The Massachusetts right to shelter still exists for families: state law guarantees emergency shelter to income-eligible families with children and to pregnant individuals with no other children, provided they became homeless for a qualifying reason, have no feasible alternative housing, and can document Massachusetts residency and lawful immigration status. Stays are now capped at six months, and single adults without children are not covered by this program.
The guarantee sits in Massachusetts General Laws Chapter 23B, Section 30, which directs the Executive Office of Housing and Livable Communities to run the Emergency Assistance (EA) program in a “fair, just and equitable manner” at locations geographically convenient to families who are homeless or at risk of homelessness.1General Court of Massachusetts. Who Qualifies for EA Family Shelter
The EA program serves a specific population: families with at least one child under 21, or pregnant women without other children. Meeting that description is the first gate. Three more follow.
Income
At the time of application, a household’s gross monthly income must be at or below 115% of the federal poverty level, adjusted for household size. If income exceeds that threshold, the application is denied.3Cornell Law School. 760 CMR 67.02 – Program Eligibility
A Qualifying Reason for Homelessness
Being homeless is not enough on its own. Under 760 CMR 67.06, the family must be homeless because of one of the following:
- Domestic violence: the household is at risk of abuse, or fled abuse, and has not had access to safe permanent housing since leaving.
- Fire, flood, or natural disaster that destroyed the home through no fault of the family.
- A no-fault eviction, which includes foreclosure, condemnation, actions by a guest or former household member the family couldn’t control, nonpayment of rent caused by a documented medical condition or disability, or a documented loss of income within the last 12 months.
- A substantial risk of significant harm to the children in the household if the family remains where it is.

Massachusetts Residency and Immigration Status
Every household member must be a Massachusetts resident, and every household member must have lawful immigration status, with limited exemptions.5Mass.gov. How to Apply
Families apply by calling the state’s centralized intake line at (866) 584-0653, Monday through Friday, 8:00 a.m. to 5:00 p.m. A call center representative records contact information and refers the family to a Homeless Coordinator, who takes the application and makes a preliminary eligibility decision.6Mass.gov. Be ready to document income, Massachusetts residency, household composition (including ages of children), and the reason for homelessness. The applicant carries the burden of producing verification, though the state is required to help obtain documents.
One rule about timing matters here. In Garcia v. Executive Office of Housing and Livable Communities (2024), the Massachusetts Supreme Judicial Court held that the state cannot require third-party verification of identity, family relationship, or residency before providing shelter under the immediate placement provision. Families who otherwise qualify must be placed first, with full documentation verified afterward.7Justia Law. Garcia v. How Long You Can Stay
Placement puts a family on one of two tracks:
- Rapid Shelter Track, for families expected to secure housing quickly: 30 business days of shelter with high-intensity case management, job placement, and housing search assistance. Waivers may extend the stay in specific circumstances.
- Bridge Shelter Track, for families with more complex needs: up to six months, with possible extensions or waivers, and ongoing case management, employment and education resources, and stabilization services.

HomeBASE: Cash Instead of a Shelter Bed
Families found eligible for EA shelter may also qualify for HomeBASE, which pays for housing outside the shelter system. HomeBASE provides up to $30,000 over two years. The family pays at least 30% of gross monthly income toward rent, and HomeBASE pays the rest directly to the landlord.9Mass.gov. HomeBASE
Beyond monthly rent, HomeBASE funds can cover first and last month’s rent, a security deposit, broker’s fees, a landlord incentive bonus of up to one month’s rent, up to $5,000 in outstanding rent or utility arrears that are blocking a new lease, $2,500 for essential furniture, and moving expenses. There is no open application. Eligible families are invited to apply based on the EA eligibility determination. Families in non-EA domestic violence shelters and residential treatment programs may also qualify.
If You Are Denied
A notice of denial, termination, noncompliance, or transfer can be appealed to the Division of Hearings, which assigns a case number and schedules a hearing before a neutral decision-maker. You can represent yourself, bring a friend or relative, or find an attorney. Local Legal Services organizations may provide free representation. If English is not your primary language, an interpreter is provided at no cost. A hearing can be rescheduled up to two times for good cause, such as a family emergency or the need to gather more evidence. Missing a third scheduled hearing dismisses the case.10Mass.gov. What This Program Does Not Cover
The EA guarantee runs to families with children and to pregnant individuals with no other children. Single adults without children and unaccompanied youth are not eligible for EA shelter. Massachusetts operates separate shelter resources for individuals and for youth through different funding streams, but those beds do not carry the same statutory entitlement, and access depends on local capacity and program-specific criteria.
