Michigan BAIID: Who Needs It, How It Works, and Violations

If you’ve been convicted of operating while intoxicated in Michigan with a blood alcohol content of 0.17 or higher, or you have repeat OWI convictions on your record, Michigan’s Breath Alcohol Ignition Interlock Device program is almost certainly in your future. A BAIID in Michigan is a court- and Secretary of State-ordered breath testing unit wired into your vehicle’s ignition that keeps the engine from starting if it detects alcohol, and getting through the required period without violations is the main thing standing between you and a full license.

Who Has to Install One

The requirement is automatic for a “super drunk” offense, meaning a first OWI with a BAC of 0.17 or higher. The Secretary of State suspends your license for one year, and after the first 45 days you can only get back on the road with a restricted license if every vehicle you own or drive has a BAIID installed. You also have to complete an alcohol treatment program.1State of Michigan. Impaired Driving Law

Repeat offenders face revocation rather than suspension. A second OWI within seven years, or a third within ten years of two prior convictions, revokes your license. To drive again, you generally need to complete a sobriety court program and install a BAIID, and a hearing officer won’t consider restoring an unrestricted license until you’ve logged at least one year on the interlock.2Michigan Legislature. Michigan Code 257.304 – Restricted License; Issuance; Conditions

Courts can also order a BAIID as a probation condition for a first OWI with a BAC below 0.17, but it isn’t mandatory in those cases.

The First 45 Days: No Driving at All

After a super drunk conviction, you cannot drive for the first 45 days. There is no restricted license during that window and no work or family hardship exception.1State of Michigan. Impaired Driving Law A restricted license becomes possible only after day 45, once the BAIID is installed on every vehicle you own or operate and, for sobriety court participants, the judge certifies your admission into the program.2Michigan Legislature. What a Restricted License Actually Lets You Do

A restricted license is not a lighter version of a regular license. The permitted destinations are set by statute, and anything not on the list is off limits. Under MCL 257.304, you may drive:

  • To, from, and during the course of your employment, provided the job doesn’t require a commercial driver license
  • To court-ordered alcohol, drug, or mental health treatment, and to meetings like Alcoholics Anonymous or Narcotics Anonymous
  • To court hearings, probation appointments, community service, and court-ordered drug or alcohol testing
  • To an educational institution where you’re enrolled
  • To regular medical treatment for a serious condition, or in a medical emergency involving you or an immediate family member
  • To your ignition interlock service provider for calibration and data downloads
  • If a judge allows it, to take minor children in your custody to daycare, school, or school activities

Driving to a grocery store, a friend’s house, or anywhere outside that list can produce new charges on top of your existing case.2Michigan Legislature. Michigan Code 257.304 – Restricted License; Issuance; Conditions

How the Device Works Day to Day

Before the engine starts, the BAIID requires a breath sample. A reading of 0.025 grams or more per 210 liters of breath blocks the start. The device also captures a digital image of whoever is blowing, along with the time and date, so that someone else can’t provide the sample for you.3Michigan Legislature. Michigan Compiled Laws 257.625k – Ignition Interlock Device Certification

Rolling retests follow once you’re moving. The first prompt comes within 5 to 15 minutes of starting, and the device asks again every 15 to 45 minutes while the engine runs. You have up to five minutes to deliver a passing sample, and the device permits multiple attempts before escalating.

Fail a rolling retest, or miss the window, and the device logs the violation and sounds a warning. It will not shut off a moving vehicle. But once you stop and turn the engine off, you won’t be able to restart without a clean sample, the free-restart feature is disabled, and a five-day countdown to a permanent lockout begins. Clearing that lockout means a visit to your service provider.4Michigan Legislature. Michigan Code 257.625k – Ignition Interlock Device Certification

Every start attempt, retest, result, and tampering event lives in the device’s data logger. Your service provider downloads it during routine appointments and reports it to the Secretary of State.

Costs and Approved Providers

As of 2026, Michigan’s approved BAIID manufacturers are Alcohol Detection Systems, Smart Start, LifeSafer Interlock, RoadGuard Interlock, and Intoxalock. You contact the manufacturer directly to find a service center and schedule installation, which usually takes a couple of hours.5State of Michigan. Ignition Interlock Manufacturers List

Installation fees generally run up to $200. Monthly lease and monitoring fees typically fall in the $55 to $90 range, continuing for the entire interlock period, which is at minimum a year. A removal fee at the end adds more. For qualifying individuals who receive a no-cost installation due to hardship, Michigan law caps the daily maintenance fee at $2.00.6Michigan Legislature. House Bill No. 6230 A typical one-year BAIID period totals roughly $800 to $1,500 in device costs alone, before any court fees or fines.

Plan on service visits every 30 to 60 days for calibration and data downloads. Missing one triggers a lockout countdown, so these appointments are not optional.

What Happens If You Tamper or Skip the Device

Under MCL 257.625l, tampering with the BAIID, trying to bypass it, driving a vehicle that doesn’t have the required device, or asking someone else to blow for you is a misdemeanor punishable by up to six months in jail, a fine of up to $5,000, or both. That’s a separate criminal charge stacked on top of your existing OWI consequences.7Michigan Legislature. Michigan Code 257.625l – Ignition Interlock Device; Warning Label; Prohibited Conduct

Administrative penalties pile on. BAIID violations are reported to the Secretary of State and can extend your interlock period, suspend your restricted license, or re-revoke your driving privileges entirely. When your reinstatement hearing comes around, hearing officers read violations as evidence that you remain a risk, and a pattern of them can push license restoration back by years.

Innocent Triggers That Still Count Against You

Mouthwash containing alcohol, certain medications, and fermented foods can all produce a failed reading. The device records the failure regardless of the cause. If this happens, get to your service provider quickly and document what happened, because unexplained failures look bad on your record.

Getting the Device Off and the License Back

Removing the device is not the same as restoring your license. You have to go through a hearing with the Office of Hearings and Administrative Oversight, formerly the Driver Assessment and Appeal Division. The hearing officer reviews your driving record, your BAIID data logs, and your compliance with every court-ordered condition.8State of Michigan. Office of Hearings and Administrative Oversight – License Restoration

Before an unrestricted license is ordered, you have to show:

  • Successful completion of the sobriety court program, if one applied to you
  • Completion of the minimum license sanction period under MCL 257.303 or 257.319
  • At least one year of driving with the ignition interlock device without significant violations
  • Satisfaction of the requirements under MCL 257.303 and the Michigan Administrative Code

Hearing officers have broad discretion. A clean BAIID record with no failed tests, no missed calibrations, and no tampering events is the strongest card you can play. One or two unexplained violations can produce a denial or an extended restricted period, so the compliance record you build in the months before your hearing is doing real work.2Michigan Legislature. Narrow Exceptions

Challenging a BAIID reading is possible but difficult. The usual argument is a false positive from mouthwash, cough medicine, fermented food, or a device malfunction, and it typically needs technical evidence from the provider’s calibration records or expert testimony. Courts hear these claims often and are skeptical without strong documentation.

Medical exemptions exist for people whose conditions physically prevent an adequate breath sample, such as severe respiratory disease. Michigan courts can order the device removed with thorough physician documentation. A medical exemption generally does not let you drive freely; it typically means no driving until the underlying license sanction period ends.9Michigan Courts. Financial hardship can qualify you for reduced-cost or no-cost installation, with the maintenance fee capped at $2.00 per day. Courts can also order the device removed for financial reasons, though this is rare and requires comprehensive documentation that the costs would prevent you from meeting basic living expenses.6Michigan Legislature. Insurance and the Fee That No Longer Applies

An OWI that triggers an interlock typically produces a major auto insurance premium increase, averaging around 80% nationally with wide variation by insurer and driving history. You will likely need an SR-22 high-risk filing, which adds cost and sits on your record for years. Some insurers offer a modest discount for an active BAIID, but the base premium increase is larger.

Michigan used to assess a $1,000 annual Driver Responsibility Fee for two consecutive years after a drunk driving conviction, adding $2,000 in costs. That fee was eliminated effective October 1, 2018, and the state can no longer assess or collect it, even though older references to it still circulate.10State of Michigan. Gov. Rick Snyder Signs Legislation to Accelerate Elimination of Driver Responsibility Fees

BAIID expenses are generally not tax-deductible. The IRS treats medical expenses that diagnose, cure, or treat a disease as deductible, and no IRS guidance treats a court-ordered interlock as a qualifying medical expense.

If You Live or Move Out of State

Michigan participates in the Driver License Compact, built around “one driver, one license, one record.” An OWI conviction in Michigan is reported to your home state and generally treated as though it happened there. The reverse holds too: an out-of-state OWI follows you back to Michigan and can trigger BAIID requirements here.

Moving during your interlock period does not erase Michigan’s requirements. Your new state will see the Michigan suspension or revocation on your record and may refuse to issue a license until Michigan clears you. Expect to finish the BAIID obligation and complete the reinstatement process through the Office of Hearings and Administrative Oversight before another state will issue you a license.
