Michigan 1099 filing requirements apply any time a business pays a non-employee $600 or more during the year: you must send the contractor a 1099-NEC or 1099-MISC, file copies with the IRS, and file a separate copy with the Michigan Department of Treasury through the Michigan Treasury Online portal. If you’re the person receiving a 1099, you report that income on your MI-1040 at Michigan’s flat 4.25% rate and usually need to make quarterly estimated payments because no state tax is withheld.
When You Have to Issue a 1099
A trade or business that pays an individual, partnership, or (in some cases) corporation at least $600 for services during the calendar year must report those payments on a 1099.1Internal Revenue Service. Am I Required to File a Form 1099 or Other Information Return? The threshold is cumulative over the year, not per check. Which form you use depends on what the payment was for:
- Form 1099-NEC covers nonemployee compensation of $600 or more: fees, commissions, and payments to independent contractors. Attorney fees paid in the course of business go here too.
- Form 1099-MISC covers rent of $600 or more, royalties of $10 or more, and certain other payments such as gross proceeds paid to attorneys in settlements.
The two forms have different deadlines, and the IRS treats putting a payment on the wrong form as a filing error.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
Get a W-9 Before You Pay
Have the contractor fill out IRS Form W-9 before the first payment. The form gives you their legal name, tax classification, address, and Taxpayer Identification Number, and it includes their certification about backup withholding.3Internal Revenue Service. If a TIN is missing or doesn’t match IRS records, you may have to begin federal backup withholding at 24% on everything you pay that contractor until the problem is fixed.4Internal Revenue Service. Backup Withholding That rate applies for the 2026 tax year.5Internal Revenue Service. Publication 15 (2026), Employer’s Tax Guide Collecting the W-9 up front is much easier than chasing a corrected number after you’ve already paid and filed.
Michigan Doesn’t Require Withholding on Contractor Pay
Michigan does not require businesses to withhold state income tax from payments to independent contractors.6Michigan Legislature. Contractor Penalty – House Bill 6239 The default rate is zero, and a business only withholds if the contractor asks for it, which is unusual. The contractor handles their own Michigan tax, usually through quarterly estimated payments.
One narrower rule to know: flow-through entities such as partnerships and S corporations may need to withhold Michigan income tax on distributions to non-resident members unless those members file an exemption form with the entity.
Filing 1099s With the Michigan Department of Treasury
Filing with the IRS doesn’t satisfy your Michigan obligation. The state wants its own copy, submitted directly through Michigan Treasury Online (MTO). Michigan doesn’t rely on the IRS Combined Federal/State Filing Program for all 1099 data, so a direct state filing is needed.
Deadlines track the federal schedule:
- Form 1099-NEC: January 31, whether on paper or electronic.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
- Form 1099-MISC: February 28 on paper, March 31 electronic.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
- Form 5081, Michigan’s Sales, Use, and Withholding Taxes Annual Return, is a separate filing due February 28.7State of Michigan. 2024 Sales, Use and Withholding Taxes Annual Return (Form 5081)
Paper filers must include Form 447 as a transmittal cover sheet.8State of Michigan. 447, Transmittal for Magnetic Media Reporting of W-2s, W-2Gs and 1099s Electronic filing through MTO is generally faster and more reliable.
Penalties for Late or Missing 1099s
Federal penalties escalate with how late the form is, and they apply per form. For the 2026 tax year:
- Up to 30 days late: $60 per form
- 31 days late through August 1: $130 per form
- After August 1 or never filed: $340 per form
- Intentional disregard: $680 per form, with no cap
Penalties apply separately for failing to file with the IRS and for failing to furnish a correct statement to the payee, so one missed form can trigger two penalties.9Internal Revenue Service. Information Return Penalties A business that misses the deadline on ten contractors can be looking at $6,800 or more at the federal level alone. Michigan may add state-level penalties for late Treasury submissions.
If You Received a 1099 in Michigan
Income on a 1099-NEC or 1099-MISC gets reported on your Michigan Individual Income Tax Return (Form MI-1040). Michigan’s flat rate for the 2026 tax year is 4.25%.10State of Michigan. 2026 Michigan Income Tax Withholding Guide The Michigan return starts with your federal adjusted gross income, so finish the federal return first and carry the number over.
Because nothing was withheld, you’ll usually owe when you file. If you expect to owe more than $500, Michigan requires quarterly estimated payments on Form MI-1040ES rather than one lump sum at the deadline.11State of Michigan. Am I Required to Make Estimated Tax Payments?
Quarterly Due Dates
Michigan follows the federal quarterly schedule: April 15, June 15, September 15, and January 15 of the following year. If a due date lands on a weekend or holiday, it moves to the next business day.12State of Michigan. 2025 MI-1040ES, Michigan Estimated Income Tax for Individuals You can also pay the full year’s estimate with the April voucher if that’s simpler.
Safe Harbor to Avoid Underpayment Penalties
To avoid Michigan underpayment penalties, your total payments (estimates plus any withholding) need to hit at least one of these marks:
- 90% of your current year’s Michigan tax liability
- 100% of your prior year’s Michigan tax liability
- 110% of your prior year’s liability if your prior-year adjusted gross income was over $150,000 ($75,000 if married filing separately)12State of Michigan. 2025 MI-1040ES, Michigan Estimated Income Tax for Individuals
The easiest route for most contractors is to base estimates on 100% of last year’s Michigan tax, since the number is already settled.
Non-Residents and Reciprocal Agreements
If you live outside Michigan but earned income from work performed in the state, you owe Michigan tax on the Michigan-sourced portion. Non-residents file Form MI-1040NR and allocate only the income tied to Michigan activity. Business income is generally apportioned using a sales-factor formula. Non-residents also owe quarterly estimated payments if they expect to owe more than $500.11State of Michigan. Am I Required to Make Estimated Tax Payments?
Michigan has reciprocal agreements with Illinois, Indiana, Kentucky, Minnesota, Ohio, and Wisconsin.13State of Michigan Department of Treasury. Revenue Administrative Bulletin 2017-13 Individual Income Tax – Reciprocal Agreements Those agreements only cover wages and salaries. They do not cover independent contractor income. An Indiana resident doing freelance work in Michigan still owes Michigan tax, files an MI-1040NR, and then claims a credit on the Indiana return to avoid double taxation. Reciprocity also does not extend to local city income taxes.
Michigan Local City Income Taxes
Roughly two dozen Michigan cities impose their own income tax on top of the state’s 4.25%. Detroit’s rate is the highest. Most other cities charge around 1% for residents and 0.5% for non-residents who work within city limits. Contract work performed in one of those cities can create a local tax bill even if you don’t live there.
City income taxes are filed on separate city returns, not on the MI-1040, and each city sets its own deadlines and procedures. Local tax isn’t withheld or reported on a 1099 by default, which catches some contractors off guard. If you regularly work in Detroit, Grand Rapids, or another taxing city, build the local rate into your quarterly estimates.
1099-K Overlap With 1099-NEC
If clients paid you through PayPal, Venmo, or a credit card processor, you may also receive a Form 1099-K. The federal 1099-K threshold is $20,000 in gross payments and more than 200 transactions during the year, and both conditions have to be met before the platform must issue the form.14Internal Revenue Service. IRS Issues FAQs on Form 1099-K Threshold Under the One, Big, Beautiful Bill
A 1099-K doesn’t create a new tax; the income was already reportable. The risk is double-counting. If a client sends a 1099-NEC for the same payments the processor reports on a 1099-K, keep records so you can back out the overlap on your Michigan return.
