Massachusetts PFML: Eligibility, Weekly Benefit, and Job Protection

Massachusetts Paid Family and Medical Leave, known as PFML, pays part of your wages when you need time off for your own serious health condition, to bond with a new child, to care for a family member, or to handle needs tied to a family member’s military service. For 2026, the maximum weekly benefit is $1,230.39, and you can take up to 26 total weeks of paid, job-protected leave in a benefit year. Most people working in Massachusetts are covered regardless of their employer’s size.

Who Qualifies

Eligibility turns on your recent earnings in Massachusetts, not your hours or how long you’ve been at your current job. You must have earned at least $6,300 during the last four completed calendar quarters, and that total must also equal at least 30 times the weekly unemployment benefit you’d otherwise be entitled to.1Mass.gov. Most W-2 employees at Massachusetts businesses are automatically covered. What Leave You Can Take and for How Long

PFML covers four categories of leave: your own serious health condition, bonding with a child during the first 12 months after birth, adoption, or foster placement, caring for a family member with a serious health condition, and needs arising from a family member’s active-duty military service.5Mass.gov. The caps depend on the reason:

  • Up to 20 weeks per benefit year for your own serious health condition
  • Up to 12 weeks per benefit year for bonding or caring for a family member
  • Up to 26 weeks per benefit year to care for a covered service member

“Family member” is defined broadly. It includes spouses and domestic partners; children, stepchildren, and a domestic partner’s children; parents, stepparents, parents-in-law, and a parent’s domestic partner; grandparents and grandchildren, including step-relations; and siblings, including step-siblings. How Your Weekly Payment Is Calculated

The state uses a two-tier formula. For 2026, the state average weekly wage is $1,922.48. The portion of your individual average weekly wage at or below 50% of that figure ($961.24) is replaced at 80%. Any portion above that threshold is replaced at 50%.9Mass.gov. An example: if your average weekly wage is $1,500, the first $961.24 is replaced at 80% ($769.00) and the remaining $538.76 at 50% ($269.38), for roughly $1,038 a week. Higher earners hit the $1,230.39 cap.

How to Apply

Then file through the Department of Family and Medical Leave’s online portal. You can submit up to 60 calendar days before your leave’s anticipated start date, but no earlier. Documentation depends on the type of leave. Medical leave requires a Certification of Your Serious Health Condition form completed by you and your healthcare provider; the Department also accepts federal FMLA certification forms, but other documentation may cause delays or denials. Job Protection and Retaliation

When you return, your employer must restore you to the same position, or an equivalent one with the same pay, benefits, seniority, and length-of-service credit. Two narrow exceptions apply: layoffs of similar roles for economic reasons during your absence, or a term or project position that ended while you were out.14Mass.gov. If your employer threatens, retaliates against, or fires you for taking or requesting PFML, you can file a civil lawsuit within three years. A court can order reinstatement, restore benefits and seniority, and award three times your lost wages plus interest, along with your attorney’s fees and court costs.16General Court of Massachusetts. What Comes Out of Your Paycheck

PFML is funded through a payroll contribution of 0.88% of eligible wages at employers with 25 or more covered individuals. The family leave portion (0.18%) can be withheld from employees in full. Employers must pay at least 60% of the medical leave portion themselves, and the remaining 0.28% can be withheld from employees. At employers with fewer than 25 covered individuals, the effective rate is 0.46%, and all of it can be withheld from employee wages, though some smaller employers voluntarily cover part.17Mass.gov. Taxes on Your Benefits

PFML benefits are subject to federal and Massachusetts income tax, but the taxable portion depends on the type of leave and your employer’s size. Family leave benefits are 100% taxable regardless of employer size. Medical leave benefits are 60% taxable if your employer has 25 or more covered individuals, and not taxable if your employer has fewer than 25.18Mass.gov. How PFML Fits With FMLA, PTO, and Short-Term Disability

PFML and the federal Family and Medical Leave Act are separate programs. FMLA is unpaid, job-protected leave; PFML is paid leave with its own job protections. You may be able to top off your PFML benefit with accrued PTO, sick time, or vacation to bring your weekly income up to your full average wage. Whether you can depends on your employer’s policy: employers can allow it but aren’t required to, as long as the restriction isn’t applied in a way that discriminates against people using PFML.

If you have employer-provided short-term disability, your PFML medical leave benefit directly offsets what the disability policy pays, so you won’t collect twice. Short-term disability durations aren’t reduced by unrelated PFML family leave you took earlier in the year.

If Your Claim Is Denied

You have 10 calendar days from the denial notice to file an appeal. If you miss that window, you’ll need to show the delay was beyond your control. If informal review doesn’t resolve it, the Department schedules a hearing, usually two to four weeks after notice, with at least 10 days’ notice before the hearing date. A decision follows within 30 days. If you’re approved at that stage, expect changes within two to four weeks.
