Massachusetts Weed Laws: Possession, Home Growing, and Driving

Under Massachusetts marijuana laws, adults 21 and older can possess up to two ounces of cannabis flower in public, keep up to 10 ounces at home, grow six plants per adult, and buy from licensed dispensaries. How Much You Can Have

You must be at least 21 to possess, use, or buy marijuana in Massachusetts.2General Court of Massachusetts. At home, you can store up to 10 ounces plus whatever your plants produce.2General Court of Massachusetts. Buying at a Dispensary

Retail sales happen only at stores licensed by the Cannabis Control Commission. Bring a government-issued photo ID showing you’re 21 or older. Taxes add up fast. Every adult-use purchase carries a 6.25% state sales tax and a 10.75% state excise tax, and cities and towns can add a local option tax of up to 3%. Growing at Home

Each adult 21 or older may grow six plants at their primary residence. A household with two or more adults over 21 caps at 12 plants total, no matter how many adults live there.2General Court of Massachusetts. Massachusetts Code Chapter 94G – Section 7

Two security rules apply. Plants must be in a locked or secured area, and they cannot be visible from a public place without binoculars or other optical aids.6Cannabis Control Commission Massachusetts. Where You Can Use It

Using marijuana in any public place, or anywhere tobacco smoking is banned, is illegal. Sidewalks, parks, restaurants, and public buildings are all off limits, with a fine of up to $100 per violation.7General Court of Massachusetts. Massachusetts Code Chapter 94G – Section 13, Penalties

Private homes are the main legal consumption space, but your landlord can prohibit smoking cannabis in your lease. The Cannabis Control Commission has confirmed that landlords can lawfully ban smoking, display, and production of marijuana on property they own.8Cannabis Control Commission. Licensed social consumption venues are on the way. The Commission approved draft regulations for three types: supplemental licenses for existing marijuana businesses to allow on-site use, hospitality licenses for non-cannabis businesses to host consumption with a licensed operator, and event organizer licenses for temporary events.9Cannabis Control Commission Massachusetts. Cannabis in Your Car

Open cannabis containers in a vehicle are treated like open alcohol containers. Marijuana with a broken seal or partly used contents anywhere in the passenger area draws a fine of up to $500.7General Court of Massachusetts. Driving Impaired

Driving while impaired by marijuana is prosecuted like drunk driving. A first offense carries a fine between $500 and $5,000, up to two and a half years in a house of correction, or both, plus a license suspension of 45 to 90 days.11General Court of Massachusetts. Massachusetts Code Chapter 90 – Section 24, Driving While Under Influence of Intoxicating Liquor There is no per se legal THC limit in blood, so officers use field sobriety tests and drug recognition evaluations. Those cases are harder to prove than alcohol OUIs, but convictions still carry serious consequences.

Gifting to Other Adults

Adults 21 and older may give marijuana to other adults 21 and older without payment or compensation.12Cannabis Control Commission Massachusetts. Guidance on Distribution of Marijuana A gift can’t be advertised or promoted to the public, and dressing up a sale as a gift, such as bundling free marijuana with the purchase of another item, is a criminal offense.

Underage Penalties and Furnishing to a Minor

Anyone under 21 who buys, tries to buy, or arranges to get marijuana faces a civil fine of up to $100 and must complete a drug awareness program. Cultivating up to 12 plants while under 21 carries the same penalty.7General Court of Massachusetts. Massachusetts Code Chapter 94G – Section 13, Penalties Offenders under 18 trigger parental notification. If a minor under 17 doesn’t finish the drug awareness program within a year, delinquency proceedings can follow.

Adults who supply cannabis to someone under 21 face much steeper penalties: a fine of up to $2,000, up to a year in jail, or both.7General Court of Massachusetts. Where Federal Law Still Applies

Massachusetts can legalize cannabis inside its borders, but marijuana is still a Schedule I controlled substance under federal law. Several situations bring that federal status into your life.

Guns

Federal law bars any “unlawful user of or addicted to any controlled substance” from possessing a firearm or ammunition.13Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Because cannabis remains illegal federally, every Massachusetts marijuana user is technically prohibited. ATF Form 4473, the questionnaire you fill out when buying a firearm, asks directly whether you are an unlawful user of marijuana. Saying yes disqualifies the purchase. Saying no while using cannabis exposes you to federal charges.

Jobs and Drug Testing

Federal contractors have to maintain drug-free workplaces under 41 U.S.C. ยง 8102, prohibiting possession or use of controlled substances on the job and imposing notification and sanction requirements when employees are convicted of drug offenses.14Office of the Law Revision Counsel. 41 USC 8102 – Drug-Free Workplace Requirements for Federal Contractors Safety-sensitive transportation workers, including commercial drivers, pilots, and transit operators, face mandatory Department of Transportation drug testing that screens for marijuana with zero tolerance.

For state-regulated private employers, the picture is different. Massachusetts courts have held that employees who use medical marijuana off-site and off-duty to treat a disability may be protected under the state’s disability discrimination law. Employers with six or more workers must consider a reasonable accommodation for off-duty medical use before taking adverse action.15Mass.gov. Federal Property

National parks, federal courthouses, post offices, and military installations follow federal law. Your state protections end at the property line. Possession there is a federal offense regardless of amount.

Crossing State Lines

Taking marijuana across state lines is a federal crime, even between two states where cannabis is fully legal. TSA officers are not specifically searching for marijuana, but if they find it during screening they are required to refer it to law enforcement, and what happens next depends on the responding officers.16TravelPulse.
