Maternity leave in Massachusetts can reach 26 weeks of paid, job-protected time off for a birthing parent, thanks to the state’s Paid Family and Medical Leave (PFML) program. Non-birthing parents get up to 12 weeks of paid bonding leave. On top of the paid benefit, two other laws add job protection: the Massachusetts Parental Leave Act (MPLA) covers employers with six or more workers, and the federal Family and Medical Leave Act (FMLA) covers larger employers. What you actually receive depends on your wages, your employer’s size, and which programs you qualify for.
How Much Leave and Pay You Get Through PFML
PFML is the program that actually pays you while you are out. It covers two kinds of leave that matter for new parents:1Mass.gov. Types of Paid Family and Medical Leave
- Up to 12 weeks of bonding leave per benefit year to bond with a child during the first 12 months after birth, adoption, or foster placement.2Mass.gov. PFML: About Family Leave to Bond With a Child
- Up to 20 weeks of medical leave if you cannot work for more than three consecutive days due to a serious health condition, which includes pregnancy and recovery from childbirth.1Mass.gov. Types of Paid Family and Medical Leave
- A combined cap of 26 weeks total in a single benefit year.3Mass.gov. Paid Family and Medical Leave (PFML) Overview and Benefits
A birthing parent typically starts on medical leave for pregnancy and recovery, then transitions directly into bonding leave. You can also split bonding leave off and use it later, but all of it has to be taken before the child’s first birthday, or the first anniversary of an adoption or foster placement.2Mass.gov. PFML: About Family Leave to Bond With a Child
PFML does not replace your full paycheck. Lower earners are replaced at a higher rate. The math uses your individual average weekly wage (IAWW) and the state average weekly wage (SAWW), which is $1,922.48 for 2026:4Mass.gov. How PFML Weekly Benefit Amounts Are Calculated and/or Changed
- Earnings up to 50% of the SAWW are replaced at 80%.
- Earnings above 50% of the SAWW are replaced at 50%.
- The maximum weekly benefit for 2026 is $1,230.39.
So a worker with an IAWW of $900 would see about $720 per week. A higher earner hits the $1,230.39 ceiling regardless of how much more they make.
Timing Rules That Catch People Off Guard
Your PFML benefit year is personal to you. It starts on the Sunday before your first day of leave and runs for 52 consecutive weeks. Your benefit rate is locked in for that whole year, even across multiple applications.3Mass.gov. Paid Family and Medical Leave (PFML) Overview and Benefits
There is also a 7-day waiting period at the start of your leave before payments begin. Those seven days still count against your total available leave. You can use accrued paid time off during the waiting period, and your job is protected the whole time.3Mass.gov. Paid Family and Medical Leave (PFML) Overview and Benefits
How to Apply for PFML
Start well before your due date or placement date. Missing a step delays your first payment.
- Give your employer at least 30 days’ notice before your leave starts. If an emergency or early delivery makes that impossible, notify your employer as soon as you can, always before you file the application.5Mass.gov. 2026 Employer Notice for a Workforce With 25 or More Covered Individuals
- Create an account and apply online at paidleave.mass.gov. You will need your Social Security number or ITIN, your employer’s federal EIN, a valid photo ID, and bank account information for direct deposit.6Mass.gov. How to Apply for Paid Family and Medical Leave (PFML)
- Submit documentation. Bonding leave requires one document showing the birth or placement date: a birth certificate, a provider statement, a hospital birth record, or a certification from an adoption or foster care agency. Medical leave requires a certification from your health care provider.7Mass.gov. Required Documents for Your Paid Family and Medical Leave (PFML) Application

The Two Other Laws That Stack On Top
Massachusetts Parental Leave Act
The MPLA provides eight weeks of job-protected leave for the birth or adoption of a child under age 18, or under 23 if the child has a disability. It applies to any employer with six or more employees. To qualify, you must have completed your employer’s initial probationary period, which cannot exceed three months.8Mass.gov. Parental Leave in Massachusetts
The MPLA does not guarantee pay. Whether it is paid or unpaid is up to the employer. When you return, your employer must restore you to the same or a similar position, with comparable status, duties, schedule, and commute. If both parents work for the same employer, they share the eight weeks total for the same child rather than getting eight weeks each.9Mass.gov. Massachusetts Law About Parental, Family and Medical Leave
Federal Family and Medical Leave Act
FMLA provides up to 12 weeks of unpaid, job-protected leave per year for the birth or placement of a child. Your employer must also keep your group health insurance in force during the leave on the same terms as if you were still working.10U.S. Department of Labor. Family and Medical Leave (FMLA)
Eligibility is narrower than the state programs. You need 12 months of employment with a covered employer, at least 1,250 hours worked during the preceding 12 months, and a worksite where the employer has 50 or more employees within 75 miles.11U.S. Department of Labor. Fact Sheet #28H: 12-Month Period Under the Family and Medical Leave Act (FMLA) You keep paying your normal share of health insurance premiums. These Programs Run Concurrently, Not Back-to-Back
This is where people leave time on the table. PFML, FMLA, and the MPLA run at the same time when you qualify for more than one. The 12 weeks of PFML bonding leave satisfy FMLA’s 12 weeks and the MPLA’s eight weeks simultaneously; they do not stack end to end.13Mass.gov. PFML Frequently Asked Questions for Employees
For a birthing parent who qualifies for all three programs and has a medically certified pregnancy-related condition, a typical timeline looks like this:
- Weeks 1 through 8 (or longer): PFML medical leave for pregnancy and recovery, with FMLA and MPLA running concurrently.
- After medical leave ends: transition to PFML bonding leave for up to 12 additional weeks, with FMLA continuing until it hits its 12-week limit.
- Combined paid total: up to 26 weeks in the benefit year, depending on how much medical leave your provider certifies.1Mass.gov. Types of Paid Family and Medical Leave
A non-birthing parent with no personal medical condition is eligible for up to 12 weeks of paid bonding leave through PFML, with FMLA and the MPLA running concurrently.
Topping Off PFML With Paid Time Off
Because PFML replaces only a portion of your wages, you can supplement your weekly benefit with accrued PTO up to the amount of your individual average weekly wage. If your IAWW is $2,000 and PFML pays $1,100 per week, you can use up to $900 of PTO per week to close the gap. Your employer is responsible for making sure the combined amount does not exceed your IAWW.13Mass.gov. PFML Frequently Asked Questions for Employees
Protections Before, During, and After Leave
Retaliation
Your employer cannot fire, demote, discipline, suspend, or otherwise punish you for taking or applying for PFML. Protection begins as soon as you tell your employer you plan to take leave. Any negative job change during your leave or within six months after you return is presumed to be unlawful retaliation, which shifts the burden to your employer to prove otherwise. If your employer retaliates, you can file a civil lawsuit in Massachusetts Superior Court. These protections apply even if your employer uses a private plan instead of the state PFML program.14Mass.gov. Notices, Appeals, and Employee Protections Under Paid Family and Medical Leave (PFML)
Pregnancy Accommodations
Under the federal Pregnant Workers Fairness Act and Massachusetts General Laws Chapter 151B, employers must provide reasonable accommodations for pregnancy and related conditions through an interactive process, unless doing so would cause undue hardship. Common accommodations include more frequent breaks, seating, modified schedules, temporary reassignment to lighter duties, and permission to keep water nearby. An employer cannot force you onto leave in place of an accommodation you have requested.15eCFR. Part 1636 – Pregnant Workers Fairness Act
Nursing Breaks
Under the federal PUMP Act, most employees have the right to reasonable break time to express breast milk at work for up to one year after the child’s birth. Your employer must provide a private space that is not a bathroom, shielded from view and free from intrusion. If you telework, your employer cannot require you to be visible on camera during pumping breaks.16U.S. Department of Labor. Fact Sheet #73: FLSA Protections for Employees to Pump Breast Milk at Work
Taxes on PFML Benefits
Family leave benefits (bonding leave) are fully taxable as income at both the state and federal level. Medical leave benefits are treated differently depending on employer size. At companies with 25 or more covered individuals, only 60% of medical leave benefits are subject to income tax withholding, reflecting the employer’s contribution share. At smaller companies (fewer than 25 covered individuals), medical leave benefits are not subject to income tax withholding at all, because the full contribution comes from the employee’s own wages.17Mass.gov. Taxes on Paid Family and Medical Leave (PFML) Benefits
When you apply, you can choose to have taxes withheld from each payment. The most common option is 5% for Massachusetts state income tax and 10% for federal income tax. You can also set a custom federal amount using IRS Form W-4S. If you skip withholding, set money aside; you may owe when you file.17Mass.gov. Taxes on Paid Family and Medical Leave (PFML) Benefits
Eligibility at a Glance
Qualifying for one program does not automatically qualify you for the others.
- PFML. You must meet an earnings requirement tied to your wages during the base period leading up to your leave. Self-employed individuals can opt in through MassTaxConnect.2Mass.gov. PFML: About Family Leave to Bond With a Child
- MPLA. You must work for an employer with six or more employees and have completed the initial probationary period, which cannot exceed three months.8Mass.gov. Parental Leave in Massachusetts
- FMLA. You must have worked at least 12 months for a covered employer (50 or more employees within 75 miles) and logged at least 1,250 hours in the preceding 12 months.10U.S. Department of Labor. Family and Medical Leave (FMLA)
The MPLA’s six-employee threshold matters. If you work at a small company that does not meet FMLA’s 50-employee requirement, you still have job-protected leave under the MPLA and, if you meet the earnings requirement, paid benefits through PFML.
