Michigan 1099 filing requirements apply to any business that issues a 1099 to a Michigan resident, regardless of where the business is located or whether Michigan tax was withheld. You file state copies of the same federal forms with the Michigan Department of Treasury, usually through Michigan Treasury Online (MTO), by deadlines that track the federal ones for each specific form.1State of Michigan. Which 1099 Forms You Must File and By When
Michigan treats several forms as “income record forms” that must be filed with Treasury: W-2, W-2C, W-2G, 1099-NEC, 1099-MISC, 1099-K, 1099-R, 1099-DA, and any other form showing Michigan withholding.1State of Michigan. Income Record Form Remittance Guide For businesses paying non-employees, the forms that come up most often are:
- 1099-NEC for non-employee compensation of $600 or more paid to independent contractors and other self-employed workers.
- 1099-MISC for rent, royalties, prizes, and other miscellaneous payments at federal reporting thresholds.
- 1099-R for distributions from pensions, annuities, retirement plans, IRAs, and insurance contracts.
- 1099-K for payment card and third-party network transactions above the federal threshold.
Michigan does not publish its own 1099 form. You file copies of the federal forms, and the state follows IRS guidelines for deciding which federal form applies to a given payment.2State of Michigan. W-2 and 1099 Filing Requirements
Deadlines differ by form type, and this is where filers slip:
- 1099-NEC is due to both the IRS and Michigan Treasury by January 31, whether filed on paper or electronically.3Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
- 1099-MISC, 1099-R, 1099-K, and 1099-DA are due to Michigan by February 28 on paper, or March 31 if filed electronically.1State of Michigan. Income Record Form Remittance Guide
- Recipient copies of all forms must be furnished to payees by January 31.4Internal Revenue Service. General Instructions for Certain Information Returns (2025)
When a deadline lands on a Saturday, Sunday, or legal holiday, it moves to the next business day. For tax year 2025 filings due in early 2026, the IRS lists February 2, 2026 as the adjusted 1099-NEC deadline.4Internal Revenue Service. General Instructions for Certain Information Returns (2025)
The 1099-NEC date is the one that catches people. There is no extra time for electronic filers the way there is with 1099-MISC. If your workflow batches all 1099s together and targets late March, you will miss the contractor filing. Build the January 31 date into your calendar as the hard stop and treat the March electronic window as room to clean up 1099-MISC errors rather than a general deadline.
How to File With Michigan Treasury
Treasury strongly prefers electronic filing through MTO.5State of Michigan. W-2 and 1099 FAQs Any issuer can use the MTO W-2 and 1099 Guest Service without creating a full MTO account. If you issue 10 or more income record forms, you are required to submit a magnetic media formatted file through MTO. Successful uploads return a confirmation number, which is your proof of filing.
Issuers with fewer than 10 forms can scan the physical copies and upload them as a PDF through MTO, or send them by mail.5State of Michigan. W-2 and 1099 FAQs Electronic filing is still worth doing at that volume because of the confirmation receipt.
The CF/SF Trap for 1099-NEC
Michigan participates in the IRS Combined Federal/State Filing (CF/SF) program, which shares certain 1099 data with the state when you file through the federal FIRE system.1State of Michigan. Income Record Form Remittance Guide But 1099-NEC is excluded. You must file 1099-NEC directly with Michigan Treasury through MTO regardless of whether you participate in CF/SF.5State of Michigan. W-2 and 1099 FAQs The IRS will not forward the data for you. Businesses that assume CF/SF handles the state copy of their contractor forms are missing their most common Michigan filing.
Form 5081 Annual Reconciliation
Michigan also requires an annual reconciliation on Form 5081, the Sales, Use, and Withholding Taxes Annual Return. Part 3 asks for the total number of W-2 and 1099 forms you issued and the total Michigan income tax withheld across all of them.6State of Michigan. Instructions for 2026 Sales, Use and Withholding Taxes Annual Return (Form 5081) Form 5081 is due February 28 of the following year.
Do not attach copies of your W-2s or 1099s to Form 5081. The instructions direct you to file those separately through MTO or the methods described in the Income Record Form Remittance Guide.6State of Michigan. Instructions for 2026 Sales, Use and Withholding Taxes Annual Return (Form 5081) Treasury uses Form 5081 as a summary to cross-check that your individually filed forms add up correctly, so the totals on 5081 need to match what you uploaded.
Michigan City Income Tax Copies
Michigan adds an obligation most states do not: if a 1099-MISC payee’s address falls within a Michigan city that imposes its own income tax, you must file a copy of that 1099-MISC with the city as well.7Michigan Legislature. MCL 206-707 – Income Tax Act of 1967 About two dozen Michigan cities levy an income tax, including Detroit, Grand Rapids, Lansing, Flint, and Saginaw.
Because the requirement turns on the address printed on the form, verifying payee addresses matters. Collecting a fresh W-9 from each contractor at the start of the tax year catches address changes before they become filing errors.8Internal Revenue Service. Instructions for the Requester of Form W-9 Most accounting software will not flag the city obligation automatically, so keep your own checklist of taxing cities and run payee addresses against it before you finalize filings.
Withholding on Payments Reported on a 1099
Michigan does not require withholding on payments to independent contractors reported on 1099 forms. The state follows federal guidelines, and because the IRS does not require withholding on contractor payments outside backup withholding situations, Michigan does not either.9State of Michigan. Withholding Tax Basics A business may withhold voluntarily if the worker asks.
Pension and annuity payments on 1099-R are different. Entities within Michigan’s taxing jurisdiction that disburse pension or annuity payments are required to withhold Michigan income tax unless the recipient opts out using Form MI W-4P.10State of Michigan. Michigan Form 4924 – Withholding Certificate for Michigan Pension or Annuity Payments If no MI W-4P is submitted, the administrator may withhold anyway, and a recipient who elects no withholding may need to make estimated tax payments.
Penalties for Late or Missing Filings
Michigan and the IRS each impose their own penalties on information returns, and both can apply to the same late filing.
Federal Penalties
For returns due in 2026, the IRS penalty for a late, incorrect, or missing information return runs on a tiered schedule:
- $60 per form, up to 30 days late.
- $130 per form, 31 days late through August 1.
- $340 per form after August 1, or if the form is never filed.
- $680 per form for intentional disregard, with no annual cap.
These amounts are assessed per form.11Internal Revenue Service. Information Return Penalties A separate penalty under the same tier structure applies for failing to furnish correct payee statements to recipients.4Internal Revenue Service. General Instructions for Certain Information Returns (2025)
Michigan Penalties
Michigan does not mirror the federal schedule. For failure to file a 1099-MISC with Treasury, Michigan assesses a flat $50 per unfiled form.7Michigan Legislature. MCL 206-707 – Income Tax Act of 1967 More broadly, failure to file any required information return can draw $10 per day for each separate failure, up to $400 per failure.12Michigan Legislature. MCL 205-24 – Revenue Division of Department of Treasury These stack with the federal penalties on the same form.
Records You Need to Keep
Michigan requires every person subject to income tax to keep records sufficient to determine their liability for six years.13Michigan Legislature. Michigan Compiled Laws Chapter 206 – Income Tax Act of 1967 For 1099 filers that covers copies of each form issued, the W-9s collected from payees, underlying payment records, and related correspondence.
The six-year rule outruns the standard four-year audit window for a reason. Michigan’s general statute of limitations for assessing a tax deficiency is four years from the filing deadline or the actual filing date, whichever is later, but that window extends in two situations: fraudulent concealment gives Treasury two additional years from discovery, and an open federal audit or litigation extends Michigan’s window for the duration of that process plus one year.14Michigan Legislature. MCL 205-27a – Revenue Division of Department of Treasury Keeping records for six years covers nearly every scenario where Treasury can still come back to you.
