Maternity Leave for Men in California: PFL Pay and Job Protection

Fathers and non-birthing parents in California can take up to eight weeks of partial paid leave through the state’s Paid Family Leave program and up to 12 weeks of job-protected time off under the California Family Rights Act. The state doesn’t label it that way, but paternity leave in California is built from these two benefits stacked together. One replaces part of your paycheck. The other keeps your job waiting when you come back.

Pay and Job Protection Are Separate

California runs two independent programs that overlap but don’t mirror each other. Paid Family Leave (PFL) covers the paycheck side, replacing a portion of your wages while you’re off. The California Family Rights Act (CFRA) covers the job side, requiring your employer to hold your position. You can qualify for one without the other. A father at a four-person company, for instance, can collect PFL benefits but has no CFRA protection, because CFRA only applies at employers with five or more employees. Check where you stand under each system before the baby arrives.

How Much PFL Pays

PFL replaces roughly 70 to 90 percent of your wages, with lower earners getting the higher rate.1Employment Development Department. Paid Family Leave These caps adjust periodically, so verify current figures on the EDD site if your leave is still months away.

There’s no waiting period. California eliminated the old seven-day delay, and payments can begin from your first day off work.

Who Qualifies for PFL

Eligibility turns on whether you’ve paid into California’s State Disability Insurance fund. If you earned at least $300 in wages during your base period with SDI deductions withheld, you qualify.1Employment Development Department. Job Protection: CFRA and FMLA

CFRA requires employers with five or more employees to grant up to 12 workweeks of job-protected bonding leave in a 12-month period. You need more than 12 months of service with the employer and at least 1,250 hours worked in the previous year.3California Legislative Information. When CFRA applies, your employer must return you to the same or a comparable position with the same pay, duties, and general location.3California Legislative Information. California Code GOV 12945.2 – Family Care and Medical Leave Retaliation for using the leave is illegal.

Federal FMLA offers a parallel layer of protection, but only at employers with 50 or more employees within 75 miles of your worksite.5U.S. Department of Labor. Family and Medical Leave (FMLA) CFRA’s five-employee threshold reaches far more California workers. When both laws cover you, the leave generally runs concurrently, so you get 12 weeks total, not 24.

Health Insurance While You’re Out

If your leave is protected under CFRA or FMLA, your employer must keep your group health coverage going on the same terms as if you were still working.9U.S. Department of Labor. The Employer’s Guide to the Family and Medical Leave Act If they normally cover 80 percent of your premium, they keep covering 80 percent during leave. You remain responsible for your share, so work out with HR how to pay it while you’re away. Taking leave beyond the 12-week protected window changes things, and your employer may require full premium payment or move you to COBRA.

Taxes on PFL Benefits

PFL benefits are taxable federally. EDD sends a Form 1099-G in January of the following year, and the income goes on your federal return. California does not tax PFL benefits under Revenue and Taxation Code Section 17083.10Employment Development Department. Paid Family Leave Benefits and Payments FAQs

Nothing is withheld automatically. Setting aside roughly 10 to 15 percent for federal taxes avoids a surprise at filing time. You can also submit IRS Form W-4V to request voluntary withholding.

If You’re Self-Employed

Self-employed workers and independent contractors don’t pay into SDI through payroll, so PFL isn’t available unless you’ve enrolled in California’s Disability Insurance Elective Coverage (DIEC) program. To participate, you must own a business or work as an independent contractor, earn at least $4,600 in net profit per year, and operate a non-seasonal business.11Employment Development Department. Disability Insurance Elective Coverage (DIEC)

The timing is strict. You must be enrolled in DIEC for at least six months before filing a PFL claim, and you need contributions paid for at least four of the prior 12 months.11Employment Development Department. Disability Insurance Elective Coverage (DIEC) Enrollment also locks you in for a minimum of two full calendar years unless you close the business or leave California. If a child is in your plans, enroll well in advance or the benefit won’t be there when you need it.
