Massachusetts Title Transfer: Deadlines, Sales Tax, and RMV Fees

To complete a Massachusetts title transfer, bring the seller-signed Certificate of Title, a completed Registration and Title Application stamped by your insurance agent, and payment for the $75 title fee plus 6.25% sales tax to an RMV service center. You have ten days from the purchase date to file the application and pay the tax. Miss that window and penalties start accruing.

Documents You Need Before You Go

The Certificate of Title is the core document. On the back, both buyer and seller complete the “Assignment of Title” section: date of sale, purchase price, names and addresses, signatures, and the odometer reading.1Mass.gov. Private Party Car Sales That assignment section serves as your bill of sale and proof the seller transferred ownership.

You also need a Registration and Title Application, sometimes called the RMV-1. This is the form the RMV uses to record the new owner and issue both the registration and a new title.2Mass.gov. Apply for a Registration and Title for a Vehicle Purchased from an Individual

Federal law requires an odometer disclosure whenever a vehicle is transferred. For model year 2011 and newer vehicles, the disclosure is mandatory until the vehicle is at least 20 years old. Model year 2010 and older vehicles fell under the older 10-year exemption, so all of them are exempt now.3eCFR. 49 CFR Part 580 – Odometer Disclosure Requirements The disclosure is usually printed on the title’s assignment section, so you fill it in when signing the title over.

Get Insurance Before Anything Else

Massachusetts will not register or title a vehicle unless you already have active auto insurance. Before going to the RMV, visit a licensed Massachusetts insurance agent. The agent sets up your policy, then stamps and signs your Registration and Title Application to confirm coverage.2Mass.gov. Apply for a Registration and Title for a Vehicle Purchased from an Individual Without that stamp, the RMV will send you away. Make sure the insurance effective date is on or before the registration date.

The Ten-Day Deadline

Massachusetts law requires the buyer to submit the title and application to the registrar “promptly” after delivery.4General Court of Massachusetts. Massachusetts General Laws Chapter 90D Section 15 The sales tax regulation pins that down: the application must be filed and the sales or use tax paid within ten days of the purchase date.5Mass.gov. 830 CMR 62C.16.2 – Sales and Use Tax Returns and Payments

Late filing brings a penalty of 1% of the tax per month, plus another 0.5% per month for late payment, each capped at 25% of the tax owed. Interest also accrues from the due date until the tax is paid.5Mass.gov. 830 CMR 62C.16.2 – Sales and Use Tax Returns and Payments

How Sales Tax Is Calculated

The buyer pays 6.25% sales tax on a vehicle bought from a private party. Massachusetts calculates the tax on whichever is higher: the actual purchase price or the vehicle’s NADA clean trade-in value, adjusted for mileage.6Mass.gov. Motor Vehicle and Trailer Sales and Use Tax The condition of the car does not reduce the taxable amount. If the NADA value exceeds what you paid, you are taxed on the NADA value.7Mass.gov. Calculating Motor Vehicle Sales Tax

This surprises buyers more than anything else in the process. Buy a car from a friend for $2,000 when the NADA clean trade-in value is $8,000, and you owe 6.25% of $8,000, which is $500 in tax rather than $125. Look up the NADA value before you agree on a price so you know the real cost.

Fees at the RMV

The RMV charges a flat $75 fee for issuing a new Certificate of Title.8Mass.gov. Apply for a Certificate of Title Registration fees depend on vehicle type: a standard passenger vehicle is $60 for a biannual registration, motorcycles are $20, and commercial vehicles are priced by weight.9Mass.gov. Schedule of Fees For a typical private-sale car purchase, expect at least $135 in RMV fees before sales tax.

Inspection Within Seven Days

Every registered vehicle must pass an annual safety and emissions inspection. After registering, you have seven days to get the car inspected at a licensed inspection station.10Mass.gov. Vehicle Inspections Driving an uninspected vehicle can result in a fine, and a failed inspection means repairs before the car is road-legal. Factor this into your purchase decision, especially if the car has known issues.

Gifted Vehicles

A gifted vehicle uses the same paperwork: signed title, insurance-stamped Registration and Title Application. The difference is the sales tax, which Massachusetts waives for genuine gifts. To claim the exemption, the recipient files Form MVU-24, the Affidavit in Support of a Claim for Exemption from Sales or Use Tax for a Motor Vehicle Transferred as a Gift. Both donor and recipient sign under penalties of perjury that no payment changed hands.11Massachusetts Department of Revenue. Form MVU-24 – Affidavit in Support of a Claim for Exemption from Sales or Use Tax for a Motor Vehicle Transferred as a Gift Filing a false statement is a felony.

Separate from the state exemption, federal gift tax rules apply. If the vehicle’s fair market value exceeds $19,000, the IRS annual gift tax exclusion for 2026, the donor may need to file Form 709, though the lifetime exclusion means actual tax owed is unlikely.12Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026 Most gifted cars are well under that threshold; a late-model truck or luxury vehicle may not be.

Out-of-State Vehicles

Bringing a vehicle titled in another state adds one required step: a VIN verification. Take the vehicle to a state police barracks or local police station, where an officer physically inspects the VIN and completes a Proof of Visual Inspection form.13Mass.gov. Proof of Visual Inspection Form This is not the annual safety inspection. It is a law enforcement check confirming the VIN has not been altered or removed.

Otherwise, the process is the same: bring the out-of-state title, the stamped Registration and Title Application, the VIN verification, and payment for the $75 title fee and sales tax.14Mass.gov. Transfer Your Registration and Title from Out of State If you already paid sales tax in the state where you bought the vehicle, Massachusetts may credit that amount, but you still owe the difference if the other state’s rate was below 6.25%.

Vehicles With an Existing Loan

If the seller’s car still has an outstanding loan, the lender holds a security interest in the title, and that lien must be released before the RMV will issue a clean title in your name. Traditionally the lienholder stamped and signed the paper title or provided a lien release letter on company letterhead.15Mass.gov. Change Information on Your Vehicle Title

Many lenders now use Electronic Lien and Title (ELT) systems that transmit the release digitally to the RMV once the loan is paid off. If the lender uses ELT, there may be no paper title to hand over until the lien clears and the RMV mails a clean title. Confirm the lien is fully released before paying the seller.

Transferring a Title After the Owner Dies

Surviving Spouse

The car is treated as jointly held with right of survivorship and passes automatically to the surviving spouse unless a will says otherwise. The surviving spouse applies for a new title with a copy of the death certificate, the existing Certificate of Title, and a sworn affidavit stating the vehicle was not disposed of by will. The RMV waives the title change fee.16General Court of Massachusetts. Massachusetts General Laws Chapter 90D Section 15A

Estate Transfers

Without a surviving spouse, the process turns on the estate’s size. If the estate is entirely personal property worth no more than $25,000 plus one motor vehicle, a voluntary personal representative can use a Small Estate Affidavit after waiting 30 days from the date of death, as long as no one has filed for formal probate.17Mass.gov. Massachusetts General Laws c.190B Section 3-1201 Larger estates go through formal probate, and the court-appointed personal representative handles the transfer with probate documents and a death certificate. Either way, the person transferring the vehicle must show legal authority before the RMV issues a new title.

Mistakes That Delay Your Registration

The most common problem is showing up without the insurance stamp on your application. The second is a title assignment the seller filled in wrong. If the signature is missing or does not match the name on the title, the RMV will reject it, and fixing a title after the seller has disappeared is a serious headache.

Buyers who paid well below book value get blindsided by the sales tax bill. The RMV does not care that the car has body damage or needs a new transmission. If the NADA clean trade-in value is higher than what you paid, that is the number they use.7Mass.gov. Calculating Motor Vehicle Sales Tax

And do not let the seven-day inspection window slip. Buyers focus on titling and registration paperwork, then wait weeks to get the car inspected. If it fails, you may have a car you cannot legally drive until repairs are done.
