vacation, or other employer-provided paid leave to cover that week.
One exception: if you take medical leave duringpregnancy or childbirth and move straight into family leave for bonding, the waiting period for the bonding portion is waived. Your job protection and health insurance stay in force even during the waiting week.
How to Apply
Before you log into the DFML portal, pull together:7Mass.gov. Get Ready to Apply for Paid Family and Medical Leave (PFML) Benefits
- Your Social Security Number or Individual Taxpayer Identification Number.
- Your employer’s federal Employer Identification Number, which appears on your W-2 or 1099-MISC.
- Your planned leave start and end dates.
For medical leave, your healthcare provider has to complete the Certification of Your Serious Health Condition form, available on the DFML website. The provider’s answers feed directly into parts of the online application, so get it filled out before you start. Bonding leave requires proof of birth or documentation of adoption or foster placement. Military-related leave calls for deployment orders or other active-duty documentation.
Applications go through the online portal at paidleave.mass.gov. The system walks you through a multi-screen questionnaire and gives you a secure link to upload documents. If you don’t have internet access, call the DFML Contact Center at (833) 344-7365.8Mass.gov. How to Apply for Paid Family and Medical Leave Keep digital copies of everything you submit.
What Happens After You Apply
Within five business days of receiving your completed application, the DFML notifies your employer, who then has 10 business days to respond or contest the claim.9Mass.gov. Paid Family and Medical Leave (PFML) Application Approval Timeline Once the DFML has everything, it aims to issue a decision within 14 calendar days. Watch your online dashboard and your mail during that stretch, since the department reaches out directly if something is missing. Approved benefits are paid weekly by direct deposit or check, whichever you selected.
If Your Claim Is Denied
You have 10 calendar days from receiving a denial to file an appeal. You can appeal online, by phone, by fax, or by mail.10Mass.gov. Paid Family and Medical Leave (PFML) Appeals Timeline A late appeal may still be accepted if the delay was caused by something outside your control, such as a health crisis or a language barrier.
The DFML reviews your case within 30 days of filing. An appeals representative may try to resolve the dispute informally; if that fails, the department schedules a virtual hearing, usually two to four weeks out, with at least 10 days’ advance notice. A new decision follows within 30 days of the hearing. If you disagree with that outcome, you can file a complaint in your local District Court within 30 days. If your employer uses an approved private plan and the carrier denies your claim, appeal through the carrier first; you can only bring the matter to the DFML after the carrier upholds the denial.
Your Job While You’re Out
When you come back from PFML leave, your employer has to put you in the same position or an equivalent one, with the same pay, benefits, seniority, and length-of-service credit you had when you left.11General Court of Massachusetts. Massachusetts General Laws Chapter 175M – Section 2 The one exception is if employees with the same seniority and status were laid off during your absence for economic reasons; even then, you keep any preferential consideration for other positions you had before leaving.
Your health insurance keeps running at the same level and under the same conditions as if you were still at work. You also continue accruing vacation, sick leave, seniority, and other benefits during the leave. Self-employed workers and certain former employees who draw benefits don’t get these job-protection rights, since there’s no employer-employee relationship to restore.
Retaliation Is Presumed
Any negative change to your pay, seniority, status, or working conditions during your leave or within six months after you return is presumed to be retaliation. That shifts the burden to your employer, who must show by clear and convincing evidence that the action was independently justified and would have happened anyway.12General Court of Massachusetts. Massachusetts General Laws Chapter 175M – Section 9 Clear and convincing evidence is a high bar, well above what employers face in most employment disputes. The protection also covers workers who file complaints, participate in proceedings, or provide information in a PFML investigation, and employers can’t use attendance policies to punish you for PFML time. Retaliation claims are enforced through a lawsuit in Superior Court, not through the DFML.
How PFML Lines Up With Federal FMLA
If you qualify for both Massachusetts PFML and federal FMLA, the two programs run at the same time. They do not stack.13Mass.gov. PFML Frequently Asked Questions for Employees FMLA provides up to 12 weeks of unpaid, job-protected leave at employers with 50 or more employees. PFML adds the paycheck replacement that FMLA lacks and reaches a broader set of family relationships. When the two overlap, your employer counts the time against both at once.
PFML also covers situations FMLA doesn’t, including leave for domestic partners, grandparents, grandchildren, and siblings. If you work for a small employer with fewer than 50 employees, you likely won’t qualify for FMLA but may still be eligible for PFML.
How Your Benefits Are Taxed
Tax treatment depends on the type of leave and your employer’s size:14Mass.gov. Paid Family and Medical Leave (PFML) Tax Information for Employers
- Family leave benefits are fully taxable for both federal and Massachusetts state income tax.
- If your employer has 25 or more employees, 60% of your medical leave benefits are taxable federally and by the state.
- If your employer has fewer than 25 employees, your medical leave benefits are not taxable.
The DFML reports the taxable portion on Form 1099-G, which it sends you. You can elect to have federal and state income taxes withheld from your weekly payments, which prevents a surprise bill in April.
What You Pay In
Contributions come out of eligible wages up to the Social Security taxable maximum, which is $184,500 for 2026. At employers with 25 or more covered workers, the combined rate is 0.88%. Your employer can withhold up to all 0.18% of the family leave portion and up to 40% of the 0.70% medical leave portion (0.28%) from your pay; the employer covers the remaining 60% of the medical piece.15Mass.gov. Paid Family and Medical Leave Employer Contribution Rates and Calculator At employers with fewer than 25 covered workers, the combined rate is 0.46% and the entire amount can come out of your paycheck. If you earn $70,000 at a large employer, your share runs about $322 a year.
